Yep, i make it up as i go. But, you know, you can leverage the truth in a way which is not demonstrably false, but the other guy will know you are reaching. Thus, make sure every factual position is squarely in the center of the truth, not shaded in a way that is favorable to you. You create good will, even with fuckheads, if they know they can trust you even when disagreeing about outcomes or ultimate positions. You then build on that, and, if you have a valid position, it has an almost irrefutable foundation; on the other hand, if you stretch, you can easily be shot down, and have no credibility. Ask the other lawyers about how to build cred. with a difficult judge...

I would not deal with them. In my exp, these people are extremely self destructing. If he is not able to state a position with out passion, then you can have no idea what he is thinking. He could be a lunatic.

Do you really want a partner that cant communicate rationally with customers? And do you really want a partner that may yell at you daily??

whart is right. depends on guys motives. don't prove you are smarter he'll figure that out when the deal is finalized. don't react back with emotions or it just escalates and nobody is in control. like throwing gasoline on a fire!

I usually say something like "I have obviously upset you" or "you are obviously very passionate about this point" "am I misunderstaing you" in a calm voice. Lets them know I get their point, but I am not gonna have a pissing contest especially in a crowded room.

Then again, some guys are just A holes and you either fight through it or walk away.

That can be difficult. I know people who use that as a negotiating style, it keeps you off center. Just be firm, don't emotionalize, and wait a beat for each response. Typically, people that are reacting on emotion say stupid things. Take advantage of that, but quietly. Don't prove you are smarter. And, in a courteous way, don't take any . If its just a ruse, he'll get it. If he really is emotional, it can be used to your advantage. Also sometimes putting stuff in writing actually aggravates the situation because the inflection and nuance can be missed. But, still, document your progress in a non-truthstreching way, confirming your positions as you go in a way even he can't disagree with. Let me know if this works.
