There is no reason to doubt my credibility. I have delivered everything I said I would. As a matter of fact, my initial calls to Euro Motorsports were NOT accusatory. My first reaction was to blame the transport company. That was also dan's first reaction - loud and clear. I believed him when he said he would get to the bottom of it. I believed him when he said he had tapes that could prove they didn't drive my car. I believed him when he said he would send the tapes. But that didnt' happen. Each time I called I was given the run-around. Slowly, my confidence in Euro Motorsports eroded as 1. The tapes were not delivered as promised 2. They did not contact Sam at Autobahn 3. They forwarded the idea that the odometer turned on its own 4. The title for the vehicle was not clear and available as represented 5. The Florida DMV told me the title was liened 5. I was repeatedly promised that the title "would be there the next day" 7. The title took two weeks to arrive - and I paid with on the spot with a cc. 8. I noticed that although Euro Motorsports claimed the only area of the car with new paint was the spoiler, it's become obvious that the front quarter panels have been painted, which is obvious from the lack of badging (which was originally shown on the website) and subsequent delamination in these areas. NOTE: I bought the car AS IS and have no problem with addressing these issues on my dime, but it did cause me to further question credibility. 9. Improper installation of a battery into my car 10. MILEAGE DISCREPANCIES and undercarriage damage Individually, each item is slightly suspicious. Two or three items together would really concern me. But item, after item, after item really makes a statement. Not about my CREDIBILITY - more about my GULLIBILITY. I am not defending the carrier, per se; merely his right to be heard and not accused without evidence presented to him. And let's also keep in mind that I am not attacking dan. I questioned Euro Motorsports and dan answered. I did NOT post accusations against dan on this site. He accused me of accusing him. Big difference. And let's also not forget that the transportation form was signed by dan - why did he sign it without an odometer reading? And, I realize that this is heresay and give it only that amount of credibilty, according to the driver, he was rushed out of Euro Motorsports because they were closing and in a hurry to leave. Sometimes when people are rushed, mistakes get made. Finally, let it be clear that Euro Motorsports themselves have offered zero evidence that they are not legally responsible for this breach of contract. I have NO legal basis for going after the transport company that Euro Motorsports contracted. My attorney has assured me of this. He is quite clear about who my contract was with. I have been quite clear. I have posted the documents to prove it. And why would I contract a Florida attorney when point of sale is Lake Bluff, Illinois? Please, in the future, if you're going to question my credibility, do your own research and ask questions FIRST. That's what I did with Euro Motorsports and look how well that's going for me. LOL. $2,500 for 96 miles and some scrapes on the underbody - BECAUSE that is what the "exotic car rental places charge as a daily rate" - sorry Brian, you are on crack. More like $100 and a fresh can of black spray paint. It is little wonder why Daniel has a problem with you and your demands, you are being totally unreasonable. Must have been just a thrill to negotiate with you on price. By the way, I can't believe that your attorney told you otherwise. If he or she came up with those figures or encouraged you to move forward and bring a lawsuit based on this position, than he or she should be disbarred. Go ahead with this nonsense, get your attorney involved, file a lawsuit. What you will learn is that the provable damages are trivial and that your legal fees - which should not be recovereable - are outrageous. I don't think I can even read this thread anymore - it is making my head hurt worse than the Phillip Haupt thread! Maybe we should hook Brian and Phillip up for the next transaction - that should be good for 100 posts an hour. As The Ferrari Turns Scottie
Oh my: 1. there was no undercarriage damage noted when they picked it up but there was some when they brought it to you. You look at the trailer they are picking up and ask yourself WHO caused the damage. So we cleared that! 2. Miles, not that 96 Miles is much or worth much in the great picture of 23,000 Miles, to put a hypothetical price of $2000 on it is outragous. That is I am sure when Daniel rightfully so said, "screw you." That would mean that the 23,500 Miles on it were deminishing the value of the car by $470,000 making this a worthless piece of crap since the car was not even $200,000 new. 3. you need to get over it. When you had the car inspected it had 23,300 Miles, when you came to see the car and sign papers it had 23,500 Miles. If the miles were so bad then, you should have walked away before signing anything. Unfortunately there is no pickup miles noted. That is a carrier fault. To say that it is Daniels fault is outragous. To come on here and continue accusing him over and over without seeing that all signs point to the carrier...childish. From experience you would have gotten more accomplished if you had called him and tried to see if he cans end you a T-shirt or a mug or something instead of making up $2000 value as miles lost. Further I would look forward to you getting this moved to IL when you had the car inspected in FL, signed the papers in FL, came to FL to see the car, called FL for progress. I am sure Daniel is not a IL dealer and has not registered the car for you in IL. So other than him making shipping arrangements for you....all is FL. Your attorney stands on very shaky ground here. I would get that thrown out of court in a matter of one motion. So to sum this up: You approached this the wrong way. Coming on here and first posting without anything at hand was wrong but shows that you do things without thinking them through. Then starting a new post AGAIN with nothing...<sigh>, what can I say. You need to let go. The sad thing, everytime you drive the car now you have to think about $2000 for every 100 Miles.
