Your point is exactly where I was coming from.....I could see that Ferrari would be perfectly in their right to refuse to warrant any area modified by a third party, but to invalidate the entire vehicle hmmm, I just don't see it.

As I said this really is an area for a lawyer, they can advise you on the merit of the case, and the best way to approach this, it may be better to argue to the anti-competitive nature of this conduct etc....a good lawyer is going to find a way to get you what you want.

I had heard Amerispec were very good, were you happy with their work?

Finally, do you have a listing of the outstanding campaigns on your car, if not send me an email ([email protected]) with the relevent info, I will ask my dealer to pull the info....that is of course if the UK computer lets them.....My car came from Germany and the dealer hasn't had any problems with info, and to be fair I have had no problems with the Ferrari warranty.....My whole Ferrari experience, car, dealers, Ferrari UK etc has been a very positive one.

fyi when a local F dealer puts up the vin # of a euro car herein the states one gets a blank screen=zero information.

I agree there are good reasons why a warranty may be denied based on federalization which is substandard.However a blanket denial is just a ploy by fna.For instance they are refusing to replace a tensioner belt and the engine was not touched by Amerispec (a well respected federalization firm.

It is not against the law for a company to dishonor warranty on a product that was not imported and sold by them. In fact, this is very common in the electronics industry. For example, if you buy a Sony (or any other brand) television in the ROW, Sony America will not warranty it. In fact and in most cases, they won't even touch it. The same goes for digital cameras and watches, etc.

There is a good reason why FNA (a subsidiary of Ferrari SpA) does not honor the warranty on ROW cars. Mainly, this is due to the fact that the cars are altered by a third party for the Federalization process. Many such parties tend to do a very poor job and do not use factory parts. I have seen poorly converted ROW cars which didn't even run for 1K miles before needing serious work and can fully understand FNA's position which is not different from any other manufacturer's.

OTOH, I hear that as of MY 2001, all 360 models are now OBDII cars worldwide. If this is indeed correct, it means that there will be no need for engine conversions. Changes will be limited to DOT issues such as side markers, bumpers and speedometers.

I am not a lawyer, but I am surprised that Ferrari can refuse to honour a warranty.... I suspect a well crafted legal letter will certainly give them food for thought and on an individual basis get you what you want....The ramifications for refusing/failing to pass on information that relates to the potential safety of your vehicle are significant. I think your success will depend on how far you are prepared to pursue the matter....FYI I took legal action regarding the quality of a new Jaguar XKR convertible I purchased here in the UK (we don't have very good lemon law protection here) I got my money back in full, but I had to go all the way to the court steps to get it.

I have a 360, why can't you get the outstanding campaigns on the car.....all it is is an excel spreadsheet which shows what has been done and what remains to be corrected on your vehicle....surely they can just pull the info from the vin number.....

Just wanted to inform you that unless you contact the original euro importer you have no way of knowing what recalls have been issued on your vehicle.
Anybody interested in joining me to take on FNA re: euro warranty policy??
If FNA refuses to honor warranty as I anticipate I plan to contact as many Euro owners as possible.
This forum as well as lists from well known brokers seems feasible. Any ideas.?I know peeing against the wind will get me wet but I have a raincoat and wouldn't it be great to win a class action suit against those arrogant FNA's???
