    ST. PETERSBURG - A Pinellas County circuit judge today gave the mother of John Graziano temporary guardianship of her young Marine son, critically injured in a car crash while wrestler Hulk Hogan's son was at the wheel.

    Probate Judge Lauren Laughlin also granted a continuance of the guardianship hearing as Graziano's father, Edward, had requested. No date has been set for the hearing to determine who will be the permanent guardian, but it is expected to be held within 60 days.

    After closing the hearing for 45 minutes to hear about John Graziano's medical condition, the judge said there was "clear and convincing" evidence that he is incapacitated and unable to make decisions on his own.

    As emergency temporary guardian, Debra Graziano will be empowered to make decisions about the medical care and veterans benefits of her 22-year-old son, who served in Iraq.

    "If I had a situation where I was in critical condition like that, I would want my mother to make the decisions rather than some person coming from the outside who doesn't know me and doesn't love me,'' George Tragos, Debra Graziano's attorney, said after the hearing.

    Tragos also hinted at the likelihood of a lawsuit against the Hogan family in the interests of John Graziano's long-term care.

    "I think that any guardian would pursue a civil suit," Tragos said. "That goes without saying.''

    Tragos did not know whether John Graziano had a will and power of attorney drawn up, as is typically the case when service members are deployed overseas. He said the Department of Veterans Affairs, which has been paying for his medical care, wants Graziano moved to a VA hospital.

    Graziano has been in critical condition at Bayfront Medical Center in St. Petersburg since Aug. 26, when he was injured while riding in a Toyota Supra driven by friend Nick Bollea, Hogan's 17-year-old son. Hogan's real name is Terry Bollea.

    Clearwater police have referred the case to the Pinellas-Pasco State Attorney's Office, which will decide whether to file charges against Bollea, possibly by next month.

    Attorneys for Graziano's father, Edward, who is estranged from his wife, unsuccessfully sought to have an independent, professional guardian appointed.

    Steven Hearn, a Tampa lawyer who said he was retained nine days ago, told the judge he needed more time to prepare for the hearing. Hearn also said he wanted the additional time to investigate his client's concerns that his wife is receiving financial support from Bollea's family.

    Hearn said they have been paying for her living arrangements at a condominium or town house in Clearwater. She previously stayed at a hotel, also paid for by Bollea's family.

    Bollea's family initially paid some of Edward Graziano's hotel expenses shortly after the accident, "but that was cut off shortly afterward and since then he's not received anything at all," Hearn said.

    The Bolleas were subpoenaed to appear at the hearing, Hearn said, but they did not show up.

    No, why would a car be dangerous at high speed? A car can back over someone at 5 mph. I drive at high speeds everyday along with the rest of the world. And you said a "high horse power" car was dangerous. I can get to about 200kph in any car. Horse power has very little to do with speed.

    So are hammers and chairs dangerous? They can be used as tools to kill.

    Your argument is poorly constructed, just like all of your other posts. You aren't making any sense.

    And when you don't reply to simple questions that you raise, it makes you look like a retard.

    Can they sue the family or just the kid ? The kid doesnt have any networth and I dont see how the family is responsible for this incident,

    I would hazard a guess that they will find a way to sue the family - especially if the kid is a minor and they gave him the car. It was also apparant that they did nothing to ground him out after earlier incidents.

    And just MHO, but I don't think we should be so quick to label the injured kid's guardians "money-grubbers". I can assure you that 90% of the people (at the very least) would be doing the same thing they are under these circumstances. Especially given the attitude the "Hogan" clan seems to be taking - like posting trash and not answering the summons.

    Is it possible that their past payments to the injured parties are a sort of admission of responsibility?

    Is the kid still a minor? If so, then the parents are still on the hook.

    I'm not sure what'd be worse, the kid dieing or him being a vegetable for the rest of his life if it was your fault? The vegetable thing would probably fill you with more guilt for the rest of your life because he's still around. Very unfortunate regardless.

    They can be sued since Nick is a minor, and/ or if the vehicle is in Hulk's name. My friend is going through this with his son, but his son is over 18 and the vehicle is in sons name, but the insurance was under dads policy. The insurance company made an error in insuring it. After receiving a letter from one of our top litigation lawyers, the 'for the people' one, he called the firm and stated he was not listed as an owner of the vehicle then hung up. It's been a month or so, and they haven't bothered him since.

    I think I have heard that a death has a lower payout/settlement than a life long vegetative state settlement.

    Is this another Terry Schavio case in the making?

    Also wonder if Hogan's show will be on next season. I don't see how. It would be a huge cloud hanging over the entire family.
    This may also be the thing that breaks up their marriage.

    Could be a Schiavo thing. The Hulk better have had his assets protected so that insurance covers things vs. them going after his personal assets.

    Not unless they turn into pariah's I think the show could still run. They might be able to spin something positive out of it.

    Jesus, you have a thick skull. Anything can be used to kill someone these days. the problem with this case is that the passenger actually had the ability to do everything in HIS power to make sure he was safe. I.e. take the 5 seconds to put his seat belt on. I can't beleive you don't think speed is dangerous.

    My posts may be poorly constructed but you sir are just.....stupid.

    I could have written it more clearly but I definitely wouldn't post that story had I been the fool to power oversteer on a slick road flanked by ditches without even wearing a seatbelt ;)

    I see Hulk's marrage breaking up over this.

    Hulk will want to protect his $$$/ass and not want to do the show anymore, as I would hope his lawyers are telling him. They need to keep a low profile. Having a show that shows the world you make bad parenting decisions and have money to burn can't be good for the pending lawsuit.

    Linda (wife) and Brooke (big boned daughter) will want to continue with the show as it is thier indentity. They shop, get thier nails done, Brooke goes on dates, all while the cameras roll. It is thier one time brush with greatness and they won't want it to end.

    Nick, hopefully will be in a jail cell and not be on the show at all.

    Haven't most all of the marriages in these stupid reality shows broken up after the show?

    By the way are you still driving the "TVR"? Or are you still "tired of waiting for a ride from a friend or parents etc." Or did you get that truck for "dirt cheap if not for free." Did you get the "Ducati or that Honda bike" you really wanted?

    By the way how many web forums are you on? I count nearly a dozen, some while "owning" cars and looking for 1930's Chevs and Fords to rebuild and others looking for people to play video games with. Trolling and lying all the way to the bank huh? Perhaps you should fit a reading class in there somewhere. The TVR is a nice car, what's your VIN? Have a pic?

    You really think he should go to jail for what happened to the passenger ?

    The passenger got in the car of his own free will and made the conscious decision to not buckle up. The passenger was also well aware of Nicks driving style.

    While its a tragedy I dont think Nick should be responsible for the passenger. Thats me being logical...the law may say otherwise.

    That doesnt mean Im sympathetic to Nick... he should be severely punished for the accident itself, though I dont know that jail time is required.

    The driver is responsible for everyone in the car, even if they do not buckle-up and not only is the driver is responsible, but he/she is accountable for what happens in and with the car. We may not like it, but that is the way things are.

    I hear lately, the driver is responsible for that nasty second hand smoke and it is against the law to smoke in a car with people under the age of 18 in California. What is next.....green house gasses from inside the car?

    I really think Nick should trade places with the passenger, but since that can't happen jail is the next best option.

    How so? Nick chose to drive in an extremely reckless manner that endangered everyone around him. As a result of his actions, a kid is now sitting in a hospital bed in a near-vegatative state. Justice would have been for Nick to be the one in the bed. Vengance would be beating Nick with a baseball bat until he was in the same condition.