You are making up these items as you go. You got a lien free title. See the lien satisfied line. Apparently EURO paid off the lien when they took the car in. Sent everything to Tallahassee and they took 2 weeks (normal) to send back the title. The title WAS liend. So? Big deal. You got a free and clear title. just as it was promissed to you. Your CC took 3-5 days to clear the banks. What do you think about that. Does not matter that it was out of your account. Daniel did not get it till 3-5 days later. Thats how that works. So the only person complaining here should be him! How long was the friggn car on the truck? Probably longer than it took for you to get the title. This is why we are LICENSED AND INSURED AND BONDED dealers in Florida. We can accept your check although the title is still on its way back from the State. We can issue a temporary tag to you and let you drive off the lot with a car. LICENSED, BONDED and INSURED! Did you suffer damages due to the title not being there or having a satisfied lien? Maybe your attorney will tell you that a car that shows a lien prior is worth $10,000 less. God, I am with Scotty. This is getting so rediculous it is making my head hurt!
No, actually the GREAT thing is, that every 100 miles I put on my car are MY 100 miles. And I know exactly how well the car is being driven for every single one of them. And I assure you I'm smiling when I'm doing it. I've already spoken to all the above points ad nauseum. The fact that you think having my car driven and damaged should have resulted in my calling up dan and being treated to a mug or a T-shirt as a proper resolution really puts your opinion in perspective. Do you deal with customer's on a regular basis? Or maybe your area of expertise lies in the legal field? I must admire your loyalty. Deluged with facts and still deliberately missing the point. Right or wrong, at least you guys stick together. Brian 512M
I've enjoy this madness at work the last few days. I now would like to offer my take. Why has 512 guy not just sued these guys at Euro, if they cost him so much greef and B.S.. What does it cost to run something like this thru the court system?
Another note, Does that car really cost that much? It seems thats alot for 1995 Ferrari. If so, my Ferrari will be most likely bought on life #2 and be a 1980. Wow hard to believe a 11 year old car is worth that much.
Uh-oh! Isn't this cross-posting? Don't we get in big trouble for this? Does this mean we're supposed to cross-post from DEALER CONCERN 2 back to dealer concern? The jokes just aren't as funny otherwise. Brian 512M
Did daniel post the pics today on the car be pushed in and out each day? Can somebody point me to that post, so many.
Don't be so quick to be smart or silly Brian. 12 cameras....6 days....24 hours in each day......do the math.......I can't believe I am still viewing video to download for this lunacy but as I said I would, so I will. Period. Haven't lied yet and not about to start. Stay tuned.......
This thread needs to die. Nothing more to be said, Daniel it is time to stop responding as it is over....Brian has been shown to have issues which he will never resolve. Moderators Time to close this tread don't you think???? Everyone needs to got thread 2
Dan, Please save yourself, and everyone here, a lot of time and trouble. Just send me the tape you originally said that you would. I'll be happy to waste my time viewing it to clear up the mystery of who drove the car. With the car dead most of the week, I shouldn't need to bother with all 12 camera angles. And while we may someday clear up the mystery of who drove the car, nothing changes who is responsible for the fact that my car showed up with additional miles and damage. Everyone agrees it isn't me. I think the aliens have been cleared. No one believes that the odometer turned only during two specific time periods which happened to be whenever I, or a Ferrari inspector, was not behind the wheel. But, I PROMISE you that if it ever does happen in that car while it is my possession, I will immediately post it on this site. Hopefully, you can now agree that a modicom of customer service on 8/3 and 8/4 would have prevented all this "madness". After all "an ounce of prevention is worth a pound of cure". Customers hate to have legitimate issues brushed off or ignored. Or, Heaven forbid, placated with a T-shirt. Don't believe the advise you've been given by others on this site. Customers can see through the BS posted here. We both know it wasn't posted by me. People have to be asking themselves why you weren't infuriated if the transportation company you hired didn't fulfill the contract you had with them. Wouldn't any reasonable dealership pursue this legitimate claim? If not, why?? Why would you let a customer suffer damages through no fault of their own? I'm still baffled and a little too tired to think about it anymore tonight. Let's all get some sleep. Tomorrow is another day. Brian 512M
Hey Brain did you do any homework on Euro before you purchased? It seems their might be a pattern. Came across some stuff on a surf.
i've been following along with the story. why post the shots of the car just sitting there in all different positions? why not post a couple of them with people actually pushing the car? it would have taken the same amount of effort to do. also, no need to download and whatnot, just roll the playback and take a couple of digital shots with a camera. it would take all of 5 minutes...
