    Not quite true. My understanding is that with a purchase of a Scuderia or 599, you must finance at least 50K for at least 1 year from Ferrari Financial Services. Doesn't have to be a lease, although it can be.

    This is some wild thread, fo' sure......

    I say (just 'cuz I can) that Roy did the deal in good faith, based upon the four corners of the documents in hand, the Leasing Company (as some have suggested) WAY overstepped it's legal position in that they screwed up in the first place, and the real criminal is the guy that got away leaving the country with the money.....

    Current Owner (carless guy)should sue the Leasing company for enough to at least buy another car because this one's gonna be in Impound 'till it rusts into the ground!

    Not trying to defend anyone here - just want some questions answered.

    Let's say Roy did all of his homework, and sold the guy a legitimate car. Let's say no parties involved could find out about the title issue during the transaction.

    Put myself in Josh's shoes. My car is reported stolen by a Leasing Company. Would I not go after the person/company who reported it stolen? Especially if their claim is not legitimate, and thus THEY are committing fraud (or at least attempting to take advantage of the system).

    Now, I personally would probably make life miserable for the dealer that sold it to me as well. However, let's say I do get a settlement from Catsexotics. Let's say Catsexotics sues the Leasing Company. Wouldn't a judge throw out the case, because Cats really doesn't have any legal basis for suing the leasing company? Would the judge not say that Josh should come after the leasing company? If Josh is to sue Roy, then by that logic Roy should sue that shady Viva-Las Vegas exotics (which, if you check out their website, nobody should do a deal with them), and they should in turn sue the guy that sold them the car, who is now overseas.....If you want to go "up the chain of blame." Because, rightfully, the guy that committed the fraud should have to pay. However, since he did it well, and got away with it, now everyone is stuck in that cycle.

    So, let's say this happened to one of us in the future. Who would we go after, not for revenge, or because "that dealer sold me the car so I should go after them", but who would we go after to get our car back? What would be the most efficient way of using the legal process? After that is established (I wish there were more lawyers on here), then we can go on about who should do what.

    ANYONE?

    Or atleast (have my lawyer) investigate that supposed "partner" who suposedly took the title and sold it (?) to begin with. In which case, I would go after the leasing company I guess. Or, I would sue everyone involved in the "chain"!

    Roy admitted not only was the car stolen when he bought it, but he was the one who stole it! Also he parted it out and replaced the engine with an old Fiero motor but kept the valve covers and put straight pipes on it. Then Josh admitted that not only did he pay for the car with credit cards, but he tried to get Roy to accept his Macys charge, or get a list of items that Roy WANTED from Macys and Josh would buy them for him.

    Then Roy said that Josh was a doo-dee head, and Josh said Roy is gay. Then they both took it back after Roy offered to buy Josh an ice cream, but then Josh wanted sprinkles and Roy told him to go F*** himself.

    A deal fell through (car impounded) in which a kid with 9 credit cards bought a Lambo (but didn't bother to register it or pay sales taxes or tag it) that was sold (presumably in good faith) by a dealer who offered no title insurance...deal cratered when a previous owner claimed the car was stolen?!
