    Hi everyone.

    Just an update.

    The matter of what type of lawyer has been a lengthy and complicated procedure.

    I think this is a federal case, because it involves parties from many states.

    I am working with a lawyer , since that is what everyone is wondering.

    I also filed a claim with the " Attorney general of licensing motor vehicles of Washington"

    I faxed him all the documentation , bill of sale, title , purchase order, everything.


    So now is it up to them to help me.

    Does anyone know if i am protected under the "consumer protection act" ?

    The real mark of a businessman is what he does when there is a problem.

    And sadly this is not how you do business in my opinion , as a broker, legally and ethically.

    Actions speak volumes.

    And unfortunately I truely honestly believe Roy will not step up.

    If he in fact "steps up" , it will be because of the pressure placed on him from the boards, or the legal system , sadly.

    Since Roy needs you to take action before he can file an insurance claim, and you seem to be more concerned with what time to set your alarm clock to and how many forums you can post about this on, I'd sure as hell not give you a dime if I were him since you'd probably never go through with the action needed for him to even think about getting an insurance claim awarded in his favor.

    Maybe you should call Ralph Nader for help with that consumer protection act question, I hear he does pro bono work for exotic car owners.

    I haven't read the entire thread.
    There is a mention that the previous owner put $50k down and leased the vehicle....then it is stated the he had the title.
    Why would the leasing company issue a title to the Lessee if they only put $50k dn on the lease?
    I was under the assumption that a title was only issued if the car was paid in full.

    I apologize if this was answered already in this thread

    Where is this information coming from?

    I would like to know what the police report said from the detective Mcgill who filed the report about the gallardo.

    I will try to provide a copy once my lawyer gets it.

    there has to be more a reason than, they are not very smart, or OOPS we made a mistake, come on now, with 3 cars from the same company, that is not a

    coincidence in my opinion.

    Once maybe, but 3 cars?

    So if the title was "handed" over to Mr. Banana Splits, how was he able to sell it since it was (Im assuming) under the name of the leasing company? Sounds like an "inside job" to me.

    complacent and lackadaisical.

    just because cats exotics may or may not be legally liable doesn't mean you should sit around waiting for a check. actions speak louder than words.

    Intresting that the State of FLorida can take your license away for no wrong doing. Maybe you did not give the the exact facts.

    Today we had OUR State Dealer Investagator AS WELL as our lawyer in my office. They BOTH reviewed all paperwork. Our Dealer Investagator as well as our lawyer, both agreeed. We did nothng incorrect. We followed all REQUIRED Washington State Laws and admistrative codes as required of a License Dealer.

    Does this make me not responsible? Legal wise YES. Moral wise, that is for each to decide. I cant understand why if we did not do anything in-correct and WE had no knowledge of this "supposed" claim from the lease company...(which is obvious given the time frame-over 3 months) then WHY should I take the hit. Yes it is not fun for Josh, I understand that...but it also would be no fun for me as well.

    360spider can (and probably should be) sued for slander! Lots of evidence posted on any/all the forums that he had posted on IMHO!!!

    according to the police report, the car was reported stolen smart guy.

    Josh, I understand your frustration and lack of knowledge of the legal system. You are not a lawyer and are confused and being pulled and pushed many directions. I am truly sorry this happened to you.

    BUT, I am also upset with your continued in-accruate statements of my dealings with you.

    Can you please at least make the correct STATEMENTS!!

    Have I not IN THREE seperate conversations with you in the last 48 hours told you OVER AND OVER AND OVER, P L E A S E get a lawyer and him start a demand letter so that I may turn it over to our insurance?

    DID I not today again, when you called told you very nicely "Josh, please, you and I can not resolve this our selfs, we HAVE TO get the lawyers and insurance company's on it" DID I not again tell you PLEASE HAVE your lawyer call me and we can start the action???

    DID I not speak with your Lawyer in Montana, whom is only handeling the title of your car out of state as a LLC, DID he not tell you as HE told me YES JOSH get a lawyer, I do not practive this kind of law...

    EVERYONE here has told you to get a lawyer. I am going to say it again. I am NOT MAD at you, I do not hate you, I do not have any ill will against you...BUT PLEASE get a lawyer so that I CAN file a claim with my insurance company and get the ball rolling. THEN I can but pressure on them to settle and go after the next guy down the list. AS I TOLD you, they are aware of the possible loss report. AT THIS point they refuse to investigate as they feel there is no course of loss or action on their part...BUT they will sit up and notice once a LAWYER contacts them...sad but thats just the way the world is...

    SO PLEASE GO GET A LAWYER AND DO IT NOW!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    What part of warranty of title do you not understand? It makes no difference whether you knew or did not know there was a problem. It makes no difference whether you did something wrong intentionally. A seller in a business transaction has a warranty and duty to pass good title. Continue fighting this thing with Josh as opposed to giving him his money back, and I think you will find yourself on the losing end of a big legal bill not only for yourself, but you will be paying for Josh's lawyer's next trip to St. Barts.

    A few more things...

    FYI, JOSH we have also been busy ALL DAY LONG with CarFax and their legal department. We are trying to invoke their "guarantee" of buy back...but so far no luck as the TITLE was not branded our liened at ANYTIME. SO WE ARE TRYING TO RESOLVE THIS FOR YOU anyway I can.

    I also understand that many people may think you do not have the funds to retain a lawyer and start the action. This may or may not be true.

    BUT just to show I care. I will OFFER to pay up to $10,000.00 RETAINER fee direct to any LAWYER of your choice in this matter.

    OF course if your lawyer is successful in collecting for you via our insurance company, I expect to be re-paid the retainer fee...NO that is more than fair!!

    I did get a lawyer , took a while to find the right one.

    Do you have a copy of the police report filed by detective Mcgill of las vegas?

    Is it possible those titles are counterfeited?

    How can a title company release title like that?

    to me there is more to this story than , OOPs , or, i trusted you, do you honestly believe the "oops"?

    I need my money back that i all i know.

    Well of course I dis agree with you. But that is what makes the world go round...

    But just for practice...HOW long would you think that would be for, I mean this is three months after the sale...what if it was 3 YEARS...5 Years...what then...and it could happen...what if the TRUE owner was not a aleasing company but a solider overseas, not back for four years and found his car had been sold by a roommate that frauded the titled...same thing...so when does it stop??

    And would there not be ANY consideration that the "victim" which I agree is JOSH had the use of the car for over 5Kmiles and three months...I am sure there would be in a court of law....or should he have just got free use of the vehicle in all this time...I am intrested in your thoughts on these questions?

    JOSH I caution you NOT to make allegations that are not true, I am very patient...but I will not stand for any acusations or allegations that I and or CATS EXOTICS was involved in any wrong doing or "cover up" in any attempt to defraud you of your hard earned money...please think prior to your wild thoughts racey away with you.

    A little too late to be validating yourself now, don't you think! You had all the chance to disprove what you claimed about Cats Exotics not stepping up (to your standards). The owner publicly claimed that he tried to help you out but you my friend lolly gagged and proceeded not to let the others know what Roy was really all about.

    In all of the places I've lived in, "Carnappers" (or even just the suspected ones) were, was and will be taken into custody (I have actual experience of this at the age of 19 with my 308 in LA!) for verification. I doubt that any of the officers would've extended a courtesy to you (by uncuffing and letting you take snapshots of the Gallardo) if the vehicle in question was in fact reported stolen.
