    Considering you have made "defamatory claims" against Roy and Cats Exotic in a public forum, I doubt you will have any change left. That is if Roy and Cats Exotics pursues a defamation case against you. So if I were you, I would just talk it out privately with either Roy, his lawyers and your lawyers and stop rallying up a mob to side with you.


    Elements of Libel and Slander

    I. WHAT IS DEFAMATION?

    Libel or Slander: Libel is written, slander is oral.

    Historically, defamation consisted of slander and libel. Slander is defamation by speaking, and libel is defamation by means of writing.     Defamation consists of the following:

    (1) a defamatory statement;
    (2) published to third parties; and
    (3) which the speaker or publisher knew or should have known was false.

    40k a year..for insurance and they are giving you **** over a 100k claim. Call your insurance company, there is no need for lawyer.. I had same thing happen in smaller scale 8k car, my customer was pissed that a lein was on title that did not show and bank would not let go. I called my insurance company explained situation and they sent a check signed to me and the customer within 5 days. they went after auction that sold me the car and who knows from their and I dont care, thats what I pay them for. They never said I had to get sued.. They are smart enough not to have lawyers involved if possible. 360boy lawyered up will cost more than just giving him his money back.
    BTW, my insurance is only $2600 a year for $250k inventory full coverage. They paid 8k like it was no prob.

    Carfax is damn sure not gonna pay, that is too funny... way to help..:)

    One things for sure, the LV dealer had a hint.. I bet they got one hell of a deal.. Anytime someone walks in the door trying to sell a highline car they are gonna shoot way low.

    Cats exotics better hope the motor vehicle commission in his state doesn't hear about this.. My customer called in on me and I had to go to a hearing and about lost my liscense for doing nothing wrong and getting the guy his money back in 5 days. What else could I do?

    In Cats favor I would not have wrote a check that is what my insurance is for and if your insurance company is not willing to help you with something you are covered for without being sued and bringing a bad name for you company, I would change Insurance companies next year...

    The Uniform Commercial Code is a raft upon the sea of common law.

    § 2-312. Warranty of Title and Against Infringement; Buyer's Obligation Against Infringement.

    (1) Subject to subsection (3), there is in a contract for sale a warranty by the seller that:

    (a) the title conveyed shall be good and its transfer rightful and shall not unreasonably expose the buyer to litigation because of any colorable claim to or interest in the goods; and

    (b) the goods shall be delivered free from any security interest or other lien or encumbrance of which the buyer at the time of contracting has no knowledge.

    (2) Unless otherwise agreed, a seller that is a merchant regularly dealing in goods of the kind warrants that the goods shall be delivered free of the rightful claim of any third person by way of infringement or the like but a buyer that furnishes specifications to the seller must hold the seller harmless against any such claim that arises out of compliance with the specifications.

    (3) A warranty under this section may be disclaimed or modified only by specific language or by circumstances that give the buyer reason to know that the seller does not claim title, that the seller is purporting to sell only the right or title as the seller or a third person may have, or that the seller is selling subject to any claims of infringement or the like.

    I cannot even think how I would feel if the car I paid for was impounded by the police because as it turns out I may not "own" it. With that said, I think what you should do is stop bashing Roy, thank him for his kind act with the offer of cash to retain a lawyer and work toward a common goal of getting this problem taken care of.

    Unfortunately the rule of thumb is $20 per mile so you now owe that leasing company $20,000 for miles driven.

    The way you're acting , no wonder you haven't found a lawyer to take your case. ...and lawyers will do anything

    Stop worrying about how much your mileage will cost. None of that will matter if you get a lawyer and get started. You will be made whole, not to worry. I don't think it would be too smart of you to accept any legal fees from Roy, although you must say is a nice offer. It will work against you if this thing gets ugly. If you really like the car and really just want it back, get started tomorrow . A legal action involving that car can keep it from being sold.

    ROY IS BEGGING FOR YOU TO SUE HIM SO HE CAN SEND THE CLAIM TO HIS INSURANCE. READ HIS POSTS, HE IS "BEGGING". WHY ? WHY ? WELL,FOR ONE SIMPLE REASON:

    HE WANTS TO HELP YOU BUT HE CANNOT DO IT FOR YOU. SO DO ONE THING, have a letter of intent sent to cats exotics and from what i see, roy may be able to take care of the rest from there and simplify your life. it will cost you 300-400$ for a well done letter and that is all.


    roy understood that he has a claim against him that has a certain weight and made it clear he understood. he is giving you every reason to initiate a claim against him.

    i think the insurance company will go and get the car back and fight it and will win as the leasing company did not register a lien. too bad for them. but they can fight these battles and will fight it.

    HURRY ! (WHILE ROY STILL LIKES YOU as i can feel he is getting tired and a little hurt by some of you comments.)

    it is understandable roy cant come out in such an issue and say guilty i am, but he did say enough to show he wants to assist. the buyer is dragging his feet and doing nothing to help himself.

    good luck to both of you.

    roy,save yourself the 10k , get a lawyer friend of yours to call the buyer and get the letter going so your insurance still has time to go fight the case. if too late, the car will go back as it will be un-challenged by no-one and the leasing company will have their property without challenge.
