Yes, you do have that right. That is not my car. It is your car.
You still want your car back? Spead that anger onto this forum will not help you getting your car back.

But if I were you, I would do whatever to get the car back first. That includes getting help from everybody from this forum, LP forum. Even beg whoever... that can help to get your car back.
After you have the car in your procession, then you file small claim court against the involved dealers for the lawyer fees.
This is the route I would do and the way it should be done. Anyway, that is your car. You have to right to do whatever you wish.

The forum power should be your last card and last resource after you have tried your steps but not successful. See how many enemies you have now on this forum? You used it too early and wasted that resource.

But I truly wish this will never happen to anyone. I have learned from your case. I know you will get your car back. Good luck.

i have a question more on topic.

    background:
in Georgia, if you buy a car from a dealer, you pay 7% sales tax on the car, and AD Velorum taxes , which are based on the taxable value of the car. this has to be paid in full in order for you to tag, register and drive the car.

insurance has to be valid in the national database also at the dmv , or no tags will be issued.

    my question:

how much are the taxes and tags on a Gallardo of this value?

    thank you

With reference to using 9 credit cards for a transaction,
Um, no, they don't have to be in my name. I don't think that all the credit cards used by Josh were in his name.

Next time you want to act smart, you might want to cross check your assumptions.

Nope if ou got off your ass and done something constructive to get your car back then you would.

Of course you do but when this person tries to help you and all you do is keep kicking him in the balls. And then have the nerve to wonder why he changes his position. Then you shouldn't be surprised when the people here decide you are an idiot.

Again he has tried to help you are doing nothing but being impossible to deal with. There is nothing this man has done or can do that will make you happy. If the car was back in your driveway right now you would still be *****ing.

"Every single 1 of you is missing the point i am trying to make here.

I will say it once again.

    The topic is "Roy's word"

Roy's word , To me the customer, has changed so many times , he has lost all credibility."
Although I dont feel Roy knowingly did anything wrong, he still sold a stolen car and should remedy the situation. I bought from Tonkin as they are very reputable and the oldest Ferrari dealer in the US.., and Roy has been banned from other Lambo websites like ********** and who knows what others, for similar percieved actions. I might think twice about doing business with Roy after reading this...I have to trust my dealer implicitily..
Although the actions of the purchasing party would have not been what I have done..or many of us might have, it still does not negate the actions of the selling dealer...just my 2c

Without rehashing any of the details, you should be so lucky to have Roy still working on getting a resolution on this for you. He hasn't headed to the Bahamas and has been dealing with this head on regardless of whatever errors you and him may have made.

    -mick

PS IMHO, a good resolution would be getting your car back - even if thats not the resolution you hope for.

Everyone got paid. The original leasing company got paid, the Las Vegas dealership got paid, and Roy got paid.

Now, *someone* claimed to not have been paid, and because the kid was either ultra-lazy or a scammer, hadn't registered his 6 figure car to get a state-issued title and become the state-recognized owner...so a prior owner who was still in some state's database as the Lambo's owner was able to get the car impounded.

So there's pretty heavy fault on the part of the kid who bought the car as well as whomever claimed to have not been paid.

Frankly, with the level of greasers involved in the transaction, I'd guess that someone spotted an easy mark when they figured out that the kid hadn't registered the car (especially if they knew that he paid for it with 9 credit cards so wouldn't be in a position to offer much of a legal fight for it).

What Roy did wrong was to not have title insurance on the car to protect his customer, as well as, perhaps through no fault of his own, sell a car with a title that could be questioned by a prior owner. This may have been exacerbated by Roy giving advice on how to avoid certain state sales/use/tag taxes.

Then Roy made the mistake of trying to help out an idiotic customer who demonstrates not only rampant stupidity and laziness, but open hostility.

All of that aside, if the person who claimed to have not been paid for the car actually was paid, yet still had the car impounded by filing some sort of (presumably false) report, then *that* person is at even more at fault than the Kid and Roy.

Now, if this story gets made into a Hollywood movie, the only other twist required would be for the that bad-guy who falsely claimed the car to be stolen...to be working in cahoots with the Kid. Now that would be some fiction!

I wonder if Josh at least credit cards where you get 3x or 5x the points. That's the perfect plan. Buy your next car with credit cards get all of the points, pay your cards off right away to avoid interest and in the process get 1 or 2 all expense trips paid for. Now I just have the find the closest Bugatti dealer.

Josh...at what point do you actually put your energy into something positive or efforts to get this resolved. I've spent the better half of the day today simply making phone calls to find out HOW this happened to begin with. I've spoke to the investigators, police detectives, owners of Exquisite Leasing, even the people that sold the car to Exquisite Leasing. I know where the car is and where it's going. All in what, a 4 hour time span? I know the stolen vehicle report wasn't 12/22/07 but was actually 3/21/08...the date of LOSS was claimed to be 12/22/07. I know a lot more about this now.

It' my understanding that you want your "Dream Car" back in your driveway....at least that's what you posted earlier...yet the very person that is trying to recover your dream car you go completely out of your way to bash...I'm going to reserve my personal opinions on how I would've handled this for another time. I just don't get you though...so let's tell everyone how this whole transaction with Josh came about...since you're questioning our patience and cooperation with you...

