It has been on the market for more than a year now with no takers so far. These two are 375 MM's, of course, not 375 Pluses. I think unfortunately there have been a significant number of posters on this thread that are not interested in any constructive discussion of the cars history. My only guess is that for them it is more important to use some sort of game playing to accuse or belittle another party, while neither asking questions nor giving answers. I personally dont want to pay anyone $500 to find out who they are, why would I........ If you are here to ask questions or give answers or even just to read with interest then thats all good with me and you certainly dont deserve a ban. If you want to abuse or attack people for undisclosed reasons, my personal opinion will change.. And that goes for all of us doesnt it. Can we get back to discussing the car and its purchase by Messirs Swaters & Lanskweert (which is the whole point of this thread)

Yeah but nobody is saying this car is not at least 75% #0384 (except Flobert) and even if less it is certainly the ONLY claimant to its provenance. In other situations you would likely be correct but not this one.

Well you might be right but the only reason ( beyond the real emotion of original parties, K and JS) of this saga is money and greed. So certainly the idea that the car could more expensive than the 275 Nart spyder is what keeps party going and somehow make them agreeing on a settlement as then there will be enough money to make all parties ( or at leat almost all except those that have been left out of the settlement or expected more..) happy. If the sell price ends up low, I would not be surprised that every one is unhappy and I would not even be surprised if the settlement would have different split arrangments depending of the amount. Finally I was at the MM too, you saw me there,,,and I did not hear anything, any gossip,,,except the roaring of my 6 cyl engine,,,and this is what collecting cars is for! At least for me!!

A major part of my file on 0384 is taken up with segments of this case. Not being a lawyer I have made little effort to understand the details, however the final wording of the decision led me to believe the story was not over. From what I understand 0384 will be returned to somewhere in Belgium.All the spares will also come to Belgium having been bought by Gardner from the Kleves to be installed in 0384. Ok now who pays and oversees the resto, organizes the eventual sale etc,etc. It sounds like neither party may never see the car in their possession. My guess is we haven't seen the end of this by a long shot. tongascrew
Based upon the snipes flying between a couple of the people I suspect that the settlement is more likely Round 1 of what is continuing to play out. Maybe not all the same participants will be in the later rounds. Jeff
It seems pretty simple. The court cut the baby in half. The car and the parts get auctioned, the money is placed in escrow and the court pays out as per the settlement. Neither side winds up with the car.
My contention is that there may still be battles warming up between some of the parties beyond the physical car, based upon some of the participants comments. Jeff
it's not clear to me as to what happened, the reports seem to conflict with one another as to what the court has offered... there seems to be a distinct lack of finality as to what the court has ruled is there a time line for events to happen... are the dates already set by the court or to be determined by the parties involved by a date certain set by the court... there is wording of a settlement... is that by mutual agreement of ALL parties involved or at the direction of the court...there is comment that a settlement was generated by an agent representing only one side... have all parties capitulated and resigned to accept the court's directive typically court rulings can be subject to appeal... appeals are made on the basis of some error or irregularity made in the lower court in arriving at its' decision... are there grounds for appeal

The settlement as odererd by the court is that the car be delivered to Bonhams in the UK as well as the parts. They would then be auctioned with funds deposited into a Bonhams escrow account. Funds would then be held until final settlement and agreement of funds are reached. The concern may be that by releasing the parts from Ohio, - Could that affect the court action in Ohio - What about the release of legal claims over the title/ ownership (severe effect on value) - Who secures the parts/ car and ensures that they are not "stolen" again. Wouldnt be particularly difficult to steal the parts and take them to Belgium, make the car whole and what could the estate do about it? Then they would only have the title as a bargaining tool. - International law is entirely different to Ohio or even US law, fighting a suit through the Belgian, International or British courts would be near impossible from what I have read in other cases. Round two may or may not be about the car and parts or about settements OR maybe ego's. Dont forget the claim was that Gardner was financing the suit by Joe Ford/ Kleve - Lawson, now the court docket states that he is now an INTERVENOR. I wonder where he stands now? I just read the Ohio county court docket on the Ferrari 0384AM. The order appears issued this afternoon because of Jospeh L. Ford and Kristie Lawsons history of repeated contemptible conduct in this proceeding before Judge Nadel and their continuing disregard for the Ohio Court that a motion to impose a fine of no less than $500 under R.C. 2705.05 on both Ford and Lawson; and if Ford and Lawson fail to comply with Judge Nadels order to surrender the Ferrari parts to Bonhams, the Ferrari title, power of attorneys, Bill of Sales, that an arrest warrant for both Kristie Kleve Lawson and Joseph l. Ford III, ordering confinement and sentence Defendants to no less than 60 days incarceration 2 under R.C. 2705.05, and (2) order the Sheriff to seize all Ferrari Parts from them and for the sheriff to take possession. To All Yep, some are getting restless while their attorneys generate unnecessary fees. It will all get sorted out and the curtain will be lifted. Like I said, there are many dynamics at work under the surface. I think my email to Bonhams (reproduced below) explains and exposes alot. Read the whole thing more than once to see what is going on - silly distractions that waste everyone's time. Maybe posting the actual email will shake some sense into them. One would think such bs is bad for their business. Mbzgurl - don't quit your day job. There is no Order, just a Motion and a Proposed Order that will be replied to and dealt with in time. Bonhams will act as the escrow agent for the parts, as they have agreed to hold all associated parts (car included) then it will be up to them to secure them. That would be the least of my worries though. This car cannot be on US soil or in an area of the world (wherever that may be that particular day) where a country would agree to seize the car and extradite it to the US. Now that so many parties are involved, many someones will constantly have their eye on its movements, especially at events and events it may be registered to participate. who is going to want this car?

Also good information from Ocean Joe, I would certainly hope that Bonhams is not trying to stiff Kleve - Lawson after everyone else has tried to. To answer the question of Ferraripilot I would suppose the important issue is to retain claim to title until the car is sold but to make legal provision that title will be transferred to purchaser upon settlement of Kleve - Lawsons suit. The issue would be if Gardner or another agent tried to claim the title in the meantime. The rest is all a sideshow, all of the claims of incarceration and all wont cause the release of either the title or the parts. The judge could do that but woud surely need really strong grounds to do it ?
