    Anyone know who I can contact if I want to sue the state for expenses incurred if I bent a factory rim and blew a tire on 95 north after hitting a pothole? This was around Port Chester, NY, in the Mini, in the right lane on I-95 North. I also had to pay 200 for a tow, since AAA doesn't cover 95.

    AAA doesn't cover I-95?! I knew they didn't cover the Merritt. Sorry to hear about what happened. It isn't the same state but contact dan360 from Boston. He is a moderator for the New England forum so it shouldn't be that hard to find him. If I remember correctly he was in his Challenge Stradale and had the same situation occur up in Boston so he would know who to contact. This happened quite a few years ago so I'm almost positive it was him.

    This is why bmw now offers "bent rim" insurance on the newer cars.

    I have the "bent rim" insurance, but it only covers the wheel if the rim is bent to the point that it won't hold any air with a brand new tire on it. it's bull****, but i'm going to try first thing in the morning once anthony (b&a motorsports) takes a look at the car. updates to follow.

    No experience in actually doing it, but to my understanding you can only claim against the state for a pothole if the state has been notified of the problem, and did not do anything about it within xx days. There is no neglect if they are not aware of a problem.

    So, technically, the only way to recover would be if you see a pot hole on your street.... you notify the correct state department, in writing of course. You wait the allotted amount of time in order for them to make the repair. They don't do it, and THEN you hit it and bend a rim.


    I highly doubt you have any claim unless the exact situation above occurred.

    Tried when I bent a wheel on my vette years ago, save your effort. the $ they will give you vs the time you'll have to put in to get it is not worth it. I put in 10 hours of trying all to be denied twice.

    Waste of time. I f'ed up a Brabus rimm bad on the Parkway and I was literally laughed at when I tried to recoup some $....Save your efforts imo

    The only time this becomes a bit easier is when it occurs in a construction zoned area.

    There is a Bond that is placed when construction commences and damages are withdrawn from those monies. I had an incident on the GWB with some debris when they were painting the span. Called the Bridge and Tunnel authority, had the car inspected and they cut a check for the full estimate.

    May have been a rare occurance as I have also gone after the city of NY for damage and been laughed at (not really but the same discussion regarding reported vs time to repiar was the reasoning behind the denial of payment).

    Good luck bro...nothing pisses you off more that hitting a hole in the road and the resulting damage.

    Report the pothole, wait the mandatory time, check to see if it was properly fixed and if not then report the damage. This seams like the only way to have a chance at being reimbursed. Try and not pay the state if you inadvertently damage a light pole or other property they or really I should say we own. Loads of hypocrisy here.
