    NO!!!!! I can not believe the court ruling.

    This is absolutely INSANE and the legal system is totally BLIND on this case.

    I think you should sue BECU and Hensrude and everyone else, big time.

    Can WE help you with a legal FIGHT??

    I am willing to donate to the cause and I am hoping that other Ferrari/exotic car
    owners will step up too. I'll pledge $500 to start get the ball rolling.

    Is there a lawyer here on FChat who is willing to help Joel out?

    We need some local media to cover this story too.

    I've got to agree with everyone here; this is a huge injustice. Surely you can appeal this. There is no way someone should get away with this. Man... I'm really sorry...... You didn't deserve this.....

    You should send a letter or call the PI and have them run an article on the injustice of the legal system and how it worked against you. Maybe it would hurt the guy who sued you for YOUR car....

    I will never understand how people take advantage of and cheat people. It's just sick.

    What a f*cking outrage! Joel, I have known you for a few years now, and I am just floored at this turn of events. I would have thought this case would have been dismissed ages ago...you are the victim after all! I hope and pray that Karma has it's day. Hang in there man.

    PS: I agree, call the reporters that ran the original stories on Tyson Spring, this would make a good follow up story. Might put a little public pressure on the KingCo Prosecutor's Office. And on Mr. Hensrude; how he got a "double dip" I will never understand.

    That is just sick -- I'm so sorry Joel; I thought for sure that you'd win this court case easily with a summary judgement. Was there a jury, or was it decided by a judge/panel ?

    Wow. The system has let you down very badly; I can't believe the injustice.

    I'm speachless as well. I agree that 1 party should get to keep the car (you0 buyer should have a judgement against the Tyson. DA (spineless & gutless, not man enough to walk be hind me and smell my farts) should have to answer to the press for the lack of action on this case.

    Sick I'm just sick of this crap and bad guys keep moving on.

    FYI, Revenge is sweat when given directly and quickly.

    First try the law, then man up and take care of business yourself. Sounds childish, but don't knock it until you've done it.

    I am terribly sorry to hear of this. I think I would be violently ill after hearing the judgment and simply violent thereafter.
    I don't believe this is over. I believe there are other avenues.


    Just read the story of the jackels at Huling Brothers in West Seattle. Look what the press did with THAT story.
    I think this is probably one of the most powerful courses to take. Widespread exposure does wonders for a person's lack of accountability and conscience. If nothing else it will raise awareness.
    I'm not above "helping" Karma.

    Looks like they have 12+ locations, plus a corporate headquarters. The earlier story tried to make it sound like he was under undue hardship cause of the loan he took out to buy the car. Doesn't seem to jive with a guy that owns all that. Ah well, better safe than sorry, I'll avoid them.

    Here is the second $500.00 pledge if you want to peruse this matter further.

    I have followed your case for the last couple of years, and am in disbelief at the outcome. It is such a clear cut case at least in my mind, it’s hard to believe. If you plan to peruse the case further, I would dissuade you from talking about strategy on a public forum, but a couple of things which our group can do;

    1.) Everyone write a couple of letters strategically spaced apart to the Hensrude / precision collision, dirt bags, stating that you will never use their services, and you will tell NO LESS THAN 100 of your affluent friends to do the same. Getting their attention where it will hurt most, we could easily remove 100k / year from their pockets, especially at this critical point in our economy.
    2.) Write the DA and AG letting them know you plan to take your story to the media.
    3.) Write a letter to the media outlets give one an exclusive on the story if they will publish your story.
    4.) ***We need to have an attorney draft a seller’s contract which can be used on a consignment basis in order to protect ourselves in this situation. A contract which maintains ownership until funds have cleared or something like this.***
    5.) Our club should vote on donating some club funds to this situation at our next meeting. It benefits us all against unscrupulous dirt bag dealers.

    If the judge issued a written opinion describing the reasons for the decision, I'd sure like to read it. It may be a straight reading of the Uniform Commercial Code that gave him no leeway, but I tend to doubt that. He might also have explained his decision from the bench and, if there's a transcript, that could help to understand what appears on its face to be a miscarriage of justice.

    This is one of those cases where two of the three parties acted in good faith and the bad guy in the middle goes bust and a choice must be made between two well-intentioned, innocent parties. Generally, courts don't make the decision "Oh, they're both good guys; let's just cut it down the middle." They have to decide the issue and apply the principles. There's an old expression "Hard cases make bad law." You need to have a consistent application of legal principles and if you bend them because the case cries out for justice, it sets precedents that allow others to work the bend even if their situation isn't as outrageous. Judges have to make calls they don't like in their gut, but the law demands it; that's what the "rule of law" means and, believe me, judges lose sleep over cases like that.
