How do you solve this problem?

    A rather young woman from Ethiopia came to work for me after fleeing a "death squad" type of situation. Other than a bit of a language barrier and being shy, she fits in just fine and is harder working than the others who are near her age. She worked for me for about 6 months and was in Canada about 6 weeks before that.

    So I get a call from her in tears, apparently the person who took over my company hired a manager which in turn fired her for insubordination. {This was two days ago}

    Apparently she was reassigned to another part of the building where she isn't supposed/ qualified to work and when she stood her ground and informed her manager about the faupaux, she was threatened with the police and the termination of her job.

    So she heads out looking for her floor supervisor to ask what exactly she's supposed to do when she gets to her new location and after collecting her water bottle and books, the manager shows up and orders her out of the building for insubordination, tells her that she's suspended for two weeks and at the end of the two weeks she'll be fired. Then tells her that the police are on their way and if she doesn't leave before they get there, she'll be thrown out by them.

    Just after she collects her jacket and purse the police show up, three of them in two cars and Makelazhia {I have forgotten how to spell her name} is about 5'2 and maybe a hundred pounds.

    As she's walked out, "Brad" calls out and says "we didn't want your kind here anyway".

    Gawd damn I'm sweating now.

    Anywho I make a call and get the above story from the man in charge himself, word for word.

    As it turns out he's culling the employees by colour. He point blank doesn't like "non-whites", so for the smallest infractions, he's handing out pink slips.

    I somewhat befriended her when she worked for me because she was so shy and her English wasn't great. As I talked to her about this, she tells me that before she came to Canada, her brother was taken from their home just before everyone was going to bed and they haven't heard anything on where is went or where he is now. He was 14 and that was 5 years ago. After she was escorted out, she cried for 3 days until she made herself sick and had to see a doctor.

    What the hell?

    I have the phone call I made on tape {as I record all potentially damning conversations} and she does have a doctors note and she was prescribed a medication, I believe it's an antidepressant.

    There have been three other people who have been tossed out, two black people who were both born in Canada and one Indian woman who has lived here longer than I've been alive.

    It hasn't even been 4 weeks and this madness is in full swing!

    How would the more than civilized FChatters handle this? Remember I have no say in how the business is managed, I didn't stay on in any capacity.

    P.S. For now she can pay her bills and rent and get to and from, so it isn't the worst case scenario.

    In the USA we have the Department of Labor and they would take such a case VERY seriously. They would levy big fines against the employer if it were proven true and the victim would be able to sue for wrongful termination and perhaps get additional damages due to the racially motivated reasoning.

    If you want to help her, suggest she go talk to the Canadian equivalent of the DOL, then go talk to an employment lawyer. Maybe Art (Yellow360) on this forum would have a recommendation of someone to talk to? As I recall he handles this type of work (but in the USA).

    She should be able to get compensation for what happened, and the manager should get a hefty fine or maybe even worse if its anything like the USA.

    I am not sure what else can be done but the above should be enough to put a stop to this behaviour lickety-split.

    It's bloody crazy.

    We have a department of labor, human rights and you can surely sue for wrongful dismissal.

    I feel like I left them {the employees} in this mess, I had no inkling that this storm was coming, I bet they're pissed at me. Uggggg.

    Dont beat yourself up buddy. You could not have reasonably foreseen this. It sounds like the manager is a real piece of work and the DOL loves to put people like that in their place. You may wish to talk to an employment lawyer before you go to the DOL. Here in the USA I believe its illegal to tape a phone call without consent from the other party. You dont want to go to the DOL and then find out that you broke the law and you're on the hot seat :) but things may be different in Canadia and I am not a lawyer. It may end up that a lawer could give you a rundown on what a legal way to get this guy to incriminate himself may be (if your existing evidence is not legal, that is). Then you could do your employees a favor by doing what you can to help.

    Please keep us posted how things work out. I would love to hear about this scumbag getting his come-uppance. Nothing is more disgraceful than being a racist pig and using your bigotry to harm the livelihood of hard working people who have done nothing wrong. If its as you say, I hope he pays and pays BIG. This is 2007, not 1940 - he ought to be ashamed of himself.

    Wow, here in the states the lawsuits would have been flying!! Holy crap.

    Unless you still have any control over the company, then she might be screwed. What a f'd up situation...

    I'm supposed to go on a golfing vacation in 6 days. When I got the call I had a game scheduled for the next day and had to leave after the second hole. I couldn't focus.

    FYI, I can record anything at anytime, anywhere but entering that phone call in a court of law would be over the line. I've recorded phone calls and in person visits by the police, harassment mostly. I get pulled over {on average} every 3 weeks in my little 924, I have had it since August 2002, do the math. That and I was in sales and the recordings were instructional for the new guys.

    No union so technically she and the others have to do this on their own.

    Have you thought about bringing all this to the attention of the person who took over your company? If you don't feel comfortable doing it in person, then through an anonymous communication.

    Here's the one behind this. And from experience he does NOT need a manager, everything is straight forward and there are 3 supervisors that handle what a manager would. I truly believe he hired this manager to do the firing as a buffer. Other than hiring and firing there shouldn't be anything for him to do.

    I would feel quite comfortable in any situation especially one like this. The "owner" knows what he's doing, he told me over the phone. He also said "we think alike". I assume that means I had more white-ish people there than not.

    62.....If you have a new company (Wich I assume from your first post), why not hire her to work for you? I would.

    Would you be in a position to hire her now to do all the pre-biz start-up work? Sounds like she would be very valuable to you.

    The paperwork is filed, everything is ready to go except me, there's nothing else to do. She worked as a shipper/ receiver for me and I won't be needing a shipper/ receiver for the new business.
