I checked with Board of equalization Sacramento
So long as it is used outside Ca I'm ok. I don't have to take delivery myself out of state. Someone can do it in my behalf. I' asked about someone taking it to Algar for work they said that is good example of it being used out of state. Gas receipts also.
The transit time is excluded so it has to be 90 days plus the transit time. Regulation 1610 and 1620.

If you bring it in after 90 days, you better have proof why it was out, and don't go to the DMV.

Art is correct in regards to out of state vehicles. You must prove you use the car elsewhere with an out of state registration or else you'll be paying up use tax.

I listed the penalties and their sources from the DMV below.

They will subtract the taxes you paid on the out of state registration, if its any consolation. Thats the ONLY benefit if you are caught as a resident of CA with an out of state car.

Its a very complicated dance to avoid paying the fees. But it can be worth it if you have a very expensive car.

If you are ever caught, you pay the following penalties. Please note current annual registration fees are 2% of the vehicles value. Current sales/use tax rate is 8% for Los Angeles, it varies by county, see my link below.

1 year or less
$30 Registration Fee Penalty
40% of the Vehicle License Fee due for that year
40% of the Weight Fee due for that year, if any

More than 1 year-2 years
$50 Registration Fee Penalty
80% of the Vehicle License Fee due for that year
80% of the Weight Fee due for that year, if any

More than 2 years
$100 Registration Fee Penalty
160% of the Vehicle License Fee due for that year
160% of the Weight Fee due for that year, if any

Use Tax penalty
Based on new registered owner's county of residence. (Add 10% penalty if paid late)

Use Tax-This tax is similar to sales tax. It is collected at the same rate as your county of residence. It is due on all vehicles purchased in California and on those brought into this state within 90 days of purchase. Any sales taxes paid out-of-state will be considered when computing the use tax due this state. This fee is due for ownership transfer of recently purchased vehicles.~~

When I ordered my second Maranello, I had it shipped via air freight (for 6K) from the factory to save 3 weeks off the delivery time! THREE MONTHS?? I could not do it!

But, I did take delivery of my boat 12 miles offshore and send it to Mexico for 3 months. It seemed like a good excuse to do some fishing (The MRS doesn't fish!)

Use AAA they dont ask questions. If you have a sale date 90 days ago and tell them you JUST brought the car into CA, they will waive the tax. If you go to the DMV they will probably make you get a waiver form from the BOE ( which is a b*tch).

I did this at AAA with my Daytona and a BMW saved $14,000.00 in taxes.

I made the mistake of taking my 330 to te DMV and had to go through the BOE process ( hell ).

Never again.

It's my intent to not pay California Sales tax on my 360. You can't just keep it out of State for 90 days. They'll get you, and the penalties are not so good. You must plan on using it out of state for at least 90 days, and when you register it, and request the exemption, you'd better have proof that you used the vehicle out of state for those 90 days. Things like gas receipts, tolls receipts, etc. are usually good proof of your intent to use the vehicle out of State.

I'd check with competent tax counsel for the requirements, and I'd follow their advise, otherwise, you may end up spending 20k for taxes instead of zero.

Not another 90 days, only 90 days from the point of ownership (date on the title) and shipping paperwork. He could have made a *cough* mistake and transferred the title *ahem* to reflect a different *sneeze* date. Damn weather changes messing with my sinuses!

I wouldn't change a thing either. I remember my first NSX encounter parked in a car port in a medical complex, on two separate days. That, hmmm, I wonder feeling and the first canyon drive led me here!

good point. I had already waited 2 months before shipping it... another 90 days would have killed me! :-) Come to think of it, had I done that, my life would have been drastically different! Imagine that, not having gone on any drives between dec. of last year and feb of this year!

no way no how!

$4k well spent. :-)

Would you really wait 90 days for $4k after you bought it? :-)

I know people who couldn't, tried to cheat. Some made it, some got pulled over and paid the penalty.

Please not that the penalty is 65% of the registration fees if your caught with a car that is not yet registered but been in CA for more than 20 days. Play at your own risk!

It is registered prior, through the dealer :-)

I know a friend bringing in another car from out of state doing the same thing, prep before ship and a little extra delay wiggled in.

I would think grey market cars work a little differently. You would have to Federalize it (whatever that took), register it, and then wait 90 days and then take delivery. Harder to do, but not impossible.

I use AAA for my DMV and they say prove it was out of state for over 90 days before you took delivery and "no problem".

good call, wayne. I had no idea that a "delay" in delivery constitutes exemption from the use tax. I thought you had to register it for use in another state for 90 days, then bring it into CA.

Not taking immediate delivery of 550 I bought from Carstore at glenside. I decided to have Algar do a major on it. Cost is 2750 plus parts.
California sales tax is about $10,000. If the car is bought out of state ,and it was, state sales tax does not apply. Catch is use tax (same rate ) attaches. If however the car does not enter the state for 90 days, buyer is exempt from use tax. So I decided since the car (a 99 model) will need a major next year anyhow to get it done in Penn and have it shipped in 2 more months after completeion. I would rather invest in a "major" than pay California 10,000 tax.
