Can I repackage someone else's product and sell it?

    Not looking to give away the product but let's say it is pieces of wax. Maybe 3 1/2 inches by 5 inches by 3/4" thick. Let's say the original manufacturer makes this wax and sells them in these blocks in trays of maybe 12 pieces per plastic tray. Maybe 10 trays per box. The manufacturer of these wax blocks puts no markings on these wax blocks. The trays have no markings on them. The box they come in will have the manufactures name and product name on it. Let's say I buy these wax blocks in bulk and take these individual blocks and repackage them individually and put a different name (one I make up) on them and sell them. Is that legal? This is a unique item. This is the only manufacturer to sell this type of wax blocks. I am sure this wax is patiented.

    Opinions???

    Yes, it is legal - unless the manufacturer has conditions of sale, such as "not for resale", on their product. Otherwise, it is no different than Dell selling Intel microprocessors to their customers. Dell gets bulk pricing, Intel's patents are respected since Intel themselves produced the microprocessors and sold them at an agreed upon price to Dell, the customer gets a "packaged" product and services on top of the microprocessor as Dell's added value. If you don't add some value, then it isn't illegal, but it is easy for the manufacturer to undercut you if they decide it's a desirable business.

    How about going to the manufacturer and striking a deal with them to resell their product under your brand name? I did it with the Fluke Corp (They are huge) on my company's temp gun that they had an exclusive with Radio Shack on. They drafted custom artwork, pad-printed my company's name on it and packaged it in a clear clam shell.

    I would think you could, HOWEVER, you need to keep track of every shipment you ever receive and send back out, because if there is ever a problem with it (medically), the gov't will want to know where it originated from.

    I mean if it somehow caused a skin rash or something... I would think you need to know the chemical makeup of it, or the 'lot number' at least....

    Cripes - I just got a rash from one of Peter's temp guns...sure hope he has the lot number! Didn't see any warning about affixing it to my forehead with his hobby adhesive on the package. Think I have a case?

    I would, but I only have one left. It's on my office wall along with past products like the PANIC Button, the Sink-EEZ Disposer magnet and the Techno-Swat (The 5.25" Floppy disk fly swatter!).

    Yes, you are now entering the world of "PRIVATE LABEL".

    What this means is you are licensed by the OEM or Proprietary company to purchase, redistribute and retail their product under your own name and regulations.

    Of course, this is a business agreement which calls for contracts, meetings, numbers and business structure.

    You cannot sell an OE (Proprietary Product) without an agreement, license, or official contract status, or else it would be called forgery, counterfeiting, or misrepresentation.

    Short selling another product locally or on a small scale can be done if you are looking to make a quick dollar is one thing, but to repackage and distribute another product on a multiple-scale, is called FRAUD!!!

    If it's patented or they have any other type of intellectual property protection then no, you can't repackage and resell it. This sounds like a bad idea, without getting a license from the company.

    At the very least...

    1) it doesn't sound like you are really adding value
    2) It probably won't go over to well with the manufacturer

    I've had people do this with our products and I did not take it too well. The person was not adding value and just marketing our product in a new market and charging exorbitant prices. My first impression was "hey what do I care? a sale is a sale", however most customers were none too happy to discover they paid 2x for a product I'd have sold for 1x, and often blamed me. Furthermore, there was a different expectation of support and warranty and quality when they were paying double. I found that the downsides outweighted the positives, so I talked to the company and we worked out a deal where they get better pricing from me and sold my product with my blessing. It didn't last long - they moved on to doing a similar thing with another manufacturer (selling for 2x and pocketing the diff).

    It may or may not be legal, I dont know, but I do know that if you don't add value to the supply chain, you won't be in the chain very long.
