Hi, Just wondering if anyone would have some info for me. I got a speeding ticket about 3 weeks ago, one of those they jump in front of you and signal to move over and they get 2 cars at a time and write the ticket and tell you to go on your way. I havent gotten a ticket since 2004, so i figured it was time, and thinking the ticket would be around $125-$150. but I find out it is $220. It will hit my pocketbook a little more than i expected. My question is I noticed when i got all those advertisements from law offices for the ticket that they misspelled my last name and i thought it was just the law offices mistake. Now looking at my ticket that the officer wrote out my last name wrong, i did not notice it at the time, he gave it to me. But I seemed to recall rumors that if the cop mislabels, mispells anything on the ticket then the ticket can be fought?? Don't know if it is true or not, I dont know any lawyers that will confirm this. I have no problem paying the ticket but i just cant believe how much it is. for those intrested i was going 50 in a 35. and this was in dallas. Any advice if this is true and if so how do I go about getting it done, i think I only have 21 days to do something, which would be this Thursday
Get a lawyer to plea bargain it down for you. I've had great success in getting this done. I don't live or get tickets in Dallas so I can't tell you who to call. Ask some of your Dallas friends.
i use Villasana & Gore here in houston. it's something rediculous like $50 to take your case. In the last 4 times i have used them, they have gotten me off scott free. and to answer your question about the mispelling of your last name, i think they would throw that out.
Get a lawyer. Or, just pay the extra $50 or so over the cost of the ticket and do deferred adjudication. 90-120 days of being ticket-free and it all goes away. These days, nothing interferes with the collection of revenue. Even if the name, car, location, etc is wrong you'll still be on the hook.
In Dallas I use John Gioffredi (214) 739-4515. I am a Lawyer and still hire him. Worth it every time and I get ticket avg once a year and have clean driving record.
Same situation I got in on 820 in fort worth. No questions asked just picked me out of traffic and told me to get on my way. Which I still don't understand considering everyone else around me was going the same speed. Anyone notice an ever increasing presence of these speed enforcment cops in dfw. I never saw it like this in houston! I went ahead and took defensive driving, But I do know if I had been in houston I would have used SPRECHER, For 100$ he will take your ticket to a jury trial if he needs to! Sorry for the rant but, I would also like to know any good attorneys here in dfw who specialize in traffic tickets. Chances are Im gonna get another one.
I agree with this with the exception that I have asked for jury trials before and fought them and am 1 for 2. Takes alot of prep but really gives you experience for the next one.
I got stopped in a speed trap yesterday on Northwest Hiway west of the tollway. I was in the far left lane and the cop stood out in the highway and motioned me over, dangerous move on his part walking across traffic. Why do they call it Northwest Highway when the speed limit is only 35? The other car that was getting a ticket was getting towed, probably for lack of insurance. First ticket in 20 years so I have been fortunate but $220 seems steep.
Just a update, so i talked to a few lawyers and they said that the cop mispelling my name was not a big deal. So thursday I went down to lew sterit to pay the $219 and ask for differed judification or defensive driving... they told me the only option I had was to pay the ticket and it will be on my record, or get a court date to ask for differed judification or defensive driving, I was shocked. I guess my other tickets were in lewisville and richardson, she told me that the city of dallas is the only one that makes you go to a judge and ask for defensive driving or differed judification. The real kicker is my court date is set for July 1st. If i was able to get differed judicfication now morethan likely i would of been done with this crap by then. So now I think I am going to get a lawyer just to try and get it dismissed or something.
For the first time in my life, I was pulled over and given a verbal warning, no citation. Hooray!!!!!
My last 2 tickets in Dallas, I asked for a court date, and ended up getting both dismissed. You do have to show up early for roll call. Then be sent on break for and hour. Then back in the court to talk to the DA when they get to you. One was a school zone, and another in a speed trap on Kingsley just east of Audelia coming down a big hill. I think they size you up while you are sitting on your ass, and decide who they are going to let skate. Both times they have announced a group of us that got dismissed. Didn't use a lawyer or cost me a dime, but plan on a 1/2 day of waiting. I think you can request a change of court date too for comflicts. My shortest deferred so far was a 1 month I got on the last Ponder run in my nephew's M3, which I totally blame on dryhole. Good luck!
I've fought a few tickets in my day. Thank God that the officers didn't show up at any of them, and if they don't show up to the hearing, the tickets are dismissed. Mine were all dismissed. It's worth a try...
