This was bought in the Far East and I doubt that it is a licensed product. It is embroidered with Michael Schumacher Formula 1 Champion 2001 on the left and the Prancing Horse on the right with Formula 1 written on the sleeves. They will cost approximately US$50 plus p+p. It is lightly padded cotton and is ideal for spring or cool summers.

The major issue is that you would be infringing on the Ferrari trademark. Fortunately, its not such a problem where I live.

Some of this stuff gets out of hand. Similarly, Verizon had a little tiff when someone registered their website as verizonwirelesssucks.com. The industry joke is that they would try to trademark the "V" peace sign you make with your pointer and middle finger. Now that would be comical on some levels.

it's all about usage in a context, and the potential for a consumer to confuse products or brandings.

ferrari does not have protection on the word "maranello" but if you tried to build a car called a "maranello" you would make your lawyers even richer :-).

How car Ferrari trademark the name of a city? Thats a rather public thing. Silly question but can they do that just to name a car. When its named after a public entity, how can they defend that.

Basically, Ferrari has design patents and trademark registration on every name and logo they use. There was a story published recently about two brothers in Europe who built a replica of the Ferrari F1 car. The brothers showed the car at some events and, here's the kicker, were paid for bringing the car.

Ferrari sued them for 250,000 Euros (about $200K). This was for actual and punitive damages. Ferrari won, but the judge reduced the award to a lesser, but still substantial amount (I believe around $80K).

I would not assume that just because you are "operating below the radar screen" you're OK. I also would not assume a 15-20% emergency fund would be enough to satisfy Ferrari. Using their names and logos is steeling, and Ferrari takes it very seriously.

If you look in the back of any of the Ferrari magazines (Forza, Cavallino, FML) you will notice several Ferrari related businesses that have designed their own logos that are similiar, but different, from the Ferrari Cavallino. Bob Smith's Coachworks is one that comes to mind. This is one avenue that you might consider, but I wouldn't do anything without talking to a good patent and trademark lawyer.

360 Modena and Maranello are trademarked names. Using them is the same as using the logo, isn't it?

I know about the licensing and that is what I am talking about. I am not going to use their logos. Just the words 360 Modena or Maranello or what ever the car is and the colors of your interior. There will be no copyright infringment from these jackets.

jason - ferrari appears to be tightening the reigns on use of its logos. my guess is that if you ask first you'll get a no answer. if you're a risk taker, sell the jackets as you like, use only ultra-professional componentry and design, and stash 15% to 20% of the gross just in case they come knocking :-)

small volume stuff isn't going to get them bent out of shape - especially if you offer them a 15% licensing fee after the fact.

big volume stuff may land you in court :-)

remember the guy on this board who had these ferrari pens? they were wooden? totally unlicensed i'm sure, but i'm also sure FNA wasn't paying attention on penny-ante stuff.

using someone's IP without a license is basically not legal at all, so do so at your own risk.

but, fwiw, i might be interested in a jacket :-)

you have to goto ferrari north america..they have the prancing horse logo patented.. my advice is to talk to a patent lawyer..there out there..just have to find one

I would like to still make some kind of Ferrari jackets but not infringe on any copyrights. I have been thinking about offering some that match the Ferraris interior. For example you could order a black leather jacket with 360 Modena on the front in yellow and the rest of the jacket would be stitched in yellow also, this would then match your black and yellow interior in your 360 spyder. Thoughts? Suggestions? Thank you as always.
