Why another thread?
I dont think thats the same "Josh", someone here made it clear a few thousand pages ago! Anyways, any news from 360spider? Have the courts decided on anything?
+1 I've totally missed what's going on with the credit cards... Any one have a Cliff's notes edition?
Tim, Who has possesion of the car now? Do you know the reason for it being sent (east I presume) across country? Simon
The CliffsNotes were back on page 74 - surprised you missed it ;-) http://www.ferrarichat.com/forum/showpost.php?p=137609708&postcount=1467 -mick
Oh please...he pretty well volunteered when he dropped trou, grabbed his ankles, and begged to keep his title unregistered and underground in order to avoid paying sales taxes and tag fees.
ok, I just read the Cliffs notes, but I was still wondering the following: "Las Vegas PD is ordered by a court to take and file a Stolen Vehicle report - listed "victim" is Leasing Co." Why did the Leasing Co. file the stolen report? The car wasn't actually stolen? In fact, why was Josh handcuffed since he actually paid the price of the car? (even though he was being difficult about the flat tire, etc) I hope Roy can get his money back, and that Josh gets his money back too. The Leasing Company handed over the title, so they should be the ones eating the losses if the first customer never makes another payment. ~shahedc .
Yup...if the kid had played by the rules, then the System would offer him some protection. But the leasing company is the last owner to be registered with any state agency as the title holder, so the leasing company can claim the car because the kid didn't register his title with his state.
I think he's still trying to figure out what an alarm actually is. And if he does know he's trying to figure out how to set it, but he still gets A.M. and P.M. mixed up.
Thanks Mick! I'd totally missed the "Purchased car with 9 credit cards with various names." Nothing like 18% interest on a $115K purchase! I'm surprised he even needed an alarm clock. I'd think the collection agencies calling at 8:00am would be enough.
Speculating.... 1) Josh is initially handcuffed since he was viewed to be in possession of stolen goods and had no proof otherwise (like a valid CA registration). I'm sure the police would not be interested in a "but I paid Roy by 9 credit cards" type of response. 2) The leasing company convinced the LV judge that the title was "stolen" from the leasing co which in turn allowed the vehicle to be "stolen"... -mick
1) Quite common for "Officer Safety:" to secure ANYONE till they have a sceen in control...he was NOT arrested, he was detained and had NEVER been charged with a crime. 2) Correct on that, they pulled wool over the Courts eyes with false affidavites and information...which is being addressed as we speak.. I can say I think things are moving along quite well at this point...we should hopefully have a resolution next week or so... I have every INTENTION of writing a screen play for Monday Night NBC Movie of the week when this is all done.
I'm sure the fchat members will have a set of actors in mind to play the lead roles for the TV movie... Kal Penn as the mysterious original customer Ben Stiller as the new customer ?? as Roy
It looks for all intents and purposes as though a *minimum* of two scams were in play at the same time: #1 scam: kid getting out of paying sales taxes/tag fees (by keeping title "underground") #2 scam: lease company exec taking advantage of kid pulling scam #1 to contest ownership of the car itself
The one thing the "Leasing Company" was able to accomplish with this BS Writ... They USED the Criminal Courts to aid them in a CIVIL "Repossession" of a non-completed CIVIL contract. The really SMART thing is with this they ARE not required to complete the LEGAL "REPO" laws... i.e. notify LAST registered owner of his "in the rears" payments, with intrest etc etc..and allow the required by law time to make up those payments and get the car back or loose the car.. NOPE instead they get to keep the money from the "first" leasee (civil contract) AND GET a car back to sell again at a WAY WAY higher price then what was still owed on the outstanding lease...AND all at the tax payers exspense....... Basically SELLING the same car TWICE!! AND pocketing ALL the profits TWICE fold! Real SMART (un-ethical) Lawyers he has working for him "Leasing Company" IMO FYI This lease company is NO LONGER in business and is just now a Holding Company completeing its outstanding contracts.
oh ok.. I was going to say Danny DeVito, but I don't know you in person .... and hey, Pitt or Clooney ain't bad.. ~shahedc .
