BTW do you know what they fix it with? old parts if they can find them, because they are less money and their argument is: you have a used car so we do not have to replace with new parts. As for getting a lawyer, if need be do it. They will do anything they can to keep you from getting what you are due. Sue them if necessary. |

Jim I have never had to claim a loss-value but would not hesitate to do it if the Ferrari gets banged up. If the 1/4 panel has to be fixed it is a defect you have to disclose when you sell the car and likely there wasa police report filed so it will show up on the carfax. Anybody looking for a 355 Spider will be looking at the car fax and see damage/accident and use that as a negotiating tool. I had somebody smash into our Jeep Grand Cherokee and the insurance wanted to give us a midsize rental. I told them NO-WAY, I will get an SUV and they will pay for it. After some arguments and threatning with suit they okayed it. Your demand for a Ferrari-rental is not unreasonable. You have made a decision to buy a $100,000K plus car and why should you be disadvantaged because that old lady is to dumb to drive her car? Further you pay a insurance premium for a Ferrari so you are entitled to drive a Ferrari. You have to understand that the insurance will puke when you tell them they will have to cover the cost of a Ferrari as a rental. They will argue hard with you but I do not see that they have any legal grounds that you should not be entitled to have what was taken from you as a rental. You can always argue: "You know I am nice enough that I do not run to the doctor and get a neck brace and get an injury attorney like 90% of all the others, even if my neck is hurting today and I have headacks since the accident..." that will wake them up! You will see how fast the conversation shifts to if you want a yellow or a red Ferrari as a rental.

Martin, what recourse do you have when you request a Ferrari rental and they say no? Or when you claim value lost and they say "they are repairing the car"? Do they give in since you know what you are talking about or do you have to get attorneys involved etc? |

Bill, thanks for your e-mail. I will respond here so others can see the answer as well for the future. There is a little shop in Hallandale called "Classic Car Restauration" talk to Mark, he is the owner. Mark has done my car. He is constantly doing nice classics full restaurations and works with the original Glasurit paint for your car with original Ferrari paint codes. No matching just the right stuff in the first place. He is not cheap but then you should not and do not have to go that route in the first place. I would also talk to the insurance company about a loaner. They will try to tell you you have to accept a Chevy Cavalier or something stupid. I would not and insist on a Ferrari as a rental for the time your car is in the shop. After all you are paying insurance on a Ferrari not a Chevy. For your rental you may go with Italian Image www.italianimage.com .Talk to Roberto, the owner, he rents 355 Bs and will surely give you a great rate. Also, on Sunday there will be a huge party at his shop for the GP, as every morning of an F1 race. We are a big Ferrari crowd that gathers for these events. Please feel free to come and enjoy the festivities...and yes, Ferraris will be 1 and 2 guaranteed! I talked to Michael and Rubens about that yesterday. Make sure to have Mark put new parts on the car not old ones. The car has lost value, make sure to put a value claim in with the insurance company as well. I need my rear right 1/4 replaced and painted. Crazy old woman mishap! Her insurance is paying so no expense spared. I never would anyway. Please help me locate the BEST auto body shop that knows how to work on aluminum. 2002 360 |
