Ebay is a good site for individuals who like to rip people off. Ebay doesn't care as long as they get their $$$$. The more posts he makes the more $$$$ Ebay gets. They are happy. Customer support is non-existent.

I have sent repeated emails to ebay complaining about this schmuck. All I got back, despite 3 emails to them, was an acknowledgment email which was automatically generated. I am floored that he is still able to use ebay, because if I had my way, he would get his hands cut off.

I suppose you could sue eBay. After all they are aware of the situation and are aiding this guy in perpetuating a fraud. You would think that they would do everything possible to get this guy because it doesn't take much to poison the well.

He actually cancelled the auction because I can not find it on my My Ebay page anymore and then he blocked it.

I have send a complaint to eBay with the link to this thread. Hope they read it and respond. Otherwise sue them and the guy. If they do not repond and take action they act criminal and should be punished.

Mitchell I'll bet that isn't his real address. Maybe someone in that area can drive by and see whats there, if anything. Why don't you file a complaint with the States Attorneys office. Document all the info. and particulars that you have in the complaint. At least it is a beginning. All we are doing now is spinning our wheels. Someone else may file a complaint and maybe someone else and so on. Then you will be contacted and go from there. The only way you will convict him of a felony is with a total amount of how much he ripped off everyone. Yours by itself is only a slap on the wrist. Sorry to be so negative but these guys do this for a living and they are very good at it.

Ebay will not get involved to any degree until the States Attorney office forces them to produce the records. They are not going to get involved in any legal dispute until the 13th hour when they have to. That's business nowdays.

I agree he has already posted and sold it 3 or 4 times. That adds up quickly. Doesn't Ebay have some form of protection insurance for their customers? Maybe look into that.

Michael, I give a 10/4 on that. If you read my comment again I agreed that trying to push those ideas I presented would be a tough sell, especially Ebay. This is more than likely not the first time this guy has done this. He knows the law and what constitutes a misdemeanor and what constitutes a felony. That's why he deals in low prices. But then the question is , How many times does he sell it? He probably makes out pretty good at this.

Magoo I agree, but the achillies heel is Ebay, they cannot afford any negative, (lawsuits criminal complaints etc). I would rattle my sabre in that direction with an eye on my previous suggestions. Trying to round up everyone, (they may not even participate on this forum) and trying to going after this dirtbag is like urinating in the ocean to effect the level of the tide... it just won't happen.

This guy knows that no one is going to chase him down for $20.00 or $50.00 bucks. If it does become a legal matter he owns up to the mistake and gives back the money to that one person. He then pockets the rest of the money. The only way to catch this guy is a class action through the States Attorney. Then again try and get all the people together who were ripped off. Unless the States Attorneys office has a number of complaints against this guy you probably don't have a chance unless Ebay cooperates and somehow comes up with a list of bidders. Maybe...

Contact the Atttorney General in your state, the state this person lives in, and the state Ebay is located. File complaints seperately, specifically against Ebay since they were apprised of his fraudulent activities and with prior knowledge let this individual POST the same merchandise AGAIN. Point out that Ebay has been nothing but a conduit for subversive sales, and fraudulent activity, based on what you've described.
Also contact the district attorney in your area and see if they have a consumer fraud dept. they may refer you to the D.A. in the jurisdiction this person lives, with this avenue you will be pursuing criminal charges, not sure of your $$ loss so don't know if it's a felony.
You may also want to file a civil action against him for damages.
Also follow up with the FTC, hopefully some of this will get you some remedy.

Start with your states Attorney General and also give the Federal Trade Commission a call or even your local Better Business Bureau. If they cannot do anything for you, I am sure they have a ton of resources to give you in order to remedy this bad situation.

Ebay is getting worse and worse. I sold an item on Ebay and the high bidder decided that he didn't want to purchase the item. I asked him to please pay for the final value fee. He agreed. I never received payment. I then posted negative feedback on him. He in turn posted negative feedback on me even though he never paid for the item. Ebay would do nothing about it. It made me angry. I am sorry to hear that this guy did this to you. I think Ebay should start being more responsible. They are only concerned with the money that they make. I hope that you get your money back.

I got madly ripped off by some schmuck in Orlando. Ebay has done nothing, the local police department has done nothing. I bought a glass Ferrari Cavallino sign off ebay from this guy and he cashed my check and never sent my sign. I even called the jerk countless times and he acted like he nothing of what I was speaking of. I got ripped off. If anyone has any "contacts" or information about this person, or can investigate let me know. Here is the a-hole's name and address:
