As others have said before me .. this has got to be the most amazing thread I've read .. and it still doesn't look like we're any closer to a resolution .. which is equally amazing!

Without wanting to take sides, I admit I certainly feel for 360 but for the life of me I can't understand why he seemingly doesn't help himself. That being said, if I was in his situation I too would want/expect Roy to reimburse me for my purchase, whilst at the same time I appreciate why Roy hasn't. Am I still sitting on the fence?

Back on page 8 (post #148) Roy said that he'd spoken to one of the other duped buyer's lawyers .. given 360's seemingly inability to get the "right" lawyer and as it's in your interest to settle this matter as well, could you not provide 360 that lawyer's details? He knows the case details and has already had success getting one car returned, so 360's case should be a walk in the park.

I think the mods needs to do the same here (lock the thread once and throw away the keys!). It'll be best for all parties concerned! The way 360spider's going, he's bound to lose the car and the money if he does not reset his priorities. For someone who claims to have already employed the service of a legal counselor, he sure seems "lost" as to whatever it is he needs to be doing!

To 360spider, ask your lawyer (if you really have one) and not the forum for legal advise. Choose your wordings carefully and try to be more gentleman like by not arguing with the guy that has been more than fair and that you will have to (eventually) settle an issue with.

To roy, I would've sued 360spider for slander and/or defamation, I commend you for having nerves of steel! If I were in your shoes (thank God Im not!) I would've lost it and called a few lawyers of my own and "invested" in a libel suit against the guy. But, the world is not all "fantasies and make beliefs" so keeping your cool will see you through this quicker than "my way".

Based on what I've been able to piece together, it looks like Cats Exotics wrote a purchase order for an out-of-state car, took payment, but didn't take title(?) - instead acted as a broker. just a guess.

It's interesting and important to note that the State of Washington DMV is apparently not requiring cats Exotics to automatically reimburse the buyer. I'm fairly confident that had his dealership been in California, and he had written the purchase contract and accepted payment for a vehicle which proved to be undeliverable, the DMV regulations require the dealership to provide a full refund of all money paid, just based on these facts alone, and regardless of any other factors.

I'd assume that under any circumstance, the buyer may also issue a claim against Roy's $30,000 bond, should the matter remain in dispute.

 

This is what I do not understand, why has he had the car since January but now 3 months later it is reported stolen by an unknown person? How can that happen?

 

Most probably by the time the leasing company sent numerous reminders to the fraudster demanding payment with no reply, and by the time they realised that he fled the country, and by the time the car was found in another state the whole process took 3 months.

Why would a dealer question a client's ability to pay anything? What does it matter to you what he can or cannot pay, and why would you bring it up on an internet thread? ROY? Listening to me? Hear what I am saying? Why would you, as a dealer, even offer up a shadow of a doubt about your client to the interweb world? He bought the car from YOU. YOU should NEVER publicly question a client's ability or disability to pay for anything.

Why 360 has to go hire a lawyer at-all amazes me....he's the CUSTOMER. He paid his money, got his 'title', and did absolutely NOTHING WRONG HERE. He got stopped, detained by the Police, and lost his car. And to make matters worse, he has to go pay a retainer, sit on his butt, empty-handed, and wait for 'the system' to work???? That's crap - Napolis is right on the money here. Mr. Cats should have cut his customer a check without having to 'find legal council first'....all that has accomplished, so far, is to ensure 360 is left with NOTHING even longer - oh, LESS THAN NOTHING, since now 360 has to go hire a lawyer...yea, I bet that was cheap.

Sorry, kids, this is called BAD CUSTOMER SERVICE. V-E-R-Y BAD! If I were a business who had a hand in all of this mess, I would be ashamed of myself and my conduct for leaving a CUSTOMER out-in-the-cold, holding the bag on a deal gone wrong. Hey, Roy, when this mess settles out, do you think 360 is going to come back to you and buy another car? After all, you admit that he will eventually be 'made-whole' again, so eventually 360 will have Lambo Money in his pocket soon - minus the money he needs to get a Lawyer to convince you-and-yours to do the right thing by your Customer....bless your heart, you probably won't see a dime of 360s money ever again. The Vegas dealer should have already reimbursed Roy, I mean they probably only sold the car to him four months ago, why don't they just cut him a check? Any good dealer would.

Something like this: purported con man got some leasing company to send him the original title which was not marked as having a lien holder, he sells the car to the vegas dealer and flees the country with the cash, Vegas sells to Roy, Roy sells to 360, months go by and lessor pursues getting 'their' car back even though they gave away the title and had never registered a lien against it. Now the lynch mob would like Roy to cut a check for the price of the car from his pocketbook for a purchase that was completed legitimately and with a clear title months ago instead of having 360 perform the simple task of having a lawyer draft a letter so an insurance claim can be filed. Supposedly the same guy did this with two other cars as well.
