My experience with my 430 today.

    I was out and about with my friend, enjoying my car when I glance in the rearview and see flashing red and blue. I know I wasn't speeding because I was following a city transit bus. I pull over, get my license and insurance out and wait for the officer to approach. I should add that both my friend and I are African American, which is what started this whole situation. The officer walks to my window and asks my friend and I to step out of the car. So we both step out, and walk to the back of the car. I hand him my papers and wait as he walks to his patrol car. I see him on his radio, and I figured his computer may be down and he needed a check on the car. My friend and I are standing for about ten minutes when another patrol unit pulls up. I might add that I am a lawyer but the whole time I do not mention my practice, its the best thing to do when you are in a sitution where your rights are potentially being voilated. Both officers approach and tell us to take a seat on the curb, and we do so. One officer walks around my car, glancing inside. Trying to find something, most likely weapons or drugs in plain site. The other officer watches us. He then presumes to question me on my occupation, he suggests drugs. I kindly decline and tell him I am a banker. I already have the making of a law suit on my hands, so I don't want to scare the two officers away. The one officer who is checking my car out, calls outloud that he has noticed something suspicious. (Often officers use this as intent to search a vehicle). He then asks if I would grant permission to let him search my car. I agree because I know that the second he does, he has voilated my rights. He searches top to bottom, opens every compartment, opens the hood, blah blah blah. Takes about twenty minutes. And then comes back to me and says "Look boy, I know your kind, and I know your not a banker". I just sit and keep quiet, taking note of everything little thing he says and does. The two officers walk back to the initial patrol car, and talk under their breath. One makes a radio call and comes back and tells us to sit still. A third car, marker (K9 Unit) comes after fifteen minutes, and without any intent, they let the dog have it. The dog jumps into my car, and the officer points out various locations. Nothing is found, so the officer walks it around the exterior of my 430 numerous times, and yet again nothing. I remain calm and collected, gathering information. The three officers then walk up to my friend and I and the same officer who made the racial remark earlier said: "You got away this time n****r, but we'll get you next time". The officers jump into their vehicles and proceed to burn rubber. My friend and I jump back into the car, and realize after five minuted of driving that the officer is following us. I drive safe and slow all the way to the local safeway to get some steaks and other various BBQ goodies. We come out and finally the officer has dispersed, so we thought. I begin driving back to my house, and there he is again. Following us. Again, I play is slow and safe and finally reach my house. I drive into the driveway and into my garage, close the door, grab my camera and snap a few shots of the officer in his car sitting outside my house. I got some very detailed shots of the officer himself, knowing this is hard evidence in court. Eventually he leaves, I'm sure he was waiting for some traffic to appear.

    This has never happened to me, although I have delt with many cases that are similar. Abuse of power and discrimination. I'm putting a case together, and going after the three officers with everything I have. I find this whole situation quite humoring when I really look at it, but I can already tell my damn car is going to get me into trouble.

    Sorry you had to experience this. But you handled it well. Now get your case together and do everything you can to get them removed from the force. They don't deserve to be police officers. Good luck.

    wow dude, that sucks. I hope these rednecks get fired.

    You may want to look into getting copies of the dashboard camera tapes (if there are any, cowards probably switched them off).

    I like how you handled the situation and kept your cool. But, especially as a lawyer, wouldn't you know better than to post this on an open internet forum..since you are supposedly trying to turn it into a case now?

    I'm not a lawyer, but I thought if they ask to search and you give them permission, that is ok?
    How does that violate your rights?

    Im interested in your what your case will be, is it based on lack of probable cause or something?

    Maybe it's just me, but I question this story. I mean no offense and, if it's true, it's a terrible situation.

    But it doesn't ring true to me (I've never seen an attorney refer to a "lawsuit" as a "law suit" nor take the automatic position that an officer's search of a vehicle, after having been granted permission, represents the violation of any rights). This post just doesn't appear to be written by any kind of attorney I've ever dealt with (and as the CEO of a large company, I deal with them every day).

    I'll add that I'm also sensitive to the portrayal of police officers when I sense that something is not quite right. I certainly recognize that there are bad cops out there (just like there are bad doctors, janitors and short-order cooks), but I also recognize that most police officers are decent guys doing a very difficult and very dangerous job... one that I am unwilling (and probably too afraid) to do.

    Again, no offense. Just my $.02.

    Sounds like you handled it well but I would keep your safety in mind at all times should this happen again, ESPECIALLY at night... Also, depending on the size of your city, word about you may get out and the force may try to make a point of harassing you constantly... You would be an easy target in such a visible car... Just my $0.02... Hopefully it will not happen again but it probably will... It sounds like you are well-equipped to deal with it.

    This post is 100% bull****. The OP couldn't pass basic undergrad muster with his grammar and spelling, not to mention the great divide between that and the LSAT. Couple that with other very large flaws in his story and we've got something that is a flight of fancy made up by some kid somewhere.

    The whole situation, if it is true, cold have been stopped by answering "lawyer" when he asked you your occupation. Handing him your card at that time would have changed the way he did everything. P.S. if you give them permision to search you car, then they haven't violated your rights. If you said no and they did it anyway, without probable cause, then that is violating your rights.

    None of this adds up at all.
    1. We never learn or you never explain why you were initially stopped in the first place.
    2. You seem to want to blame either the police or the car for your problems and maybe explanation of #1 would help in this.
    3. You flatly assume you were pulled over because you were black.
    4. You gave them permission to search your car, what rights were violated? You say you're an attorney? lol.
    5. You gave false information to an officer. You state that you're a lawyer but told him you're a banker.
    6. The portrait of these offending officers is absurdly hyperbolic. Calling you "Boy" and "N***er" and stalking you back to your home, questioning your ability to earn a living that pays for such a car. It's just all extremely over the top and frankly to the reader (because at this point, let's be honest this is pure fiction) unimaginative.
    7. As previously has been pointed out, a lawyer calling out his ability to such things as "I already have the making of a law suit on my hands, so I don't want to scare the two officers away." And I also liked you stating after this horrific experience: "I drive safe and slow all the way to the local safeway to get some steaks and other various BBQ goodies." You are trying to write slapstick, correct?
    I didn't even know they offered law school online.

    Don't insult our collective intellects with this mediocre attempt. Now go play with your F430.

    there is no way a lawyer, would LIE and say he is a "banker"...no shot...there are other red flags..but that one is most glaring to me..
    why not say you are an attorney?..please..
    looks like it was written by a 4th grader..

    +1, what's sad is that it is possible (maybe not likely, but possible) that this situation could actually happen to someone. Making up stories like this offends people who have actually had their rights violated.

    "I gave him permission to search my vehicle knowing that when he did he would violate my rights"..........so if I tell them to put handcuffs on me I can go after them for false imprisonment? Hmm, I'd love to know what law school this Hemingway of the internet went to. And fwiw, how about some paragraph breaks in the story?
