I won/paid for a USB analogue controller for my computer. (paid through paypal)

10 days roll by with no communication.
12 days and I send out an Item not receive complaint. In return I get a 'refund via the seller on paypal'. The seller claims the shipment was 'lost'.

I would leave it at that but ebay says I'm still the winning bidder and have to pay. Reluctantly, I re-pay via paypal.

10 days roll by with no communication.
12 days and I send out an Item not receive complaint.

Now the seller promptly sends a refund leaving me as the 'unpaid buyer again' and files a complaint against me in ebay. (for not paying lol)

In the dispute, I post the dates at which I paid via Paypal (the trans ID #'s) and the dates at which I was refunded. Unfortunately, there is no human mediator that can see through this mess and recognize the scam artist.

So I'm left with this open dispute.

That sucks to hear, I always send my items with a tracking number or US postal shipping confirmation number, I leave it up to the buyers if they want to add it to their purchase & even disclose that info in my terms & conditions of the order. There are so many ways people can scam you on EBAY it's best to cover your arse to prevent this from even happening.

    Good luck

Agreed! The only real way to CYA as a buyer though is to use paypal. You can get your refund (under $1,000) but ebay still leaves you stuck in the middle of the transaction as the 'non-paying bidder'.

    silliness.

if im shipping via usps priority, i always get delivery confirmation...it's only a few cents.

I do this because i have been scammed by buyers in the past that claim they did not receive the item, and i had no way to prove that the item had been delivered.

I also confirm the shipping address before I ship out because i've also had people claim that I shipped it to the wrong address, and that they want a refund.

i'm really wary of internet person-to-person dealings.

I always buy the delivery confirmation too. I include the price into the shipping and handling costs.

So the guy sends me a refund and then files a 'payment not received' complaint against me.

I just received a phone call from Paypal because this guy has filed some sort of complaint against him.

I always pay with my AMEX credt card through paypal
any BS comes up I just call my CC and get a charge back. Let ebay, paypal, and the seller worry about the rest :)

actually, I did the EXACT SAME! My Amex via paypal.

The only problem is the issue isn't with paying.

I really dislike Paypal. The few occasion's I have had to use their customer service due to bad sellers have never resulted in me getting a refund, no matter who I yell at. I try to pay outside of ebay whenever possible now.

had a similar issue with paypal and they resolved it very well, and quckly...via several emails.

nor sure why you aren't getting a good response, they actually have a resolution section that for the first time, to me worked.

I had ZERO trouble getting money back. The prob is though.... I am STILL left as the winning bidder! It has almost been a month.

If I pay, he refunds me and then files a complaint that I haven't paid!!!!

He has done this three times now. There seems to be no end in sight as he doesn't respond to email or ebay communications.

Ebay feedback does not leave you much room to tell your side of the story. Keep a website where you can post pics and tell your side of the story for cases like this. I had one Ebayer claimed I cashed his check and never mailed the item, so he left me negative feedback. I had the check because it came back NSF. I told the story and posted a picture of the NSF check on my website. Then in my reply just put "LIAR! See: www.yourdomain.com/liar.html"

The liar always gets schooled when they try to pull stunts with me.

This is exactly why I DON'T take Paypal. People like to "buy" items with a credit card through Paypal. Then when they receive it, they call the CC compant and do a chargeback. So in the end, they get the item and their money back. Paypal sucks.
