In fairness, I think Mbzgurl is giving as good as he gets. If there is trolling then surely it is up to the member (principally OJ) being trolled to complain ?

Also lets not forget that both Mbzgurl and OJ started as new chatters on this thread and you have to start somewhere

another thing that is strange... why is the Ohio court relinquishing it's jurisdiction over the case... by allowing / directing that documents and parts be shipped outside CONUS for sale and settlement, it appears it is giving up. Once the order is complied with, the US parties to the suit lose their standing in the US court system making other compliance with the Ohio court moot. It would seem more prudent that the court retain jurisdiction by keeping documents and disputed parts in US for later exchange as part of sale and distribution of settlement proceeds... a kind of delivery vs payment situation and protecting the interest of the US citizens

Mbzgurl claims to be a girl not a "he".

The odds of this car selling for 30MM USD are laughable.

If it does Darwin will be dancing.

JS bought a car he knew was stolen and tried to hide that fact by changing the chassis #.

Sad end to a remarkable life.

Timmmmmy, is your keyboard stuck? I think it is.

That letter is not from any Bonham’s executive. It’s to Bonham’s from Ocean Joe. See the date, see the time. The Court order to surrender the parts had a deadline of August 28, 2013 at midnight. Ocean Joe sends his email to Bonham’s at 7:04 PM on 8/28/2013. Ocean Joe expects to comply with Judge Nadel’s forced surrender of the Ferrari parts, document, kit and caboodle within 3 hours of his email ? So, let me think this out, Ocean Joe is waiting for a reply from Bonham’s in the 5th hour to doomsday. Ocean has 3 hours to get a response from Robert Brooks or the Bonham’s chief legal counsel , then move the parts to a transportation company before the 10 Pm closing time for the storage warehouse down the street from Kristie Kleve, while Swater’s surveillance investigator is sitting at the door so the parts don’t disappear in another mystery ? That means Ocean Joe had 3 hours to comply from the time of his sending the email to Bonham’s.

The email Timmmmmy mentions , posted by Ocean Joe , IMO, is a snow job generated on August 28, 2013 the day the music stopped for Ocean Joe’s self-inflicted stall targeted at Bonham’s. This stall went hard 8/28/2013 putting the mystery woman Kristie Lawson with a motion filed for incarceration and $500 a day for the contempt action. Ocean Joe is not a resident of Ohio, Kristie Kleve is, both already violated the Judge’s order, both could do jail time. As a woman, I can follow this and clearly see between the lines. Where is Kristie Kleve? I’d be sweating while Ocean Ford is out fishing in Florida.

Ocean Joe clearly states in his post 780 , of August 20 ; ‘’Timeframe to appeal Ohio decision - 30 days, but I think it will be done far sooner. Maybe we can tweak or clarify some of the Order's issues and avoid appeal. I'll leave that to the lawyers. If Bonham's can't make the Sept 14 auction, in my view its a whole new auction house ballgame, RM, Gooding's, etc.

Let’s look at this, according to my WOMAN friend lawyer upstairs: There is no appeal for a contempt of court violation before the judge rules on the charges against them. If Ford/Lawson would appeal and delay the surrender of the parts in order to stall the auction house, they would have to put up a bond in the amount of the value of the car – that would be say $200,000, non-refundable, then, Lawson/Ford could be ordered to pay damages daily in addition, or even jailed. The crime already has taken place by their non-compliance. The judge will rule on September 11 . The statement by Ocean Joe ‘’Timeframe to appeal Ohio decision - 30 days, but I think it will be done far sooner, means nothing in having to pay the piper for their contempt. In addition, even this delay could be considered damaging to Ms. Swaters, Bonham’s, and Gardner by Lawson/Ford conspiring to create a delay, well documented in the court filing motions of August 28. That’s what she says at least, I am no lawyer, maybe the Ocean can correct me if I am wrong, but she is a fairly level headed attorney....

She did add on thing, as Ocean Joe apparently owns no property, no Ferrari's, no nothing and is not a resident of Ohio, judgment could go against the Lawson’s property – anything that is attachable in Ohio would be easy.

So, I see it this way, Ocean Joe has no lawyer, he is Pro Se. He made no attempt, nor did Kristie Kleve-Lawson comply with the Court Order to surrender the parts. In fact, Ford/Lawson surrendered no document, in fact nothing as demanded by Judge Nadel. In the Bonham’s agreement, Bonham’s pays for the transporation of the car , we see Ford cut and pasted a clause that does not apply to the parts being paid for by Bonham's , that was for us ‘’Trolls’’ to see. The agreement filed in the court said Bonham’s will auction the CAR and pay for the transportation not the parts. Bonham’s did that already on time.
The car 0384AM is in London along with engines and a load of gear, and all of Swaters ordered compliance is done on time. It reads Gardner has complied also.
    And so it goes.........

I also found a list of all the parts to be surrendered to Bonham’s by Kleve/Ford, that list is about 34 different parts, some numbered, and all original. The detailed information I got is all in the Court Documents just filed.

Anybody have a missing Ferrari? I can see this clearer that you guys, and I’ve only been at this for a week. Maybe I should team up with Kristie, two women against a bunch of Ferrari guys.... hey...it could be a new day job....

