A car sale may not involve money. Any payment schedule is not relevant to when the sale occured.

Just a quick question, if I wrote a cheque for the automobile on the 1st of the month and the cheque does not clear until the next day, when did I actually buy the car?

I guess either way the dates are so close together, that unless it was Cats policy to run stolen vehicle report on date of delivery (not a bad idea in the future) it wouldn't have come up with a hit as stolen.

Josh, as the car is stolen, call your insurance and tell them its stolen! Why not at this stage...as perhaps, and I don't know anything about insurance law, maybe there is some type of coverage for this in auto inurance? Fraudulent conveyance or something? Likely not though huh.

The answer is howeve we wrote the contract. If I was selling you a car and I thought you were a shady MF, i would write 'Sale is not complete and transfer of title and ownership will not occur until purchaser's payment has cleared the bank. Should funds fail to clear car will be immediately returned to [me] and all purhcase and sale agreements rendered null and void'.

    there.

NO! Duh he would say that the police stole it. Goto the police station and file a report, that the police stole the car. Technically they sort of did (smile).

I would do it just for fun, why not.

I mean technically on the date he bought the car according to you guys, WHICH IS PO DATE OF 12/20 the car WAS NOT REPORTED STOLEN. As of that date if as according to y'all is the OFFICIAL DATE the car was purchased, well then:

No on but the rightful owner can report the car stolen. As Josh was supposedly the owner on 12/22 when the car was reported stolen, the leasing company has filed a FRAUDULENT STOLEN VEHICLE REPORT.

    How about that...

Yeah...Josh send your paper work to Las Vegas Police Dept, and show them that you were the rightful owner on the date the car was reported stolen, therefore it could not have been reported stolen, because you had it. Tell them as the rightful owner you are requesting that the stolen vehicle report be cancelled, and the car returned to you immediately.

I've been curious about that part too. I figured that the corrupt leasing company person was viewed as stealing it from the leasing company.... Josh then received stolen property??

No you can't receive stolen property if you were the rightful owner on the day someone else reported it stolen.

Probem here is there are two rightful owners: Leasing company and Josh.

Leasing company who originally leased it out, and Josh who legally purchased it and has the title.

In the end i think the judge is going to view the sending out of the title to the bone head who fled the country as a relinqusihment of title. That is pretty much the case anywhere when a leasing company sends a title to the lessee, at hte end of the lease on a buyout or whatever. Mr Out Of The Country could come back and say and 'hey instead of leasing the car i decided to buy it and that's why they sent me the title, I then sold it fair and square for a little profit.'

Of course that guy is long gone and all we have is the leasing company's word.

Thats not the current story. The guy did not flee the country nor did the leasing co send a title out to him. You missed some posts. And just because Dec 22 is the date the car is reported stolen doesn't mean thats the date the theft occured.

Okay, maybe so, but I thought I'd read all the pages. If he didn't leave the country, and he didn't get the leasing company to send him the title, how did the original lessee pull this off then?

FOUND MY OWN ANSWER: The owners had a falling out and one of the owners was short selling titles?

So then in actuality, my statement about the judge seeing it as relinqusihing the title maybe more relevant than ever. Its one thing if the lessee scammed the title and then sold the car, but if one of the lease company owners somehow sold him the car for pennies on the dollar or something? And this guy got the title and flipped the car?

This just get weirder, and weirder.

If the case exists someone please post the whole thing and take the time to redact all the names.

Roy, I have a friend to introduce you to, his name is Prince Valium. He can help you with these posts.

Is abolfaz somehow involved in the situation with this stolen car other than an observer? To my knowledge, no... so, I still am not getting what his history (whether it's clean or otherwise) would have to do with it?

Seems to me that if one of the principles of the leasing company was selling these titles short to line his own pockets...well thats a civil matter between partners of that biz. He might be a slimeball, but not knowing how the company is set up id say the complaining partner is F'ed. Now get this info to the judge who wrote order to sieze and he might rescind his order. End of story.

Yeah i started watching L.A Law back in my teens........

Chill out. I know you're PO'ed and the way Josh acts sometimes I can totally see why.

This thread is getting very long in the tooth and beyond it's sell-by date. The only things that I think we KNOW at this point are

-The title problems were caused by some bickering business partners
-You didnt know about the problems when you sold the car
-Now you know about the problems you will not refund his money unless compelled to do so (and that is your right)
-Josh has (Finally!) retained a lawyer and will almost certainly be "made whole" either through insurance or through judgement
-Josh has made a whole lot of mistakes from the day he decided to get a Lambo until today
-Both of you probably with you could go back and never have dealt with each other
-Life goes on and we all have our health so this isnt the end of the world