It's a digital recorder that I have to access through the net so all has to be downloaded. It takes a lot of time to go through and pinpoint times although I have it narrowed down. I will have them up Monday afternoon at the latest. Remember I still have to conduct my regular business also therefore I am limited on time. I however do have it and the moment it is downloaded I will be happy to post. I now ask for patience.
daniel, is this whole tape avaiable on the net?Can we veiw it. That would be proof you didn't drive this dude car.
It is not available publicly on the net. My private interface. Just hang on and I will produce them as I have produced all else I have claimed I have. I will not post again here until Monday at which time I will post all pics of the car being moved by hand.
You just don't get it. You are obsessed. Did I spell this out for you correctly? OBSESSED. The car was damaged in transport not by driving it. You can't pippoint donw who or what put the 96 miles on your car but you keep on blaming the dealer who said the car was no moved. You claim it had a bad battery when you got there and a battery was hastily installed when they picked up your car. My question, if the battery was bad all this time then why in the world would anybody drive the car? To get knowinly stuck somewhere on the road? Please you are making a "behind" out of yourself with your obsession. I am not sticking up for Daniel. he is my competition. But by all means I cannot stand having some nucklehead come on and post crap out of an obsession. You keep this up you should seek mental advise.
I did not plan to post today, but my OBSESSION got the best of me. Martin, I'm obsessed with getting the facts correct. I NEVER claimed the battery was bad. It worked perfectly when Tim Stanford inspected it. It worked perfectly when I test drove the car. The statement made by Euro Motorsports that I left the lights on in the car and drained the battery is a complete falsehood. Dan turned on the lights because I didn't know how and he had to show me. When I exited the vehicle, it was running. When Dan removed the key from the ignition, the lights went off. That's how this car works. The position the car is in on the 7-26-2006 3:40:17PM camera still posted by Dan is not where I left the car. If you truly read through every entry on this current thread, there has not been one shred of evidence that Euro Motorsports did or did not drive this vehicle. What is clear is that it was frequently moved. Even more clear is the fact that Euro Motorsports contracted to transport the vehicle. We also have no evidence that the hauler drove the vehicle (although some people have implied he has). The lack of odometer reading does not deem the transporter guilty. It only casts suspicion. I am far more concerned with the contractual obligation of Euro Motorsports. Had Euro Motorsports followed up on 8/3 and 8/4 by sending me the tape they feel convicts Autobahn (as they promised to do) and at least CALLED Sam at Autobahn to investigate this matter, I would have focused my energy elsewhere. Too many shades of gray eventually turn an issue black. Brian 512M
<yahn> its getting old. my popcorn is out.... reading through all your posts all I can say is: obsessive! Reminds me of the client I had who refused an inspection on a car. Got it. Had it for 1 month and brought it to the dealer then told me it was leaking from the clutch and wanted me to pay for $3000+ in repairs. Sure it is my fault that he did not opt for the inspection although I told him I did not know anything about the car, never had it on the lift and looked over it. Also he used the "I'm not even going to make an inspection and buy AS-IS" as a basis for negotiation. Daniel: lesson learned. Give your client a list of carriers and let them make the call. Some clients are not worth selling to. When it looks like trouble, trouble it is!
Actually Martin, if you will read the documents we posted, none of the above is true. The car was listed with a clear title weeks before I bought it. I was told on the phone before I left by Daniel (not Dan) that the title was on the premises in their vault upstairs. They received my cashier's check on 7/26/06, so according to your estimation, it would have cleared between 7/29 and 7/31. Yet, as you can see by the title we posted, the title was not paid off until 8/7/06. I FINALLY received my title the afternoon of 8/10/06. I have bought numerous other vehicles and I have NEVER, EVER waited more than three days to receive a title when paying with a cashier's check. When a business gives you the run-around when it comes to a title that you have paid for in good faith, it creates even more mistrust. I couldn't even drive my vehicle for a week after it showed up at LFSC on 8/3 because Euro Motorsports could not do me the courtesy of providing temporary transport tags for my vehicle until 8/9/06. I requested these tags numerous times. I do understand that the sole purpose of these tags are for the purpose of driving it home. However, that option was not available to me. Neither was going to the DMV myself, as I didn't have a title. If you are really interested in the details on this title, please take a closer look at the document on line. Pay particular attention to the day this vehicle was transfered to Gene Morales vs. the day he sold the vehicle to me. I was never informed that this vehicle was a consignment vehicle. Imagine my horror when I called the State of Florida two days after handing over the full funds for the sale, regarding my title and was told that not only was my clear title "liened", but that the title holder was NOT Euro Motorsports. Yes, Martin, this was a BIG DEAL. A customer should always be made aware of a pending consignment. Unlike the scenario you proposed, Euro Motorsports DID NOT pay off the lien when they brought in the car. Brian 512M
