Im going to call my Insurance company on the claim i filed and see what the update is so far.
it wasnt a clear title, the 1st owner owned money, got the title anyways and sold the car, he was not a us citizen , left the country and ran with the cash any coverage for the accident....looking like there isnt gonna be coverage....a victim of fraud isnt covered under state farm policy. esquisite leasing on the east coast caused all these problems.
I want to know how if i buy a car from a dealer like Roy Cats, what makes it MY responsibility to go after the DEALER that Roy bought the car from , and not roy. What gives Roy the right to wash his hands?

You've been at this for 2-3 days on L-power (where they finally got fed up and shut down the thread) and you haven't gotten an attorney yet? Perhaps you need to attend to that first as I doubt that any of this chatboard posting is doing anything to help you recover your loss.

Honestly,if you had your title with you and proof of insurance etc. I believe those cops shouldnt of took you to jail.Why because you had proof of ownership. You have been advised by your Lawyer John Bennett out of Montana not to post these dis-crediting and in-correct, misleading statements. So now of course I have no choice but to repsond...I was trying to keep you from looking stupid here, but you leave me no choice. The car in question was "Leased" to a customer of the leasing company you named. They took a $50K down payment on the inception of the lease. The "customer" requested the lease company send him the Title to his home state of Nevada (las Vegas City to be exact), saying he could not get the car licensed our plated with out the title. So the lease company sends the title out to him, making him "promise" to have them added to the title and have NDMV send it back to them...so OK, first mistake on the leasing company part. YOU NEVER send a clear title to anyone on a word. They should have either used a 3rd party agent to do the title work in Nevada...which a lot of out of state lease company's do as well as banks OR AT the very least filed a lien againt the car/title with the State of Nevada PRIOR to sending the title out, this way Nevada DMV would have the lien pop up prior to any title work...by ANYONE. Step 2. The "customer" gets the title. He is NOT a USA citizen. He takes the car to Viva Las Vegas Motorcars in Las vegas. He offers the Dealer his car WITH a title in hand. The Dealer, as he correctly did, ran the car through DMV for any liens and or clear title as well as a stolen vehicle checck. The car comes back clean and clear as it would. "Customer" signs off on the title...gets his cash for the car and leaves. Step 3 Dealer in Las Vegas sells car to CATS EXOTICS. CATS EXOTICS as required by law repeates the same process, check for stolen, check all states for lien, check front and back of title for proper signatures and release. All is good and CATS pays for the car. Step 4 CATS sells car to current poster. Car is paid for. Poster flys to Vegas and picks up car. CATS re-assigns title with all correct required paperwork to poster and overnights title to poster via FedEx approx 3 months ago. Poster HAS title in his possesion and has physical control of it and the car. Step 5 Leasing company has not heard from or had payment made from "customer" on car. They attempt to locate him but find he has FLED the country back to his home country. Further investigation via the VIN# of the vehicle shows the vehicle going through the correct paperwork of Las Vegas car Dealer and Cats Dealer and on to current owner. Step 6 Leasing company "request's CATS EXOTICS to make them whole. This is where the real laughing begins. ARE you nuts!! You guys screwed up by "just" handing a title out, no lien, no nothing...and you want US to correct the problem. Go find your "customer" and sue him or get the money from him. Step 7 Leasing company is able to get a Nevada Judge to issue a "writ" to secure and HOLD the vehicle till a hearing can be had to determine the correct ownership of the car. (IT WAS NOT AND HAS NOT BEEN A STOLEN VEHICLE REPORT) Local Police get a copy of the writ, via the Private Detective working for the lease company. They go to posters house. While en-route they pass him, turn and stop him and take possession of the vehicle. Why he was placed in hand cufffs I do not know for sure. I do know that per the posters OWN words on the other thread...he has had run ins with this one officer. Maybe the officer secured him for his safety. HE WAS NOT arrested or booked for any crime and is NOT GOING to be charged with any crime. Step 8 This is a very mis-fortune thing to happen of course. However there is no wrong doing on the part of either the Las Vegas Car Dealer nor Cats Exotics, NOR the poster. The problem was created by the leasing company's neglect to do their proper home work and file the correct papers. Step 9 Poster was advised to file a claim with his insurance company, get a LAWYER ASAP and have the hearing against the lease company to get his car back. He was also advised by ME and his LAWYER sure sue us, but for what there is not neglect nor will full or knowledge of this car at the time of sale to the poster, we did nothing wrong. I am truly sorry it has happened to you. I have also learned in the lastt 48 hours of several other high end car Lease and Bank companys that it has happened to them as well. They have changed their methods of dealing with titles as well as ALL OF them ate the loss on the car and moved on. The leasing company in this case NEEDS to do the same. I can almost guarantee you with the right lawyer you will win your car back...but I am sorry I can not just right you a "feel" good check to make you whole. Matter of fact no1 did cept as Roy mentioned that LEASING company..That company should have to pay out their own pockets that car back becuase of their stupid mistake of sendin a title out to someone that doesnt even own the car really! HAAA and to top that hes not evevn a US Citizen! Wowww what were they thinking!! 360 Spider you need to SUE that leasin company and give a BIG apology to Roy for puttin him out like that all over the boards.

WOW. Frightening. I would have had a stroke... Sounds like the leasing company is holding the hot potato here. But, was the car technically stolen? You know, there are probably 100's of lawyers on this site, but it seems few actively offer input. Why is that? Some enlightenment would be nice, even in generic terms... The real estate guys chip in and answer real estate questions all of the time. The business guys help with any business related questions. Come on legal eagles, educate all of us!

360, You need to talk to a lawyer Thursday morning. You need to immediately file some paperwork (lawsuit, injunction, stolen vehicle report, whatever) to make SURE that car does not leave SoCal. Once it does you will have a MUCH harder time getting it back. Stop posting on this thread, stop wasting time. Get out of bed tomorrow at 8:30 and get on the phone with a LAWYER. Make sure you can meet them THAT DAY to discuss the case, because you will want to file paperwork on Friday. As soon as that car leaves SoCal and is on it's way to the leasing company, you are going to have a much harder time. Yes you can sue Roy and maybe you will get some $$ there, but the whole situation will be much easier if you have posession of the vehicle. Seriously, do not waste time on this. You already wasted 2-3 days. Move on it NOW or you stand to lose the car, the money, and any future lawsuit.
