    Less than 72 hours...and yes...JOSH was advised of the "possible" issue..BUT to protect my customer, WHICH HAD AND STILL HAS A CLEAR AND LAWFUL TITLE, we DID Not release any info on the sale of the vehicle to ANYONE with out proper procedure. I am not in the habit, and never will be of releasing my clients info over the phone JUST because someone ask's? I think you would want me to do the same with your account if I get called. I ONLY release info with a court order/subponea...NOW that is protecting my client.

    I did nothing but re-read the very timeline Roy himself posted. Go read it, it's on one of the early pages of the thread.

    Like either a lawyer here or Napolis or someone posted - Josh is the LEGAL TITLE HOLDER and the best chance he had for keeping the car was literall that - keeping the car, hiding it somewhere, or now that that is no longer and option - GOING TO COURT right away to keep the car from the leaving the state. Because once he has posession of the car or the car can't leave the state, techincally its still his, and the leasing company's only recourse is to go to court SANS POSESSION of the automobile.

    Techincally the leasing company doesn't have possesion/control but the JUDGE they went to does, and that's just about the same thing.

    Even if Josh wasn't ready to duke it out with the cops or the judges or play 007 with the car, at least would have had WARNING. He could have got himself a LAWYER a LONG TIME AGO.

    And we've all seen in this thread how long it takes Josh to do anything, like get a lawyer. He could have had a lawyer on standby, one who had already consulted with Roy and gotten the facts of the case, and the car stashed away somewhere, so when the cops came looking all Josh had to say was 'Yeah that's my car and it is MY CAR - and here is my lawyer's number.'

    This is just whacked.

    I think I'm going to quit posting on this thread. It's too much of a mess. This thread is a lesson to every single person that ever buys a car like this.

    Josh did you really know about the problem?

    If anyone ever called me and told me about something like that, I would at least turf the car at the nearest dealer until I got more information, if not rent a storage garage.

    Although honestly if Roy had called me, I don't think even I would have thought in 72 hours there would be cops coming to get a car I got 3 months ago and had been driving thinking it was mine. It's almost inconceivable.

    So lesson again, if anyone you bought a car from ever tells you some crap like this, go put it somewhere where no one will think to look until you find out EXACTLY what was going on.

    Good luck to Josh and Roy, i hope you both end up coming out with your monies back....

    I do to but not to the extent of actually accusing Roy that he had prior knowledge of the car being "wanted" by the LV courts!

    EDIT: Apparently, Roy did inform 360spider about the possible issue.

    Well he did but by only 72 hours according to him, which again is a point in neither's direction. Yeah he knew and maybe called his customer but the ball had been rolling too long already.

    Looks like they had the judge thing ready to go and as a last ditch effort before executing that tried to get Roy to give them their money back.

    I will leave it up to you, do as you wish, I have not been able to view and "lurk" there any longer since all my IPS have been blocked the last 24 hours LOL oh well, I understand... the truth of this whole issue as that there is no way what so ever I OR JOSH come out ahead on this NO MATTER WHAT!!

    I offer 10K for his attorney, sure hindside dumb, now half will say he did it to cover up, half a good thing..nothing and I mean nothing I do can be a win for me..I have just decided to let it go throw its course and let it all come out in the wash...nothing more I can really do...

    I will say ONCE AGAIN for the record. CATS EXOTICS and Roy Cats and any of its employees NEVER at anytime had ANY knowledge of any issue with the title to this car. AS a MATTER of fact I stand 110% behind what we did with this sale and would not have done anything different if I had to do it over. WE followed every rule and did everything we could possibly have done. THERE is NO WAY in HELL we could have had any knowledge that the "leasing" company had an "alledged" claim to this car....NO WAY IN HELL! I am extremly sorry this happend to JOSH, I am sorry it has happened to all involved, but I must let it takes its course now and I have nothing further I can do.

    I am very sorry for those who think I am a crook and am in the wrong...there is no way I can change your minds. I also appreciate the people that have the understanding to see what this is, a very bad situation for all that must now be dealth with in the court systems.

    I will also have to stop posting here as it has come to light now that there is more to this than the "leasing" company has told us...that it MAY be NOT the fault of the seller to "viva Las Vegas Motors'...new information is coming forth that the "leaseing" companys two owners had a falling out and one has caused a lot of issues for the others in the way of short selling titles...in defense Viva has been in contact with us and IS cooperating with everyone involved..they have as US done no wrong doing what so ever...

    I am sure there will be more to this and all I can do now is wait...

    I really wish you would please back off on this thread.

    All you are doing is goading Roy from an online dispute into a bloodbath. You are not his dad or his business partner or his lawyer, so I fail to see why in numerous posts in this thread you keep "helpfully pointing out" that you feel Roy has a slander/libel case. You are clearly not a lawyer so I fail to see why Roy as the owner of a multimillion dollar successful enterprise would take some guy on the internet's advice? You remind me of one of the guys standing beside a couple of guys who are having words with each other. From the safety of the sidelines you say "ohhhh did you hear what he said? Are you gonna let him get away with that?" - goading others into combat so you can sit back and just take pleasure from the results.

    Roy is a big boy and I am sure he doesn't need or want your input on what he ought to do in this situation.

    Teach us the ways to become a felon! :D Seriously, I would've surrendered the car to the nearest PD and given them the necessary paperworks to prove who the legal and most recent owner was. I definitely wouldn't have taken the G out "for a spin"! Big lesson for everyone indeed!

    Nope, they were calling trying to get an addres so they COULD go get the car...AND I REFUSED to release any info on my client...JOSH was fully informed of this..

    I dont see how you could've mistaken me for "baby sitting" Roy to begin with. This is a forum and people are encouraged to give their comments. Im sure Roy is where he's at right now not because he "took my advice". Just so were clear on things, was drgek's comment/inquiry about 360spider's source of income more "appealing" much less "suitable" for this forum?

    Nowhere have I asked where 360spider got his income from. I couldn't care less. How would that be relevant? If you take your head out of your butt, you might be able to see that for yourself. I haven't deleted any posts here, so go back and read through all of them and tell me which post # you are referring to. Not only are you an idiot, you are a libelous one too.

    Ah! I knew it! the story of title given to the leaser was too stupid not too hide something else more sinister involving the leasing company.
    Someone mentioned many posters attempting to turn this into a bloodbath and I agree. The issue is back on track with the dealers cooperating. May be the last buyer Josh is also cooperating with the police and have an attorney involved. If so the car may be back to him quickly. I would be glad to see this happen so that everyone her can learn something. Ultimately what we have here is a bunch of enthousiasts, dealers and not being screwed by scammers who dont care about the cars but only about stealing money from guys like us in a very sneaky way that cannot be detected easily. Let's not forget that. Josh could have also been much smarter and faster in reacting to the warnings and would still have his car while explaining the situation to the police with an attorney. He could also have been trying to get the fact quickly rather than starting a "drum beat soap opera" on the LP forum.

As someone who has helped at least two people keep their possessions (which they had legally obtained, legally imported, and continued to legally own) out of the clutches of US Customs, I can assure you that Mark's advice is 100% correct. As recognized by law.
