    Completely unacceptable. Morally reprehensible on ebay, but expected there. Here, simply unacceptable.

    My rule of thumb is used in good condition = 1/2 retail (unless unobtanium). You paid what I consider top dollar for crap when good is readily available.

    Unacceptable.

    Surely it's not defamation to say:

    "________ sold me this wheel for $400 + shipping, and I was dissatisfied upon seeing the condition of the wheel."​


    That's merely a statement of fact. I thought defamation was only when someone started publicising subjective statements or opinions. :eek:

    That is totally unsatisfactory. I sure hope the seller is not a Hurricanes fan, no need to add to the feud! I'd say out him, nobody else should have to deal with this type of seller. When I sold stuff to other Fchatters I would always send the item without payment, then after they got it they could send the money or return the item. Sorry you are having to deal with this nonsense!

    I posted a theory, it lost it's primer...there's about four different coats of "stuff" to Factory prep the wheel, from bare metal.

    Does accuracy of the statement affect the outcome of the action? Presumably, if the statement was completely true, then there isn't much of a case.

    I remember the sale,, and the string too..
    But, I am not going to post it. (yet)

    I was trying to sell MY PERFECT 308GT4 Light Weight Spare also, but that dude undercut me for a price of $ 400.00,,, now I can see why. That wheel is junk.

    Here is mine for sale, some patina, but perfect and never been mounted.
    (aka,, a "Virgin.") 1/2 price as requested,, cheap.

    Ok, Art may have practiced law a lot longer than I did, but truth is the defense to defamation charges (either slander or libel). So, perhaps I'm not seeing what's actionable against statements of fact. It doesn't mean defamation can't be alleged, which the party would have to defend against. But, Art, unless I'm missing something, what, specifically, is the problem with what was written?

    But, I agree with Art that the proper way is not to disclose the name, to file suit and link to it. Of course, that's a very formalistic approach, and I understand that you're trying to handle this in a gentlemanly manner. Sans attorneys, so to speak.

    Don't get lawyers involved.....I have a feeling that he will be outed without you having to do anything at this point.

    I think you purchased the wheel on ebay?...You can always do a formal complaint through ebay (which almost ALWAYS works in favor of the buyer) and not spend a penny on Lawyers.

    Anyhow, the guy knew exactly what he was selling you and he is a real idiot to think that he could get away with that crap. Good Luck.

    Who in their right mind would file suit over $400? The opportunity cost alone in pursuing such litigation, on top of the low percentage of ever collecting on an out of state judgment, makes it a losing proposition.

    HOWEVER, I want this guy outed. Somebody needs to post the thread and the link. It is what it is. This guy sold a wheel that could pass for relic from the titanic for $400.00 to another f-chatter. This is a giant breach of the code of honor among Ferraristi and F-chatters as alike.