    1. Josh calls wanting a Gallardo for MAX price of $115k. He is informed that he should raise the bar a little or he runs the risk of finding a story car or something with no history. Josh begs, please find me one for 115k.

    2. We locate said car for $115k. We are told car has service records and new clutch...clean carfax, title work is in order. Obtain photos, etc. Josh jumps up and down and wants the car, which we purchase then spend the next week processing Josh's payment.

    3. Josh schedules a truck from Gran Tourismo to bring the car to him. Only car is not ready to leave until the next morning, trucker agrees to wait, Josh cancels the truck and pays no dry run fee to driver. Then Josh flies to LV to get the car.

    4. Cory meets Josh at airport at 11 PM at night because Josh did not want to wait until the morning. Cory spends over 2 hours going over the car with Josh, SHOWING him how to drive the car even.

    5. Josh leaves and feels the car pulling to the right...so rather than stop and check...he keeps driving until smoke is coming from the right front wheel. He immediately assumes the tire went flat due to previous accident history and thinks there is something wrong with the suspension. Jumps online to post this "possible frame damage concern" while waiting for a tow truck and drains the battery using his computer for hours waiting for truck to arrive.

    6. Roy felt bad for this misfortune and bought him a new tire...then gets flamed on the boards for buying the guy a tire? Ok...he helped the kid out, but gets flamed for it.

    7. 2500 miles go by and the car goes into limp mode...takes the car to LOC where they tell him that it needs a service. Josh calls Cats saying his car needs service and what can we do to help him out...but forgets to tell anyone that he drove the car over 2500 miles in 2 weeks time.

    8. Roy agrees to pay for half the service, $1500.00. Josh calls and wants to take the car to an independent service facility to get repaired for less. I advise him that we will pay for half of the service, no matter at LOC or independent place...again, this is 2500 miles later.

    9. Car gets serviced and Josh is off and running. Two weeks later, check engine light comes on and car is back at LOC. They say it's an O2 sensor. Josh calls and wants Cats to pay fo all new O2 Sensors. At this point, we decline this repair. Josh has now driven over 3500 miles in the car.

    10. Josh goes out with some friends that are "paint and body" experts...they claim that his car has had the entire body painted, has frame damage, and even goes so far to state that his car might be a flood damage car. Gets involved in one of the biggest let down threads known so far on the other forum.

    11. Roy sends car to LOC and agrees to pay to have car completely inspected, paint, body, frame, everything. LOC concludes that the car has NOT been in an accident, only paintwork was on one door consistent with the service repair invoices for a replaced door handle. No structural damage. No history of repairs in the system other than the required services and campaigns.

    12. Josh now starts his campaign for a clutch that the car did not need...because Cats was informed the car had a clutch replaced at Lambo Las Vegas, that information was passed onto Josh. In fact, it was the clutch PUMP that was replaced and not the clutch. But, Roy offered to pay to have the clutch replaced and also $1k towards a detail job AT LOC. Josh never takes the car to LOC.

    13. 45 days go by and Josh calls, asking Cats to pay him direct the cost of the clutch and detail so he can "use the money for a Murcie" as he was interested in the Silver 02 at Denver. He is told no and we do not hear from him again.

    14. Title sent to Josh's lawyer in Montana for processing.

    15. Josh posts about having a kid jump on the back of his car wearing a metal spiked belt, does nothing but remove the kid from the engine bonnet and sit him on the curb...then drives off.

    16. Josh posts that he is getting "harassed" by police for improper lane change...says he got cuffed & stuffed and received a ticket for this...which he waited 2 months to post anything about, at least according to the timeline he gives, and then says he beats the ticket. Wooo hooo....go Josh.

Fast forward to today...Josh waits not one, not two, not three, but FOUR FULL days before he figures out WHO to call on this? Everyone is forgetting this happened SUNDAY night, not Monday night...where was Josh on Monday? Seems to me, if I just watched my "dream car" leave on a flat bed tow truck, I'd do a whole lot more than snivel like a school girl who just lost her teddy bear...I'd do what I spent the day doing today...finding out what happened and how to fix it.

I for one know that Roy has and will spend a great deal of money on this both For and WITH you to get it resolved. There's more than just Josh, Cats, Viva, and the sellers as victims in this...as I uncovered today...but time will tell the outcome.

Yes it sucks...it sucks bad, but if you'll shut your mouth for 30 seconds Josh you'll learn that the very people you are bashing daily, are the very people that are helping to get this resolved. It's no one person's fault. This goes back to 2006. So try being a little more proactive in this.

It's my understanding the lawyers are meeting tomorrow...let them meet and hash this out.

    Kevin

OMG, what a nightmare customer! That's one customer I wouldn't want for anything. Josh, you bought cheap; what were you expecting, a new car? I don't know any dealers that would have gone out of their way to help you like Roy did. Be grateful, not angry.

I'd wager that this type of ordeal is not out of the ordinary in the world of Josh.

Do your lawyers tell you not to speak about a case in progress?? Why do you feel it is necessary to post all of this on a car forum? It doesn't matter what Kevin or Roy say, you will continue to post nonsense for another 55 pages. I do not think anything will make you happy. Actually I think you are looking to get the car for free and $115,000 from Roy so you can get your used Murcie right?
