Agee with everything Martin said. I cannot emphasize enough the need to immdediately contact your attorney. I've been through this kind of hassle before(non-ferrari-thank God), you don't want to do it without your attorney.

Here is my understanding:

FNA has only one authorized body shop, Classic Coach in NJ. You have the right to insist on having your car properly fixed at Classic Coach if you wanted to. I would give them the option on that or giving deminished value.

You do have the right to a Ferrari as your rental car. Show that you use your car 2-3 times per week and you can insist on gettting a rental Ferrari.

Body panels are avaialble from Ferrari. Do not go with their body shop, joe blow from the street. Insist on your Ferrari dealer or a shop you have had prior experience with.

There is a deminished value. You know it because you would have been reluctant to buy the same car if it had the accident and was fixed. A good car appraiser will be able to determine the loss in value.

The insurance company will put up a big fight. Be prepared. They will not give you a Ferrari rental, they will not pay for deminished value, they will not want to have the car shipped to Classic Coach.

Have your attorney briefed in what had happened and have him be prepared to call the insurance company immediately after you got nowhere.
Always talk to the supervisor, never to the first person on the phone.

This accident can mount to as much as $50,000 without a problem. The rental can cost $20K and fixing the car properly will not be easy, plus I estimate $10K in deminished value at least.

Give a little. "I would accept a V8 as a rental, it does not have to be a V12"
"I will accept having the car fxed at the local Ferrari dealer and not by Classic Coach if you accept the deminished value my independant appraiser comes back with!"

Sorry to hear abt this misfortune.

Fixing cars, especially F cars is never cheap. You need to decide if you want to keep the car, or sell it afterwards. If she's a keeper, then by all means specify you want it completely repainted. Thats really the only way everything will look consistent. I am amazed how well a competent shop can lay paint these days. A good shop will also be able to overcome panel fitment issues as mentioned below.

I hope this isn't a typical story but, I was just down at the local body shop getting my TR's spoiler repainted and saw that they were working on a TR (I think it was an 86 or 87). The body shop guys told me the front end had been smashed up and that they'd been working on it for a couple of months (it was nearly done when I saw it). The disturbing thing they mentioned was that most of the replacement panels (ordered from Ferrari) did not fit together correctly (excessive gaps between panels) which required a lot of extra work. The part that blew me away was that the repair bill had reached about $40,000!!! Unfortunately for the poor owner, the woman who hit him was under insured, which I guess means he has to pay or sue her insurance company(?).

Anyway, I hope your's isn't as bad as that, but I sure drove home very cautiously...

Patrick, the body is mainly steel, some bits are alloy though
The body panels are available (ask jeff from Ferrari UK)
in the UK the car wouldnt probabley be completley re-painted (insurance calls it betterment)

Sorry to hear this happened (she did admit its her fault?)

You're going to get guys telling you to get a Fcar as a rental as that is what you lost. You pay insurance on a Ferrari not a Taurus. Loss of use payments etc.

Also, the cars' resale value is diminished since it has been in an accident regardless if they fix it properly or not.

Some said to mention your attorney and the adjuster will maybe pay up. If not then I would seriously get an attorney. Hell she drives a Jag so "she can afford it".

Well, my 4th of July weekend started on a painful note. I was out driving around Thursday night in the TR since the traffic and parking is such a mess here on the 4th. I stopped about 30 ft behind a lady in a newish Jag who had pulled about halfway into her driveway and stopped. since her intentions were unclear, I waited to see what she was going to do - unfortunately I didn't suspect that she would put her car in reverse and gun it. She caught my car directly on the right front corner with her back bumper. When I got out to review the damage, it turned out that my bumper was essentially knocked off and broken in half, the right front fender is creased and crumpled, the right headlight and the piece in front of it are smashed, and the hood was pushed back and won't open right now.
Here are the questions:
1. The body panels are aluminum (correct?) - is it true that they can't be easily straightened?
2. If so, how available are replacement body panels?
3. Do insurance companies typically have the entire car repainted in a situation like this? Matching 15 year old paint has to be nearly impossible.
4. What has your experience been with their insurance providing a rental car - will they go for something something slightly more comparable than a Ford Taurus?
5. How long should I expect the car to be out of action? weeks? months?
