I think you're way off base here. No one is rallying around the poor "mass" for the sake of taking down the "evil Capitalist"... this is FerrariChat afterall!

Impoter/exporter of automobiles, motorcycles, RTW and some basic commodities (in Manila) since the early 80's! I have had a similar experience (but not as complicated with a motorcycle) and I was adviced by my brother (an LA based lawyer), his colleauges and my LAPD friends to do exactly as I had indicated.

Really? Roy just said he knew about it 72hrs before the car was taken by the cops. Did Roy call Josh the moment he found out?

So if you didn't post your constant comments to Roy suggesting he sue 360 with the intent that they be taken seriously, I guess that means you were just stirring the pot to keep the battle going?

As for the comments about where 360 got the $$ to pay for the car, it's also irrelevant to the discussion, but I can see there being interest in the question given the lack of attention to detail (and apparent cluelessness) that 360 has displayed.

However, there are adults discussing the details of whether Roy is on the hook to pay for the vehicle and making salient points regarding such. Then the peanut gallery is adding their own special form of value with the "yeah! YEAH! GET HIM! SUE HIM!!!!! I would!" comments.

Not helpful, not interesting, not relevant. So whats the point?

I think Roy told 360spider at some point but he did indicate that he did not let the cops know of the Gallardo's whereabouts.

It would be amusing to me if at the very start Roy had Josh's back and gave him that extra 72 hours to lawyer up and protect his car. I'd laugh my fat ass right off...

And this post of yours is helpful, interesting AND relevant!? What's YOUR point? C'mon man, seriously. These guys dont need to be told what to do. Its up to them to accept any comments and/or suggestions. Relax man, its the internet! No need to get all worked up for nothing. Whatever people say in a public forum is basically worth whatever you think its worth. Besides, I think you are underestimating Roy's ability to handle himself in a situation. It wasn't like he agreed with me to sue 360spider at some point.

You got some very bad advice. And you are giving bad advice yourself. You might know something about import/export, but you know nothing about the law or legal strategy. Please post your contact info and your brother's so those of us who want to can steer clear. Don't worry about looking up the LAPD's contact info, I think most of us know better than to get legal advice from that outfit.

I got the impression that it was exactly how you said it was. Which is why 360spider lost my vote and compassion.

During the time circumstances surrounding the incident, it was the best advise possible. Also, I still feel that it would've been a good advice in 360spider's case as well. If he had placed his car in the PD's custody, it wouldn't have been sent back to the leasing company. 360spider's lawyer would have been able to recover his car easier as he had a clean and verifiable title.

the question i feel compelled to ask here is this

why should the OP have to sue ?????
everyone seems to be saying "sue sue sue" but surely sueing should be a last resort - IF the dealer doesnt play ball and do the right thing, not a 1st port of call.

Quick question, how would 360spider respond to the cops (after "hiding" the G) when they ring the doorbell to his house? The car was titled to him and Im assuming the address in the registration would be the same as his residence!

    "The car is not here."

I am not toying with you. This is the exact answer he needs to give. Nothing less, and certainly nothing more.

What has to be done is the start of a process. No business is going to just cut a check in this situation. Of course, Josh needs to be made whole and the only way for that to happen is for him to lawyer up and go down the line of those who had the car between himself, holding the clean and clear title, and the ones who claim they actually own it, the leasing company. Roy is doing the right thing. He's protecting himself by making use of his own legal council and his own insurance company. Roy knows he's done nothing wrong, per his lawyer and the WA State dealer investigator, so the idea of Josh "suing" him isn't a concern. He knows it's just the first step that has to be taken. This car and title took many steps along it's journey to Josh, now it has to retrace those steps back down to the leasing company. Just the way it is.

but why does he need to sue ???

    surely a letter would suffice.

    "dear roy cats,

the gallardo i bought from you in good faith on ***** has now been impounded as it seems it was actually stolen/fraudulently sold/has outstanding finance on it. it was taken by officer **** of the ****** police force on ******** at **********.

now as a licenced dealer im sure you understand that form my end the buck stops with you and that as such you are financially liable for what has happened.
please either refund me or sort this mess out asap.

    yours truly ******* "

ok it might need a bit of polishing before being sent, but do you see what i mean ?
basically why should the OP have to spend yet more money involving a 3rd party at no doubt massive financial cost to himself.
