More than likely the guy in car one is already long gone. Similar thing happened to me years ago. My uninsured motorist paid for it in the end. It of course took may calls and threats from me to my insurance carrier.

Reiner, that is aweful to here bro. I fear this every time I go on the freeway in LA. There are sooo many freekin idiots on the road in LA. I have to battle the valley traffic everyday that I have to go to work. I will stop there because I am getting mad just thinking about it. Take both dudes to court. Hey make them pay, garnish wages after you win. That is about the only way you will get the money out of the uninsured guy. Oh that sucks sooooooo bad, I am so sorry to hear that. Hope every thing goes your way.

have a salvage title, but I'll bring it
to Premier and get an estimate, my guess (given
Ferrari parts prices) is total. So, at that point
it WILL have a salvage title, and I would have
the option to buy it back from the insurance.

I agree with Art on most of what was said. But first you need to see if you are injured. If not, don't get an attorney for the reasons Art gave but also, an attorney really can't do any better for a property damage claim. However, if you have medical bills, ongoing injuries, or other damages like wage loss, then you need to speak to an attorney. If insurance companies paid people fair amounts for their injuries, I wouldn't have a job, and neither would thousands of other PI attorneys. BTW in Washington (not legal advice in California) you would sue both parties and figure it out later. Hope this helps.

Hopefully you have uninsured motorist, including property damage. Check your policy to make sure you have it. The next thing you need to do is to start documenting the value of your car. Check your policy to ensure that you have fair market value insurance coverage, not a specified coverage. I would work with a local Ferrari Dealer in your area, and get them to provide you with an estimate of the value of your car. If they are the authorized dealer in the area, your carrier will probably accept that value.

Additionally, if you have uninsured motorist coverage, property damage you are entitled to a certain amount for loss of use. Given the high cost of renting a 348 this could be substantial. Again, perhaps the dealer can supply you with an estimate for that cost. Because there are so few of these autos, a cerain amount of time is needed to replace the vehicle, use the dealer to establish that time limit.

Lastly, don't use a lawyer, they will charge you either by the hour for this and there will be a few hours of work involved here, or they will charge a contingent fee. Attorneys fees in California are not allowed in cases like this.

Reiner: Martin's idea about getting the boys to come over- that would probably be the most ideal resolution to this; close friends with bats are ALOT less paperwork than a phone call to Allstate (that is, if you don't get caught...! :-))

Although I am not an expert, let me just put in my 2 cents.

Since car #1 has no insurance, you are basically chasing a poor duck. You will not get anything other than getting that person prosecuted/jail time (frankly, a waste of time).

Let the car #2's insurance(who hit you) pay for the damages and let them deal with car #1 (it's their headache).

Car accident is always a lose/lose situation. Your only option is to get it resolved with minimal inconvenience.

I am sorry to see an F-car getting damaged.

sorry to say this but I do not have comprehensive
coverage, just the minimum to be legal!!
(I have a bad driving record!)

you are under the same assumption as I was. You and I were both wrong though!
Uninsured Motorist is not for damages but ONLY for your medical bills that you incur in accident caused by somebody driving without insurance.

Reiner,
you should contact your own insurance and let them battle it out with the other insurance. In FLA a friend of mione had something similar and all of the insurances will eventually get into it and pay claims. That is why you have insurance.

Sorry to hear about another 348 being taken out of commission.

Get the address of the driving without insurance and have the boys come by to beat him up.

traffic comes to a stop with me in the fast lane
being the last car to stop, then behind me I
hear a loud bang, then 1/2 second later I get
hit hard from behind. The car is beat up pretty
good, with frame damage, probably a total!

My question for you lawyers on the list
(I'll probably need to find a good one here in
LA anyways): Car 1 hit car 2 which then hit me.
Can I go after both car one and car 2 to collect
damages, or only after the driver at fault (car 1)? Unfortunately that guy did not have insurance.
Driver of car 2 was unconscious (so I assume he
was pretty badly injured)...
