unreasonable noise?

    whats up guys, a long-time lurker here and i got a question for ya. Can anyone define unreasonable noise bacause i was recently pulled over and sumonsed because of "unreasonable noise".

    Here is some backround info, im 21 years old, and curently finishing up my batchelors degree in mechanical engineering. Sorry to dissapoint but i wasnt driving a ferrari, i was driving my silver '00 muntang gt. The car has magnaflows on it and it sounds angry, but can the cop say the noise is unreasonable? That sounds like a opinion call to me.

    My final question is in New York state what is "unreasonable noise" an is there anything i can do because im going to have to appear in court

    I am not too sure what is considered "Unreasonable noise", but it has always something that has worried me. I have an 02 GT Mustangs with flowmaster american thunder, that could possibly fall under that category.
    If I had to take a guess it would be above 90 Decibles, which is what the noise limit for some local tracks.

    sounds like a bull**** ticket, i guess you can go to court and say if it passed inspection then it's good to go.

    What's the regulation cited in the summons?

    Look it up in the Vehicle Traffic Law and it should be well defined as to what it means.

    A quick search finds 24-227 from 1998:

    "Except as otherwise provided in this code, no person shall cause or permit discharge into the open air of the exhaust of any device, including but not limited to any steam engine, diesel engine, internal combustion engine or turbine engine, so as to create an unreasonable noise."

    Pretty vague. Might be a case for Frank DeSousa...

    You got a summons to appear? That's strange. I've gotten a good dozen "inadequate exhaust" BS tickets, though it's just a $70 cash cow.

    Ultimately it's at the officer's discretion as to what "unreasonable" means, as it's a cash cow statute, so if they're bored you get a ticket. Fighting it will ultimately be a waste of time and money, just pay it and forget about it.

    usually when you buy an exhaust system they give you a card that says it's 50 state legal. show up in court and show the judge the card and he should throw it out.

    It is usually a cops call. I don't know where you got it but if it were in your neighborhood I would bet that someone doesn't like the noise as you drive through it. So someone turned you in. If you got it on the road I would bet that you didn't let up on the gas as you passed the cop. So he didn't like you running up the gears although you were not speeding.

    From a Police Officers standpoint, I know where I work, unreasonable noise is usually associated with aftermarket mufflers that are extremely loud. There is a separate charge that relates to the decible level, but is difficult to prove unless the Officer has a decible reader in his vehicle. So in short, the unreasonable noise charge encompasses severel things. Loud music from a car, loud pipes on a motorcycle, loud muffler on a car, etc.. It is all the discretion of the Officer. The Officer could have gotten a complaint from someone passing by as well. If someone told the Officer that the car was so loud and he followed you for a short distance and did determine that a reasonable person would say the vehicle was loud, then he could issue you for unreasonable noise. Now for the rice rocket aftermarket muffler, the charge is $250 ticket.