So I have a question? Why would Lawson/Kleve violate the court order other than stalling the turn over of the 34 parts ?

A couple of questions (feel free to answer them or not, its a free country)

    - As an interested party BUT NOT A "invested" party you would appear to be privy to exactly what went on in court and have a lot of information that I havent been able to find. Would you like to post some it, links to any documents or websites would be great.

    - I was only referring to what had already been posted by someone else, not giving any credence to it nor stating I had any way of proving it correct OR not.

    - You seem to be very passionate about all of this, even angry can i confirm again you are just an interested viewer of the proceedings rather than an "invested" party.

    - Do you want to see Ocean Joe jailed ?

    Timmmmmmmmmmmy boy….
We know your position. So, I’ll answer you. I am not an invested party, never was and never will be. (Unless Kristi needs a woman partner!)

I never met Ms. Swater, Mr. Ford, Ms. Kleve-Lawson, Mr. Gardner, or anyone else in this "investment". I don’t know any lawyers in the cocktail, I just have a friend I talk to. I saw the NPR spot, and from time to time followed it. When I saw it was settled, we talked to my boyfriend in Dallas about it (a true Ferrari man), and I fell on the thread with interest. Nothing more.

If you have a 'lawyers code' for the court documents, you can see more than 100 pages of documents filed in the past week – everything I mentioned is posted in a series of motions against Ford/Kleve-Lawson. There are thousands of pages of documents, police records, photos, etc, etc. When I read all this stuff, it’s like 'War and Peace'. So, call your own indigent defender upstairs – and ask her for your own code to access the docket. It’s as easy as it was buying your Ferrari diecast car on ebay.

Do I want Ocean in Jail? No. I don’t know him. I only read about him on the internet, same as where I found information on you! Denmark?

This story went crazy on the newsfeeds, from LinkedIn to all the Ferrari feeds…tweeter sounded like geese flying. I took interest.

Then, when I googled Joe Ford III, I came up with a guy who holds the Broward County record for prolonging a lawsuit in Florida Pro-Se. I couldn’t find anything else on him, nothing professional at all, except what the Judge and the lawyers in the Florida case said. He managed to tie up a lawsuit with Pro-se antics, getting away without paying 13 years of taxes and mortgage payments on a waterfront house that he was thrown out of, with a pending judgement of $900,000 in legal fees still chasing him. GMAC Mortgage Company /Joseph L. Ford III ( Circuit Court, Broward County; Jeffrey E. Streitfeld, Judge; L.T. Case No. 97-17536(14)

Then, it makes sense, he’s hired to tie things up again, like an attorney does. Then the pieces fitted more and more. Also, it was a great story; two penniless Americans….Ford and Kleve-Lawson settling a multi-million dollar lottery ticket case and going straight into contempt, calling foul, no response from the MIA Kleve-Lawson hard working 2 job woman and then this board’s cheerleading cheap seats. It’s great stuff. I want to buy the movie rights. I also want to be the first to drive the car!

My Ferrari connections goes to real cars, not Dinky Toys and ebay pictures. My boyfriend had a bunch of them. Real ones. Not miniatures.

So, I can tell you really, I am a woman, not your Little Mermaid but close! My friend upstairs is a lawyer. May I ask Kristi Kleve to PM me? I have a women’s rights offer for her!

    Mona

Having collected much of Ocean Joe's contributions on the developments of this case over the past several years his involvement is now considerably more than just a collector of data.At least I was right about one thing. This is far from over. Everyone's contributions make this very clear. Keep up the good work. tongascrew

Longtime lurker and reader of this forum. I registered to refute a lie by MBZGurl. I know this car. It was originally restored by Mark Passarelli for Dr. Philip Lufty in Arizona and the car was destroyed in an accident. This photo was stolen from Peter Thomas who purchased the burned body from Dr. Lufty. MBZGurl never owned this car, its last known location is in Germany.

I have cross-checked the IP address from the reported post, and it does not match with any other active user.

If it is Pass posting, he's using a completely different IP address than he has ever used before. In fact, the IP address from which the post above was made has never been used for this board before.

First, I have no dog in that fight, but I, like many of us here, find that thread fascinating. A few days ago I was happy that the parties appeared to have settled.

Today I am trying to get a better understanding.

It is undeniable that everybody knew the wreck was chassis # 0384. The wreck left the USA and entered into Belgium using that chassis number.

It may be argued however that Jacques Swaters was free to choose whatever chassis number he wished given that his 375+ was more of a replica than the real car. In the 90s Swaters’ 375+ was a beautiful replica, but with very few parts of the Kimberly car.

I understand that has since, or will be soon, be reunited with the original engine, and soon with some more original parts and bits and title.

So the replica that might be worth $500,000 could be turned into something more like the real thing, which might be worth up to $5M.

If we can blame something on Swaters, it is more of having built a replica than having stolen a car: Guy Anderson who sold 0384 to Michel Kruch restituted the money he made on that transaction to Karl Kleve who apparently abandoned all charges against Anderson. Didn’t that show that Anderson somehow legally acquired the wreck?
