Question on probation and restitution

    My girlfriends ex is/was on probation for stealing from the WIC program. He was given 5 years probation for this felony. He was also ordered to pay $70,000 restitution. We doubt he has paid little if any of this $70,000. Will his probation be extended?

    His new thing is driving to Chicago and picking up things like candy bars and selling them to local ma and pa convience stores in SE WI. Most likely for all cash. Still ripping off the government.

    Most places work the same way, if he violates any aspect of his probation he's back in the clink for 1, not obeying the original order and 2, breaching probation, which is a separate violation. So it's basically a double whammy, he'll get dinged twice if he doesn't comply fully with the orders. What did he do to only get probation for a felony that amounted to $70,000? It sounds like he got lucky with a judge.

    Great point above. Get rid of this guy, forever, in all aspects. And don't look back.

    In any event, it comes down to a pattern of effort. If the sentencing judge doesn't see a consistent pattern of paying back the money on time, he could go back in come the end of his probation. Sounds like he's out there, so he's probably going to do some time.

    If he was stealing from WIC, sounds like there might be a kid involved, making it somewhat harder to rid oneself of him as that kid may be her kid too.

    If he's violating his probation, and restitution is a condition of that probation, the government will catch up with him sooner or later. However, if they toss him in jail, he ain't gonna make any more restitution is he? So what sense would it make for the state to toss him in jail? NONE. They'll slap his wrist, give him a warning and let him try again.

    Rinse and repeat this as often as his violations continue. They're not gonna toss him until they are positive he's never gonna pay them back. And even then, with the jails all full up, he'll spend very little time there.

    To the OP, you can PM me if you want, I work with a top criminal attorney in Milwaukee and can answer most things you'll need...PM me his name and most likely I can search it for you (I'm a law student in my last year and work criminal cases). Honestly though, why on Earth would you even care? Unless he is bothering you in some way, it would benefit you mentally to just distance yourself from the situation.

    Just so everyone can keep perspective, ripping off the WIC program is very common. I worked on one of these cases not too long ago...the guy ripped off WAY more than 70k and only got 5 years. He only got time because he refused to cooperate with the government. Usually you won't get much time because in the grand scheme of things, his infraction is really not that bad. This would have been charged federally, and to be honest, the feds have a lot bigger problems to deal with than the WIC scams.

    He probably only got probation because he agreed to talk to the feds about who he was working with and how the crimes were committed. Plus if he hired one of the top attorneys, the judges are usually pretty easy on them because the attorneys can make it very easy on the court to get a plea. As for what will happen to him, he will eventually get his assets ceased by the fed. gov. and sold at auction. If he was convicted federally, which I assume he was since its a federal program, restitution is separate from jail time, he won't go to jail for not paying.

    Actually no, if he was ripping off the WIC, he probably worked for or owned a convient store. There's a few ways you can rip off the gov, most common are; 1) you buy stolen baby formula or whatever from out of state, make false invoices, sell it for food stamps, then send in the stamps to the gov for reimbursement...2) pay crackheads $0.50 on the dollar for the baby formula, ect. they buy with their stamps then sell it for full price in your store.

    And why would he be driving to Chicago to buy candy bars, where petrol prices are the highest than they've ever been and sales tax in Cook County is the highest in the nation?

    Absolutely, and for some reason you never get to hear the other side of the story (there are always two sides)!

    If a woman comes into your life with 'baggage' that occurred before the two of you became involved, let her handle her past; and that works both ways too.

    So....have her report him to WIC, if she has proof of her allegations.

    I'm curious how he got caught exactly.

    I have zero proof of the following.

    I've been told by a very good and reliable source, who was told by another very reliable source that someone we know (suppose to be friends of mine) who could be cheating the system. Supposedly there is something mothers can sign up for whose babies daddies are no where to be found. And all you have to do is go to some class once a month or something. And you get lots of "free" baby products.

    Problem is this a huge lie. Dad is around. These are people who have helped me get through a tough time in my life and lent their ears and words of encouragement to me. Then something happened and I sort of wrecked the friendship, and I have more or less redeemed it. Now I hear this and I feel like if it is true I don't want anything to do with them. And that it's like the old adage "Everything happens for a reason" is so true.

    My question is though, the government is bound to find out whose cheating them and whose not most of the time. Correct?

    He is an Arab. He also owes over $60,000 in back taxes to the Feds. My girlfriend is now trying to see if she is responsible for any or all. She always claimed 0 on her deductions. He had the taxes done when they were married and told her to sign here. She did not know she could do her taxes individually although had she tried he would have made her do a joint filing anyway. So she is wondering if he would still be on probation if the restitution was not paid. She stayed at home and raised the kids. He sent a lot of money home to the Middle East to his family. He gambled some away and slept around yet he allowed her to do nothing. He owes a lot in child support. He pays $100 every 90 days. Just in time and just enough to keep him out of jail. A truly bad guy. His kids want nothing to do with him. He has done so much to hurt them. He has little or no assets. Anything he would have would be under someone else's name. Possibly his girlfriends.

    I've known my girlfriend for 10 years or so. I worked with her at the hospital. She moved here from Tailand when she was around 10. She is loved by everyone at the hospital or anywhere she goes. She is very sweet. Honest and ethical. She married the worst guy.

    You would need to speak with an attorney barred in that state.

    Take non-attorney advice from a forum with a grain of salt. Attorneys not barred in that state can not offer advice on that state's laws. The same goes for non-attorney's that work for or are "under the supervision" of an attorney barred in that state.

    His probation will mots likely me extended along with the possibility of jail time. If he is still doing the same thing, it leads to be believe that this person is a career criminal. Also, it doesn't appear that he is cleaning up his act and I'm doubtful he will pay back the money he owes the the government. In my opinion, do not get involved and make sure your girlfriend clears her name with the IRS.

    Don't pass judgment until you know the whole truth. By the way, if you think some of your exes "were losers', it only means you have made poor choices. Do you think they could be saying the same thing about you?

    One-sided testimonies are meaningless..........
