    The primary focus of FerrariChat is on high-performance road cars, which are based on racecars.

    Racecars are pushed to the limit on racetracks. However that may be, certain design limitations are in place, along with restrictor plates and so forth, so as to create a level playing field. Road cars can be pushed to the limit on many racetracks under more controlled conditions.

    But, no innocent bystanders were at risk.

    Amongst others, Rob Lay, the site owner, pushes his car to the limit. On a track.

    All those who race can be championed for putting their lives and machines at stake. And they can brag about it.

    But, in the eyes of the law, it would be considered unwise to drive triple or greater the posted speed limit. It is considered foolish to publicize said exploits on the open road, with proof positive provided via the lens of a handheld camera. Oftentimes by the driver himself. Why take that chance?

    If you tell a guy you just banged his wife, and show him pictures, he's gonna take the law into his own hands, or, lie in wait. The road is a Traffic Cop's wife, and in turn, the D.A. is the cop's Best Man. Either is entitled to seek the greatest punishment against the guy who's banging the cop's wife.

    There's two ways to avoid that peril - don't pork the ol' lady, or, pork her all you want, just don't tell everybody. 'Cause, sooner or later, that'll come back to bite you in the ass. Gawd forbid anybody should get killed or maimed in the process, particularly an innocent.

    As a host, why should FerrariChat take the chance of being perceived as encouraging reckless behavior?

    You're assuming that the 'evidence' found on a bulletin board posting is plenty to satisfy The State's burden-of-proof for a moving violation, such as speeding. Funny, I thought cops used Radar guns, not Ferrarichat....am I missing something?

    wax has reminded me of another point...two of the Enzos (Wyomong and here) and even the Lamborghini supermodel crash were caused by the cars overdriving the road...........all curves and grades are based upon physics and are calculated off of posted speeds.......arguably the Russian in Nice, France as well by eyewitness accounts WAY over in town limits..

    Search the two different Dallas Ferrari fatalities, this year......

    I can't believe we have such a huge contingent thinking this (speeding and filming) is all OK to do on uncontrolled public roads, despite traffic conditions....obviously not residents of deer or cattle country.....LOL!

    It gives a little more bite than some disclamer. If one lawyer looks at it and thinks the policy is to sound to drag into court where a disclaimer wouldn't have been then the policy done it's job. Saved Rob from having to spend money on a defense attorney. Again easy to criticize when you are not the one is going to be paying. Rob has more exposure here than any of us and should have a right to cover his ass without the ****** remarks you made earlier.

    I was just thinking about the two Dallas accidents, myself. Guess how many times they said Ferrari and High Rate of Speed on the news?

    And I simply can't believe it either - could it be that some of these people are just venting off to show us how much stones they have in the same manner that they would have us read their road-rage/race stories?

    Maybe its just me, but I don't want to breathe somebody else's second hand smoke.

    Ok, fine. Ban anyone who claims to speed.

    What's next? Ban anyone who has Tubis because it annoys the neighbours and they may sue FChat?

    Or perhaps ban anyone with modified exhausts? CARB is doing a crackdown, so FChat may be responsible for encouraging such illlegal stuff!

    Ban people talking about waffles too! If someone chokes to death on one, FChat may be responsible for saying they're tasty.

    Just ban everyone. You just never know.

    The video or pictures on a post do not have to meet the burden of anything. They may however be used to help identify someone and or help to establish probable cause to arrest or file criminal charges. they can also be used in a civil lawsuit. I don't believe someone is going to get a speeding ticket from an Fchat post. However, if there is a more serious violation such as reckless driving, DUI, street racing or God forbid an injury or death, then stand by ! Any information found on a website would be used against those involved. First by the DA in a criminal matter and then in a civil suit. Can you imagine a jury looking at a persons posts from a car forum bragging about going 120 mph down a highway or a video of him doing that ! The jury would hammer him.

    To quote Tom Cruise in A Few Good Men " you must have been sick the day they taught law at law school"

    Look, I don't condone this kids actions. 140mph in an escort is a lot diff than an experienced driver doing 140 mph in a car built for it. The point is that he likely won't be convicted and I believe that others making similar posts won't be convicted. There have been NUMEROUS posts warning people that they'll go to jail if they post a video. My argument is it will be VERY difficult to get a conviction. As far as others emulating the behavior. I saw hours of footage of all kinds of things on MTV and HBO as a teenager growing up. I didn't turn into an idiot. Nor do most teenagers. We don't talk about reckless behavior non-stop on this site. When it comes up, the community votes w/ their keyboards. Many post on how stupid it is. Many ignore it. But the amount of this stuff on this site is minimal as it is.

    I am NOT arguing that individuals should not be held accountable for their own actions - but the 'new policy' implies that The State should be allowed to hold others, Rob and FChat included, accountable as well for the actions of the individual. This is flat-out WRONG, and you know it. But instead of fighting this moronic philosophy, you're running scared and actually supporting it (why I dunno). If there exists a threat for a Publisher to be sued by the posts of a bulletin board, the safest course of action (by legal standards) would be to post NOTHING. This is the road we're now walking down, folks.....its not a 'safe' trip as you imagine it to be.

    My comment on 'nailed it' was more: If someone was brave enough to always be touting something [illegal or not] then they should be brave enough to back it up with facts like DL, etc. Stand up. Like fill out one's profile and NOT hide on the net to troll or call names etc.

    The Statement wasn't intended to be directly to you. I was trying to say to anyone not just you. That if anyone likes to speed, race and drive dangerously on public streets no one here is capable or going to stop you. Just do not come here bragging about it. It is not accepted behavior and should not be encouraged.

    could be: pattern of behavior can be gathered from many sources. Just becuase one is caught under normal means doesn't mean it is necessary to gather other proof. However, If one, say a DA, wanted to truly press a case for more, that DA could gather [free] evidence from any source to include the net. [or cell phone texting, or ......pick one.]
