Find a good attorney. A regular civilian fighting a ticket in court isn't going to have the odds in his favor. The only time I won was when the officer didn't show up. I tried fighting another one on my own and just got beat up. My last one I used a terrific attorney in the Seattle area. She is batting 1000% for anyone I know that she has defended. Not that I get speeding tickets or anything...

Dennis,
I still suspect you may be part of an alien race from another planet; it is the only logical explanation I can come up with for your extra large noggin, and super human smarts!

Dave (btw, your mom has me on "direct deposit" so you're covered for this month's payment)

i dunno, dude. if you were driving a two wheeled vehicle with only one wheel on the ground, i'd be surprised if a judge would buy that you were driving safely. physics happens, of course, but if i were power sliding around a corner, even within the speed limit, i'd get ticketed like you read about - even though _I_ think i'm in complete control and don't represent any sort of risk to myself, others, or any property.

not trying to be difficult - just suggesting that that might be a tough one to fight. fight 'em all, for sure, though!

The book is: Beat Your Ticket, by David Brown, Nolo Press. The author discusses how lasers can be inaccurate, and how some court do not accept them as accurate. I'd take a look at: Izer v State, A98A2475 Ct/ App. Ga, Feb 5, 1999 for a case which holds lasers are not accurate.

Anyone have any suggestions regarding a ticket for careless driving?

I was out on my Ducati with a passenger and the Cop claimed I was doing a wheelie. I was going about 20Mph in a 55Mhp after a car pulled out in front of me. I then downshifted into first and began to accelerate back up to speed. The front wheel may have come off the ground a few inches but not with the intension of being careless. Or as the law states "without due caution and circumspection, in a manner so as to endanger, or be likely to endanger, a person or property" The Officer was more likely to endanger property as he speed towards me nearly running me down with his cruiser.

Any suggestions would be appreciated.

i believe alexlee is correct. laser definitely did not used to work if it wasn't stationary. maybe it's been updated, but i'd be surprised.

I thought laser had to be stationary when used? There was a case when laser first came out where during the trial the defendent picked up the laser gun and targeted the wall. While he targeted the wall, he moved his hands along and the gun registered that the wall was doing 2 MPH. Case was tossed.

Drew, start here:
http://www.motorists.org/issues/tickets/index.html

The National Motorists Association is a great organization (fighting for YOUR RIGHTS), and they are a great resource if you need to fight a ticket.

Hubert, I think you may be a bit mistaken about errors with laser speed guns. Cops can get erroneous readings if the shot is taken at an ANGLE to the target. As the angle of incidence increases (when the shot deviates from a direct line either in front or to the rear of the vector of travel), the accuracy will decrease. Problematically for speeders like you and me, the error results in the indicated speed DECREASING as you move off this centerline. This phenomenon is called the Cosine Effect, because the measured speed is directly related to the cosine of the angle between the gun and the targets direction of travel. At 90 degrees, the speed would be ZERO.

Lastly, Dave Handa, my mother needs your address to write you a check for your kind words. I wouldn't say that Radartest.com is complete BS, but suffice it to say that it definitely shows a strong, undisclosed bias. Check the archives using "radartest" as a key word.

vty,

--Dennis

Thanks for the heads up, careful on Radartest.com, as they are not known for being the most objective on their testing protocol....there are a number of threads on this site about detectors and jammers. Check the archives and see the posts by "Dennis" or "bigheaddennis" as he is the smartest guy I know, and if he says a particular brand is best, you can trust he has spent many days/weeks researching and checking references before recommending anything. I'm pretty sure he was the one who said radartest.com is not to be trusted.

I was at the start of the Barnet Hwy. I was ahead of a pack of cars with no one in front and punched it just a little and then took my foot of the gas letting the RPM's slow me down.

I was putting around all day and this was just bad luck. I was on my way to the car stereo store so he could measure for templates for rear speakers. Oddly enough I was already pondering a detector/laser jammer with them. Needlessly to say I bought the system. Escort SR7 Detector/ZR3 Jammer. www.radartest.com say there the best?

Dave,

Were you part of the group from Vancouver and Seattle that got stranded in Whistler last week? I was going to show up in NorthVan but it was one of the wetest day ever recorded in Vancouver.

You're in "sunny" Vancouver I see.......if it was foggy or cloudy or raining(fat chance, eh...top down in the rain ?) that diminishes the beam significantly to probably suggest in court that the reading as not accurate.

In the army we had laser rangefinders as well as stereoscopic "visual" range finders on the Leopard A4 MBT......when the weather was lousy and the laser couldn't "ping" properly, we switched over to the good old MKII "eyeball" sights.

Location? Since I drive up there a couple times a month....VPD or RCMP? I try to drive pretty safe and sane in the city, but always hit 180-200kph on the way down 99 to the border. :-)

Today was a glorious day here in Seattle; we had a number of cars get together for a drive, including "Rumordude" in his F50! Check the "Northwest" region, as I am sure pictures will be posted!

do an online search, there's plenty of reference material. one way to discount the lasers accuracy is the incident angle at which your were "zapped."

How ironic that I was just reading the discussion on what to do when you get pulled over and the very next day I get my first ticket in 5 years.

The cop clocked me doing 95Kms/hr on a 50Kms/hr road from inside his car heading in the other direction with "Laser". Is there any real defense if it went to court?
