Question for those more seasoned than me: I am looking at a car in upstate NY. How exactly does the process of transferring an out of state title to NC work? The current owner does have an existing lien. Can I not do the paperwork (and drive the car) until the lien holder processes everything and sends the appropriate release? How long does that usually take? Any insight appreciated, --MarkS
Mark, The process in NY is that the owner of the vehicle needs to payoff the lein amount, and he/she will recieve a notoraized and signed lein release letter from the leinholder (bank). Once that is recieved (usually 5-10 days), and the back of the NY title is signed, you are safe to pay/recieve the car. You would then take both the title and lien release letter to your local DMV with a bill of sale. To be safe, I would recommend making sure that you have both of those documents BEFORE you pay for the car in full or take delivery. There are 2 ways to drive the car home. One is to drive it with the current owners plate and then mail him the plates after you get home. The other is to have a NY dealer do all the paperwork and give you temporary "Transit" plates to drive the car home. Most dealers would charge some fee to do so.
