I think everyone or at least every other person is missing the point. I think Roy wants to correct the problem and I think he has insurance to correct the problem, but insurance companys have to have a claim filed or be contacted by a lawyer....they do not hand money out when just asked. 360 needs to get an attorney. (period). He keeps typing and typing and procrastinating....it really makes no sense to me. Nothing is going to get done without a lawyer. Why not get one? How can you have the money for a car like this and not know what kind of lawyer to get....or someone to call to get the correct one. Does this make sense to anyone? It makes absolutely 100% positive NO SENSE to me. I wouldnt do anything and that would either force him to do some homework and get a lawyer or take the hit himself....if hes stupid enough to take the hit himself, he deserves to loose the money.

Most people have missed this point. Josh has started a cheer-leading rally and gleetfully paraded through multiple forums w/ Roy's head on a stick and Roy's body through the mud and put it up for target practice TWO FULL days before he even contacted Roy. I'd find it hard to go out of my way to help......

    I got a lawyer.

i just want my money back or car back.

They always love how the little guy goes against the big car dealer and usually prevails.

    This is a nightmare.

Well that is pretty frickin fair, and then some.

My question was why Roy hasn't initiated a claim - his answer is that the insurance does not feel there is merit to a claim and will not pay it. Ok, next step is send a legal demand letter and then sue if they don't pay.

Roy is also offering to pay the retainer?

Any barrier that may have existed to the resolution of this case has been eliminated. It's all you now Josh.

    Roy,

I think he is wondering whether the guy who leased the cars made up counterfeit titles, not you. Of course you would never do that.

But Josh - I hate to pour cold water on you but it really doesn't matter at all how it happened. Maybe it was an inside job. Maybe the guy made fake titles. Maybe he did something else. What does it matter? He's out of the country, you have no recourse with him. The cops want to make sure any crimes are prosecuted. They aren't going to intervene on your behalf to get your car back. They aren't going to call Roy and tell him to pay you. That is ONLY going to happen with a lawyer. The cops may make your path easier to hoe but they aren't going to do it for you.

Focus on your lawyer. IMO it's unimportant how it all happened.

But what Roy has to understand, as well as Josh... They are both victims of the same thing, except standing behind one another in line. Roy needs to get his lawyers opening a can o' wup a$$ on the LV dealer. They have the same duty to pass title to Roy. Roy will get his money back, but the good business sense tell you that Roy should give the boy his car money back and save that 10K retainer for his own henchmen.

    Come on guys..........

This is getting ridiculous, with all the allegations, accusations, and opinions. Why don't we let these guys sort it out and report back with the facts. If Josh has retained an attorney like he said, it should just be a matter of time before he gets this resolved.

    YES, 100% REALLY...

NOW if you truly do not have the means in which to find the right Lawyer...I will even give you several to call.. I OF course can not contact them directly for you..like I have told you..

I HAVE INSURANCE for this...IF THERE is a valid claim I AM MORE THAN HAPPY to have them pay for it. **** I pay well over 40K a year for Dealers lot insurance and no claims in 5 yera, so they have made money and it is fine with me that they have to work for their fee once in a while!!

Roy probably doesn't need to lawyer up. He can have his insurance foot the bill for the claim. Then they will send a demand or lawsuit to the LV guy who'se insurance will kick in and then either sue the leasing co or the posession of the car will be determined in court. If the leasing company gets it, it will be after they pay the amount that the LV dealer is out.

Common sense is never a subject of proof and class derives from maturity. This is all you need. You don't need a law degree.

    Again I dis-agree with you...

HOW can I possibly go to the Dealer behind me, say HEY I want my money back...the FIRST thing their insurance company will say, IS what mine will say...did you have a loss, did you pay out, do we have an issue that we are liable for...

SAME answer, JOSH needs to hit me first, then it goes down the ladder via the insurance and lawyers to the guy behind me and so on and so on..

The sad thing is no MATTER what someone is going to lose here...in higher preiums for all of us...the only guy having a good time is the scum bag that is out of the country with the cash!!

I quit, let us know how it turns out. Maybe all the lawyers you guys think need to be involved will be buying the rounds next time I see them in St. Barts on your dime. It really is not as complicated as you're making it.

NOW that is a real sign of your character...taking "advantage" of people, that as your clients you consider "Bozo's"

Maybe as you are preaching here you should have "stepped" up with all these "Bozo'z" not taken them for a ride and their money and just settled it...

WOW the kettle calling the pot black comes to mind...

    Thanks for your insight...

HA! There never was a "barrier", and it's been "all Josh" since MONDAY THE 24TH! You're going to tell me it takes 60 hours to just get a lawyer? While at the same time racking up literally hundreds of forum posts, between at least 2 and probably more forums? Kid has been punching Roy in the balls for 3 days and Roy is still willing to bend over backwards to make this retard whole?

"He should just pay the kid."

    Don't be a f**king retard.

"It's the right thing to do.

    Shut the f**k up.

I am particularly amused by those who scoff at what Roy's legal council, his state Dealer Investigator and his insurance company have said. They must all be idiots, eh? There's no way Roy's lawyer, the WA state dealer investigator and Roy's insurance company might know better than some idiot nutswingers on F-Chat do on this matter.

360, it sucks that, through no fault of your own , your car got taken from you Monday. It's sadder that if you'd been johnny-on-the-spot you might have your car back already. I hope you've got this show on the road.

Roy, it sucks that, through no fault of your own, you've been bashed, trashed, lied about and dragged through the sh*t storm once again for the amusement of know-nothing mushmouths. You bent over backwards for this kid on this car from the moment he bought it, further and further. I would have snapped back upright and kicked him square in the balls by now.

I left my house 4 and a half hours ago.

collected my friend went to see another friend.

    we went to the gym.

i dropped them both to their homes.

    i stopped by the supermarket.

and now i'm back, and this is still going on.

This is better than going to the movies.

action, accusations, police, lawyers, money, fraud, international scam artists, sports cars, this is just missing a couple of sex scenes and we have a recipe for a great movie.
