You know what I've learned from skimming over this thread the last couple of hours?, The fact that Roy will be the only dealer that I buy my next exotic from. He is a asset to this community. I like how he has handled himself over this issue. And I'm a car dealer myself so I know what he has to do by law vs. what he did do, and the manner he did it in. Cudos Roy.
I really feel bad for what has happened to Josh and it just does not make sense to me that this young man has to go through this mess. I actually do admire him for wanting something so bad as he wanted the Gallardo that he ended up smoking all his credit cards to purchase the Gallardo. Not too many people would have thought about doing that but more power to him. Unfortunately, he is a loan officer for a mortgage company and I am sure business is probably slower now than it was in the previous years. I am sure Roy and Kevin from Cat Exotics do not feel good about getting tangled in this bureacratic mess either. I am a firm believer in the principle of if there is a will, there is a way. There has to be a way where Josh and Cats Exotics can resolve this dilemma without wasting any more money in legal fees. I am not an attorney but if we all put our heads together and brainstorm, maybe we can come up with a solution. Any ideas anyone? I have not read this whole post nor do I have the intention to read it. It will take me days. Josh used multiple credit cards for the purchase of the Gallardo. From what I know, Josh should have somewhat of fraud protection in each of the credit cards used for the purchase of the Gallardo. Maybe Josh or his attorney should contact the respective credit card companies and tell them his story. He can seek the credit card companies to go after the leasing company where Roy purchased the vehicle from and do their own investigation. Why the credit card company investigates a dispute, Josh will be relieved of having interest accrued on his credit card. More than likely, Josh is paying over 20% in interest on his credit cards while his Gallardo is getting depreciated double that. Maybe we can start with that. As for Josh, beggars cant be chosers. If Cats Exotics offers you a Gallardo for settlement, take the car and run. Settle with whatever gets offered to you. Even if the car has a salvaged title. None of this bull**** that the car will be bad luck or tainted. Nobody comes out a winner in this case. In the meantime, if members of this forum can brainstorm and come up with ideas, I am sure Josh will greatly appreciate it. I bet if everyone puts their great minds together, Josh can probably have his Gallardo within the next 45 days or sooner. Anyway, just my thoughts to chip in and trying to help Josh. Gustan
My understanding of how credit card chargebacks work is that money would be sucked out of Cat Exotics account so Roy would be out the cash...
That would not be cool either. I know for a fact Roy`s markup is very minimal and for him to take a loss like that he would need to sell 50 Gallardos. Insurance companies are raking it in and there has to be a solution somehow where both Roy and Josh are protected for the screwup the leasing company made. Is there title insurance on cars like they have on real estate? There are thousands of intellegent people on this forum and I am sure someone can engineer a program where there will be a solution. Worse case scenario, I am willing to chip in for a Trust Fund for car buyers that has been taken to the cleaners. We will call it The Josh Fund. I will take time and read this whole thread and see if I can come up with some ideas. I do have in house attorneys and will run the idea by them also. In the meantime, Josh should write a book so he can pay down the balance of his credit cards. Gus
The main problem is that there are too many players. The problems start with someone that neither Josh or Roy dealt with directly or even knew of at the time. From my count, Roy and Josh make up only 2 of the 7 people/companies/courts already involved. Read the summary if nothing else: http://www.ferrarichat.com/forum/showpost.php?p=137609708&postcount=1467 -mick
Dave, it's very unfortunate that you find humour in my misery. I take offense to that. And for you to laugh at someone for going to prison, says a lot.
Please don't wax insightful at this point, you're way beyond that being believable. But yes, I hope my laughing at Wesley Snipes says a lot, because I feel quite strongly when someone who makes a hell of a lot more money than me decides he doesn't need to pay the taxes that the rest of us do, to the tune of $15 mil I believe. If you tried some questionable transaction to avoid taxation that others have to pay, well, hope it was worth it.
ADON, whatever your name may be. I take offense to your statements, I was ignoring your childish remarks, but no more. I have made all payments for my car.
Another childish statement , say's a lot about your character. I am living fine at the moment. I am living in my house, im fine, thanks for your kind words.
How much in taxes did you pay? I just skimmed through the thread, but it seemed to me you dodged paying the taxes by fraud, therefore you could not register the car in your name or some garbage, which is half the reason this situation is such a mess. I don't care that you can't afford the car and put it on 100 credit cards. What chaps my ass is the fraud angle. If it's true, you don't deserve any help from anyone and Roy should tell you to go pound sand.
I am going to make this statement clear, once and for all. I did pay my lawyer to have the car registered , that was his job to register under my LLC. It is absolutely 100% none of your business which state i chose to register the vehicle. I don't appreciate your allegations, it's none of your business where i register the car and why, it's my business.
If this were me, I would never have made that first post. You used the can opener, peeled the lid, and poured the contents out.
Some states require sales tax, some don't. Don't you get it? It doesnt matter where and why what state i chose to try to register the vehicle, its none of your business, stay out of it , and let it be.
I am very grumpy, I hope we can set aside our differences and move on. I am paying almost $3000/month in car payments and have nothing to show for it, life is not good right now. Every day is a worry and struggle.
