My First ticket...silver lining

I received my first ticket in my 458 for 50 est. in a 35. The silver lining, my radar jammed worked and my true speed was not recorded on the ticket.

 

You do know the "model specific sections" of F-Chat are Google searchable, right?

Radar jammers are not legal anywhere. Just do not get caught. They violate FCC rules.

 

You sure about that? I've always heard the opposite. Seems weird to even have a product for sale that is illegal everywhere.

Would you guys be able to post some proof about jammers being illegal everywhere? Not trying to be difficult, but the guys of lidar link appears to contradict that. Nearly every laser jammer site I've checked seems to confirm this.

Radar jammers are different. Some officers even have jammer detectors.

 

I heard radar jammers don't even work well.

 

I used to sell the laser jammers. They are legal in many states. It is the RADAR jammers that are illegal period...

I mixed mine up. It's the opposite. Laser jammers are legal in certain states and radar is legal no where.

 

It is a laser jammer. It constantly sends laser lights out which confuse the laser being sent. They are discreatly installed in front and back. It worked. There is no laser speed on the ticket, just a 15mph over speed limit approximation. In other words, the section for "Radar/Lidar" has a dash through the area for numbers. The police vehicle was new. They all have lidar (laser). I am glad it worked. I also could not find my insurance, which necessitates a fix it ticket on top of this. Again, could be worse.

where did you get the jammer?

 

fwiw laser jammers aren't legal in Cali either. The escort 'shifters' are kind of a gray area. Many states have laws that prohibit anything electronic that prevents the measurement of your speed, so that covers everything. However the shifters are a bit more stealthy, they turn off after a few seconds of being hit. They don't prevent your speed from being measured, only 'delay' it, because if the officer hits your car a second time it will be measured accurately. They might think they just didn't hit your plate right, hit it again, see that you aren't speeding and pay no more attention to you. But something that jams 24x7 is just inviting trouble -- A full time jammer will prevent an officer from measuring your speed and anyone's else near you (ie on a busy hiway), and that will surely upset them.

Like you said they can just estimate your speed visually so IMO they're not as useful as they may seem.

 

I would be interested to find out if you fight this ticket if you will win or lose?
They have no proof of your speed only his estimation (just a guess by the officer) which hardly seems air tight to convict you.
If all a LEO has to do is write tickets guessing everyones speed then why should they even use radar/laser guns?
They can just drive around ticketing anyone and everyone if they don't need proof which does not seem logical or legal.

 

darkkaangel I have gone down this path before and what I have concluded is unless you have a really good traffic attorney the state can do pretty much whatever they want. The Hiway Patrol/State troopers have special training which allow them to estimate speed, and the judges tend to side with the officer. The sherrifs/local cops typically do not have this training so that is easier to argue. Is not exact but its fairly easy to spot someone going 50 (or more) in a 35, even easier on a busy hiway. I just pay the fine and be glad for the times no one was looking

 

Yes. If you try to fight the ticket you will almost certainly lose.

But besides fighting or pleading guilty, there is a third tactic to keep in mind, if not now, then for the future. Plea bargain. Let's say you are cited for 73 in a 50, and you live in a state where there is a penalty drop for less than 15 miles over the limit, whether it is less dollars or points or noninforming of your insurance company. Show up early at the court and look for the ADA. He or she is very anxious to clear the docket so they can get out early. Tell the person that, "Look I was going a little fast but I really don't think it was that fast. I'm willing to plead guilty to something like 62 or 64 in the 50 zone." The odds are very good that you will get an instant plea bargain at what you suggest or a little higher. Sign the ticket, pay and go home.

I have done this several times over the years. In each case I got it down. But warning, if you are a habitual speeder with a long "tape" they may nail you.

Alas the law makes no distinction between a 458 Italia at the breakneck speed of 50 mph and a wheezing Hyundai subcompact with miniature brakes. Like humans, all cars are created equal under the law. (Sigh)
