Now as some of you know, and others have heard roomers and other things. Over Two and a half years ago. February 05 I was arrested by an off duty dallas police officer. He charged me with "Creating a Disturbance" and "Resisting Arrest". With out getting in to the details that are being handled in a Federal Civil Rights case, I can report this. The Denton County DA tossed the Resist Arrest charge "we have reason to doubt certain aspects of the case and have little hope of achieving conviction beyond a reasonable doubt..." (if you read between the lines they think the cop is lying - no comment) Now the other charge of "Creating A Disturbance" is more fun. No one has been able to find the charge so I contacted Chief David Kunkle's office. He assigned a Lieutenant in legal affairs to investigate why the charge was never forwarded to the DA. The LT took 6 weeks to have people physically search the records at City Hall and other locations. In 6 weeks they could not turn up a single paper copy of the charge. THe Dallas City ATTY has now officially "Dropped" the charges due to "the statute of limitations" without saying so because they can't find the charge. This has been a 2.5 year nightmare of dealing with something i certainly didn't ask for. I could go on but when the dust clears... We are in Discovery in the Federal courts right now. I will update what i can when i can.
Congrats- I know how you feel- like a dark cloud has been lifted off of your shoulders. People do not understand the long term stress that goes along with having a pending case over your head pending when you know you did not do anything wrong. I was sued for over $4 million on a bogus black mold claim ( I am having to edit what I want to type) that was eventually (after 5 years) thrown out on summary judgement due to lack of evidence. The minute I found out it was finally over it was like I had won the lottery. I did not realize the pressure it had put on me. Again, congratulations! If you need the name of an attorney pm me.
My lawyer is a former Dallas Police officer. He kinda specializes. Sad thing is there is enough demand for his speciality
I wouldn't wish what I have been through on my worst enemy. 22 trips to court/DA's/county clerk in Denton, Endless hours on the phone, days of lawyer time, jail time, loss of income not just for the time but the collateral time, loss of sleep, loss of a lot of other things, damage to my reputation. Phone, long distance, the number of "old Favors" i had to call in from Canada to here.... I could go on only good thing to come out of it at this time is the dude... who came to live with me just after. until he came into my life I couldn't sleep. This sounds like one of those Guilty until proven innocent deals. Sorry. Been there, done that, but not to this degree. Although the flip side of the coin is what would society be like without law enforcement ? Errors and all.
You are lucky they didn't cut your hair! I was thrown in jail in Pineland Texas one time, just for being in the truck with some long haired dude......I convinced the Jailer the qualudes were my heart medication as it WAS my perscription......... Boy, that was the happiest cell block you'd EVER want to see.... They let us out once Western Union had the Bail Money as they needed the room for Saturday night!!! LOL! If you knew more of the details... This was not "Law Enforcement" There was no Law to enforce, and there was no call to pull a tazer and put it on my heart

My pardners had to Bail us out, as the ski gear was with the boat in the Impound Yard...last trip to Pineland, for me..
It's funny that has been both the easy part and the hard part. Everyone who saw what happened came up to me later and offered me their numbers because they said "That was wrong" but getting them to follow up on that has taken more effort.
I'll only go as far as Point Blank then turn off to my crib in the Nat'l. Forest... That's a good idea though there's some bad azz roads thru there, let me get a local Bail Bondsman on Standby..... I'm kinda like Paris Hilton, after a few hours in the Grey Bar Motel I'm like "that's enough, can I go now???"
Cue Maxwell Smart voice "Missed it by that much...." So I drive up to denton for the 22nd time, this time to recover my bail and a copy of the "we are not going to proceed..." letter. Guess what? I got the letter but THERE WAS NO ONE AT THE DENTON COUNTY CLERKS OFFICE WHO COULD SIGN MY CHEQUE!!!!" No one, they needed 2 signatures. I find the ONE DAY that the entire signing authority of denton is out for "Retraining" THis agony continues for another day.
