Nick Hogan in court right now!

He just pleaded No Contest to wreckless driving. That means no jury trial and he'll be sentenced today I think.

 

What is the penalty for wreck-less driving? Is it not just a ticket? Or is there more to it?

 

How can it be called wreckless driving, when clearly he wrecked?

 

Probably pleading to reckless driving, since we all know he had a wreck. I heard he can get up to 5 years.

 

8 months in jail

 

A guy is near dead and the one responsible gets 8 months?

 

Money can get anything.

 

8 months in the can, will be out in 4 most likely
5 years probation
500 hours community service.
3 years loss of license

Now the civil court case will start.

Nick will now spend 8 months in Gradiator School, maybe he will learn something, but I would doubt it. He will come out a tuff guy.

 

Kind of shocking that he received a lesser sentence than the potential sentence for high rate of speed violations.

Frankly, I think the Courts are very confused. They over-penalize for minor offenses and under-penalize for serious ones.

From the article I read it, the maximum sentance for the charge was 1 yr in jail. The strange part is he pleaded no contest to the charges. This was somehow related to the lawsuit filed against his family. Can someone explain the "no contest" plea? It sounds to me like you're saying "I did it" but not admitting guilt.

 

The article I read indicated he faced a possible 5-year sentence. However, the 8 months he received is less than the possible sentence for reckless speeding in many jurisdictions (1 year).

Didn't Nick have several tickets for excessive speeding already? this was an accident just waiting. Tpp bad it happend to someone else and not the guy at fault.

No contest is exactly the same as pleading guilty. Just sounds better to people, so they say it. I am told it originates from lawyers pleading on behalf of clients with multiple violations--they choose to not contest some of the charges, and contest the others.

I don't believe it's correct to say that it was an accident waiting to happen on the basis of speeding tickets on his record. Most of us have multiple speeding tickets on our record. Are we all accidents waiting to happen? It is correct to say so based on his personality/attitude, I would agree with that. As I would about a few fchatters I have been on drives with--will never get into some of their cars, nor drive in the near vicinity of their cars, as I believe they are also accidents waiting to happen. Just speeding tickets are not a good indicator of such tendencies, IMO--indeed, I would wonder about someone who has never received a speeding ticket, yet claims to enjoy fast cars.

 

No, it isn't. No contest simply means you do not want to challenge the charges against you. You are not admitting that they are true, just saying that you won't challenge them. "Guilty" admits that you did in fact do what they say you did. When it comes to a civil case, the difference will be important.

 

No contest is exactly the same as pleading guilty as far as your record and sentencing are concerned. Whether you fight a charge and lose (are found guilty), or plead guilty, or plead no contest, the ramifications are exactly the same.

What does change with a no contest (nolo contendre) plea is that you cannot have that plea held against you in a subsequent civil suit for monetary damages, arising from the actions for which you are currently pleading no contest. For the charge itself, nolo contendre is the same as guilty.

 

They said on the radio this morning that when Nick would come to "visit" his "friend", he would spend most of the time skate boarding and acted completely disinterested in being there.

Not a shocker, but this kid really is something else. He needs to be befriended by Bubba a couple of times. Maybe he'll start thinking clearly.

 

So you can skateboard in a hospital?? or did he skateboard outside the hospital?? If it was outside what was the point of going to the hospital??

 

While that skateboard stuff may be anecdotal, there is valid evidence that Nick's sister blogged out after court that "she knew a lot she wasn't telling" and that the real facts were being suppressed. It was almost (well, more than almost) like she was blaming someone else for the accident.

The little blog tantrum was removed after one day, but it had plenty of exposure time to get adequately recorded. The information came out yesterday on the internet MSN.com.

I have been asking myself all along on this story - what in the hell is wrong with this whole family??? If it had just been the accident, I would have been willing to accept the tragedy and forgive. But all these selfish antics are making me sick to my stomach.

BTW - did they ever really find out who was driving the Viper?
