    Since a Judge ruled that traffic cameras are illegal, the cash hungry City of Aventura has turned to other ways of collecting additional revenue. Say hello once again to the infamous Police Department, proudly enjoying one of the worst reputations in the state.
    This time, their victims are bicyclists. Yes, human beings pedaling. Early this morning a task force of 2 sparkling Crown Vics and a black Chevy Tahoe, pulling over and writing tickets to cyclists, who according to them, block traffic lanes and run red lights. This daily hunting bonanza, has become a routine pastime for the Aventura P.D. boys.
    Since the number of cyclists who train during early morning hours and received tickets is very large, we've decided it's time to seek legal counseling.
    If any of you happens to be a good attorney, willing to take many cases like this, please send me a PM.

    I lived in Aventura for a few months last year. I literally saw a squad car on EVERY corner. It was ridiculous! Good luck with this.

    How much do they charge for a ticket on a bicycle and do they put points on your driving license?

    What would happen if you didnt have your license or ID on you and refused to provide it or told them that you lived in another state and gave them a fake name?

    I wouldnt seem fair that someone with a license would have to pay more by getting points than someone that didnt have one.

    I heard Adventura is bad, next they will be going after jaywalkers.

    What is the information about the traffic cameras? I have always believed that they should be outlawed based upon being unconstitutional and violate the sixth amendment.. Right to face your accuser. I believe that everyone who paid one of those tickets should get a refund.

    Red-light cameras in Aventura get stop sign
    A Miami-Dade circuit judge ruled that Aventura cannot use traffic cameras to issue fines under state law, but the issue will likely remain in a legal limbo for now.


    The cameras installed on traffic lights to fine red-light runners -- which cities love and drivers hate -- may be in legal jeopardy, after a precedent-setting ruling Monday by a Miami-Dade circuit judge.

    Judge Jerald Bagley's decision that Aventura cannot use the cameras to issue fines under current state law is a defeat for South Florida cities that are trying to promote safety -- and raise money to shore up their budgets.

    While Bagley's oral ruling won't resolve whether the camera programs are legal -- Aventura is expected to appeal -- it opens the door for future lawsuits and the possibility of cited drivers getting refunds.

    ``Right now, other cities with red-light programs could be subject to class-action lawsuits,'' said Bret Lusskin, the attorney who represented the plaintiff, Richard Masone.

    Aventura -- best known for its shopping, condos and traffic -- plans to continue issuing citations using the cameras, at least until Bagley puts Monday's oral ruling into writing. The written ruling is expected in about one week.

    ``Until we see the actual written ruling, we will continue our program as is to protect the safety of our residents,'' Aventura City Manager Eric Soroka wrote Monday in an e-mail.

    Aventura began issuing fines from its camera program in October 2008. Its fines start at $125 for a first offense. The city has collected more than $1 million from the program.

    Masone, 36, was cited twice in January 2009. He hired Lusskin to sue Aventura.

    ``It's a revenue thing that they're doing, and I think it's unfair for the people,'' Masone said of Monday's ruling.

    Lusskin, of the firm Ticket Cricket, argued that Florida law says only the state Legislature can pass traffic laws, while cities can regulate traffic issues of local concern, such as parking.

    Cities have used the cameras, which take pictures of a car's license plate, to cite red-light runners with a code violation, instead of a traffic violation. Code violations, like parking tickets, do not penalize a driver with points on a license.

    Lusskin argued the cities were using code violations to circumvent state law and that cities can only issue violations to red-light runners when an officer is present.

    Bagley sided with Lusskin.

    The attorney representing Aventura, Michael Popok of Weiss Serota, said the judge's ruling only addressed whether cities can issue fines based on the red-light cameras, not the presence of the cameras themselves. State law says cities have the power to use ``security devices'' to ``regulate'' what occurs on the roadways, Popok said, and the issue is whether the word ``regulate'' gives cities the authority to issue fines.

    ``If the city decides to appeal, that's the issue we're going to take up,'' he said.

    While red-light cameras have been at the center of a slew of lawsuits in Florida and across the nation, this is the first ruling in Florida.

    Some states, such as Mississippi and West Virginia, have banned the use of red-light cameras. Others, such as Iowa, have declared the cameras permissible.
