    It's official. Ferrari spa have sent a letter to the FCA, informing us that we are to STOP using their name (FERRARI), their logos, their colours, prancing horse design and the "F" trademark. They have given us 12 months to cease any use. This of course gives us 12 months to re-lobby the members to SIGN their document.
    So I say to all you on here that were saying "that they can't stop us using their name FERRARI, in our name Ferrari club australia.........YOU WERE WRONG

    So, when the RTA or VicRoads sends you the registration of your car... do you tell them they can't use the word 'F######' because it is trademarked, copyrighted and blessed by the Pope? :D

    are you really saying that we should go to court against Ferrari Spa. (they also mention in the document that they have looked at the trademark act of 1974 in Australia and have sent the document as a demand that "we stop using the name FERRARI in any car event or correspondence etc.etc. BUT we do have 12 months to re-negotiate with them. But I would suggest that the "re-negotiation really means sign the document".
    The letter is what we were expecting anyway and is nothing new.
    It basically is a case of a letter of demand from Ferrari Spa (with a 12 month window), and then if we don't sign AND we don't stop using their name, then they will take us to court and the club just doesn't have enough funds for a massive court case with Ferrari SPA.
    And I for one don't want to go to court against the factory that made all my cars.

    I have no dog in this fight.....but recently the Big US Company that claimed it had total rights to the name/logo "Ugg Boots" took the Oz manufacturer to court here in Australia................and lost!


    The US pool cleaner manufacturer "Kreepy Krawly" too a little Oz pool shop and manufacturer to court(Zoltan's)here in Oz.................and lost!

    Maybe the FCA doesnt have the dollars for a legal fight with Ferrari Spa but I'm damn sure that there would be a lawyer/lawyers in Oz willing to fight them in court for nothing!


    I don't think Ferrari Spa would win this one as easily as they might think?

    This sucks and is all about $$$, greed and control!

    the multi-national will win, they do often.

    At the end of the day the owners will align themselves with the manufacturer, those that dont want to, well they will be excluded from events.....which is status quo at the moment, being a member gives you some rights to events (excluding the mackie rally).

    What is there to lose? control? control of what?

    the other side being what does the manufacturer do for us? Do we get cheaper servicing costs or cheaper parts?........NO

    And in time they could say that those cars that dont have "classique" certification cant turn up to official events......I doubt they would go down that road.

    One thing I learnt at the national rally was that as an member you cannot be excluded from events regardless of what you drive

    except for mackie rally and anything to do with NSW club

    Suspect they're trying a bluff with the name by tagging it on to the trademarked stuff - if the club is called Ferrari Club Australia WITHOUT any reference to cars, prancing horses, the typeface etc, then FCA has a legally registered name in this country out of SpA's control. AND if I recall correctly, they've already lost this battle in Australia once with a shoe company "Diana Ferrari".

    we cant even get enough people to pay 700.00 to go on the national rally and you expect them to throw in 5k............like thats one months payment on a 430

    No, did that already. Too many people confused me as a dentist on the way to the golf club. As my backside is getting bigger later in life, I like getting in and out of the Mulsanne better than crawling into the 308.
