    Josh, while I feel Roy's offer was a nice gesture, I would continue on the legal path you have begun. There is no reason for you to not be made whole. This whole mileage charge and rental fee is BS. Roy has been mostly cooperative so let this go to his insurance company , you will most likely get money for loss of use and maybe any interest you paid while without a car. Again , I'm pretty much on Roy's side , just telling you what I would do.

    I have a prediction: Josh gets his money back, Roys has to pay back the $2500 he got, but owes nothing else, the lawyers all get brand new Merci Roadsters

    That there number 6 of yours bothers me.

    Roy, I do not think you are going to get the car back either, it seems to me as you say that if you sue up the latter the car is gone, to you, to Josh, to this viva company. So why does Josh need to pay you for mileage or rental. That can only (maybe) apply if you get the car back. Which I don't think you will.

    I think you will be made whole, but to make money from this just does not seem right.


    On another note, I think Roy is a stand up guy even though he won't finance me the Lambo I want at $299 per month, just this is a really messed up situation.

    Yes, Why should Josh have to pay for a rental fee and milage. Why do you get to profit from a rental of a stolen car? I side with the customer here. How much more of a pain in the **s does Roy have to make this for his customers. Are you kidding? Does a restaurant charge you for bites eaten out of your steak if you send it back to the kitchen? Wow, this is a true measure of the way you handle business and how you treat customers. Josh, After you get what ever money Roy gives you, i would sue him for the rest and more for the BS this guy has put you through. Unbelievable ethics!

    Eating a steak and sending it back to the kitchen is much different than driving the piss out of a car for 3 months and putting 7K miles on it. What if Roy gets the car back? It is worth a lot less than it sold for in December.

    Like I have said, no matter what I do, not every one will be happy...but this is apples to oranges not even the same thing..

    What next I should also pay back all the gas he used?

    All conflicts have to have a give and take somewhere along the line...so to think I AM making money off of this is just stupid math...try I am loosing on it...you all ASSUME I will be able to recover the money and or the car...what if I dont for what ever reason,,,? Think about that for a minute.

    The customer didn't send the steak back...a cop came by and confiscated it from the diner while the customer was eating it, after the customer had paid for it.

    Frankly, the customer did his part: he paid for the dinner.

    So why doesn't the customer have his dinner, and why should the customer have to sue or otherwise pay more money?

    A customer should have one and only one job: to pay for the product.

    Everything, and I mean everything, after the product has been paid is on the shoulders of the supplier.

    Now, perhaps it isn't the restaurant's fault that someone else called the cops and had the steak confiscated...but the restaurant got paid and should be protecting their diners.

    He was driving the piss out of HIS car not a rental or a lease an certainly not under the notion that it would be confiscated.

    A butcher without a title...gets to place a lien on something that isn't his (perhaps because he was stupid and gave something like a title away to a thief) and have someone else's car, er steak, confiscated from someone who paid for it.

    If turnabout is fair play, then strangers off of the street should have liens placed on every steak that the butcher owns, with each one being confiscated by police to "let the courts sort it out."

    Well, well...that's an interesting twist. Hope that someone doesn't turn him in for trying to avoid state taxes on the car.

    He may find jail waiting for him in addition to losing the car and cash.

    He did not register the car, the dealers did not register the car. There is a major flaw in the system here folks that Premier pointed out as law in SD

    If it's true, the kid is in for a world of hurt. I've got a buddy that was freakin' **hounded** by the State of California for unpaid taxes.

    The young prosecutors, especially the left-wing girls fresh out of law school, live for going after easy wins against males (hope that the kid isn't White, as that would make the girls go rabid) in anti-environmental "rich man's" exotics.
