Any recommendations for a speeding ticket attorney in NYC?
Casey Raskob at www.speedlaw.net . He's my tristate area Ducati group's go-to guy. I can tell you what he'll tell you first: postpone your hearing date as many times as possible. You get one or two postponements (simply call the # and tell em you need to postpone). Problem w.NYC tix is that their traffic is handled by DMV, not the courts, so it's an ALJ not a real judge. As such there is no plea bargaining/reductions, so esp w.speeding, it is what it is. This is why the best strategy is to postpone. Do this: 1. call in, get a postponement. 2. Show up to that hearing and state now you want an attorney (they'll ask at the start of the time block. They'll adjourn it once more, but you have to pay a bond ($60?) you will get back if found not guilty. 3. At the next/final hearing hopefully the ticketing officer won't show or won't remember/have notes, and you're good. I used this strategy for a moving violation and through this method the hearing was over a year from the date of offense. I.E. time is your friend. .
81 in 50 on way to work 9:45 pm thursday going into the bruckner high way cop ,I must appear for this with in 15 days , but in looking at the ticket he made a mistake he used the same date for my renewal as for my birth day? Can I get it tossed?How to play this?
Some good advice here but the standard is not "beyond a reasonable doubt"; it is "clear and convincing evidence" which is a lower standard and unless the cop really sh1ts the bed in terms of his/her testimony then you're screwed. Best bet is to hope cop doesn't show as you can't plead it down in NYC as you can in other courts. Comes down to being lucky.
If your Drivers License info is correct then there is little you can do mistakes suck as vehicle color ect will do little to convince them that it was not you that was there and you who commited the act.
Great advice here. I have a friend who was a NYC motorcycle cop for 20 years. He never gave a ticket for under 70 because he hated to go to DMV court. He figured that 99% of the time someone going 70 in a 50 wasn't going to fight it, and he told me he was right. The 1% of the time he was called he blew it off. Now, if they are giving out coffee and donuts to the cops at DMV, that all could have changed. Please keep us posted.
