You can sue over the balance of what you sell it to right now, if you have to lose a deposit in a subsequent transaction you can sue for that and yes, keep it in small claims, do it yourself and save the lawyers fees.

As for why does somebody sell on eBay?
It is advertising. I have cars on eBay and use that as advertising. I bought cars through eBay and sold cars through eBay. Buying you call the seller before the end and selling the buyer will call you and discuss before the end. Those that are serious at least.

Magoo...that brings up a good question...why buy at an auction...period...(in my case I was looking for a cheap car to leave at the train station and take to Home Depot so I figured I'd give e-bay a try) Next month Speedvision will have the Barret Jackson auction..and while it is a much more reputable venue than e-bay...last year I sat watching yelling at the TV (my wife doesn't yet understand that this is what men do) as people over bid, paid buyers premiums etc, etc, on cars that they did not have an opportunity to drive and could only give a visual inspection. Having been to a Christies auction I can tell you that these higher end auctions don't always have 100 point top quality cars...

BDW, received the title yesterday (post marked 12/20 and the dealer claimed he mailed it on 12/8...is the mail that bad?) it took putting a fire under this guy's ass.

I really am not trying to be a Monday night quarter back here, but why do people buy and sell cars on Ebay? It seems the only guy who makes out is the guy who is selling a junker. He is usually able to pull the wool over the buyers eyes on Ebay. Not so in this case because it is obvious your car is a nice car Jeff. But I have seen other people get taken really bad and Ebay offers no help at all.

1) Try small claims court in his town for whatever the max amount is allowed for small claims(typically, somewhere's around $5 or so). Is easy to do, will GET his attention, but doesn't require attorney crap to deal with, just you & da judge.

Possibly sell your car and go into small claims requesting the difference(if you sell it for less than he bid).

2) check ebay for last date to submit negative feedback(don't remember for sure, but thought it was 30-90 days or so), then wait till right before time expires to slam the guy. By the time he's aware of the slam, it'll be too late for him to post negative to you.

What Erik says is so. They could lose their dealer license plus other charges if they don't produce title within a certain time period.

Ebay will refund your list fees.

Paul, contact the NY DMV/Dealers service. In my state the dealer may not sell a vehicle unless it has a clear title. Any title issue MUST be resolved within 30 days. This is why dealers must be bonded- to guarantee title. Likely the dealer will work with you to get you the title if you tell him you are in contact with the DMV about his dealership and not supplying you with clean title.

Same applies if you buy a car out of the classified section of the newspaper. BUYER BEWARE, "Cause' once you buy it it is yours."

as far as cars are concerned, ebay is really a marketing tool not a sales tool. i bought one car and almost bought another off ebay - but ebay just delivered me to the seller - we negotiated one on one from there. it's one of the best listing services out there, but that's all it is.

it sucks, but you're probably screwed. i seriously doubt any court would force the guy to buy your car. at best, they'd tell you to sell it and then sue him for the difference (if any) between the subsequent sale price and his bid (plus legal fees, i guess).

it's over. don't waste your time on it.

you'll get screwed on both ends with cars on e-bay...I bought an old Audi at the end of Nov from an auction on ebay and the seller (a dealer) still has not sent me the title...each time I enquire he makes up a different story...I told him that if I don't get the title by the end of the month I will leave the car on the street here in NYC with the keys in it...I did charge the car on my credit card for some protection..though I am not sure how much.

Thanks for the kind words about my 308, Jay. It really is a special car.
I'm replacing it with a 348 Twin Turbo, by Norwood. The car, itself, is considerably rougher than mine, but, Thats my specialty. It is the most fun car I've ever driven. I guess it makes about 400hp, TO THE GROUND! FUN. To bad I've goota sell the 308. I could have a nice car and, a fun car too!

Try there, I think F-cars go really quickly from this site. Good luck to you Jeff. By the way, what are you planning on exchanging it with?

Thanks for the replies, guys. He is not in the same state as me. I am though, frequently in his town. It irks me that he has the gumption to call my house, excited to have the car, then back out! I may just sue him for the principle. I'd most likely do it myself so I don't lose all my proceeds in court/ attourneys costs.

You get that alot on Ebay. IMO there isn't much that you can do about it. What did you find out through legal council. This happened to me on my first Lotus that I put on Ebay. He wanted to trade after he won the auction. It didn't make any sense. Where you selling your 308?

Your screwed basically.
If you ask a lawyer here on the chat. I think you might hear the same.
He has the money you want it.Go to court to get it.
Is he located in the same state as you?
I dislike ebay sales.

I sold my Supra on eBay, but I used it as an advertising mechanism. The actual buyer called me on the phone and we negotiated it off eBay. I would never let the auction end with a high bidder whose info (name, address, tel number, etc etc) I did not have.

Some people don't take bidding on eBay seriously, and just don't care. They know that the hassle and cost of suing to enforce the contract is probably not worth it. Most people would just re-list the item.

You can leave him negative feedback, but this is useless and he will leave you negative feedback and create a new account.

I doubt eBay will help. Maybe some lawyers can pitch in here?

Gents,
I recently sold my car on eBay. Ok, no gasps or moans please; I sold it to buy another. I gave the guy a very good price and he actually bought it for $50 over my min reserve. After an enthusiastic phone call, and a few e-mails, he now claims to want to retract his offer, (the auction ended long ago). I've returned is e-mail explaining he has entered a legally binding contract, I've already put a downpayment on my new car, etc. I am receiving no replies to my mail. I've already sought legal council. Would you, the group, be kind enough to offer suggestions here; in this open forum?
