    In Nov 2012 my 06 three pedal spider was t-boned. The entire right side was damaged. The car was taken to the local Ferrari dealer and then sent to their approved body shop for repairs. There was also a rattle in the transmission that needed to be taken care. The car had the power train warranty.
    All of the repairs with the exception of a trim piece were completed by feb 2013. The trim piece was not in inventory and the shop suggested the car be totaled since it couldn't be repaired without that piece. There was a delay of 4 months waiting for this to settled. The transmission was not addressed untill all the body work was done. Finally FNA produces the piece and the car finished and the dealer takes out the transmission for repair. This was in early may 2013. Car was finally ready in Oct 2013. I go to pick it up and immediately notice that the diffuser has been damaged. The general manager says he can't do anything about that right then to come back. The diffuser gets replaced and I get the car. I notice it pulls tothe left and that the right side window won't seal. Call for an appointment car goes back. It pulls because the right front tire was replaced and the left front is worn so they have to order a new tire. Body shop to fix the window at a later date. Go back get the tire replace car alligned now tracks true. Window still needs to be fixed. Winter sets and and the car sits I'm my garage. Drive it a couple of times and notice that the paint just behind the right front tire on the rocker panel is chipping. Call the body shop. They say bring it in and the promise to fix in as a priority. Two days later the car is fixed go to pick it up. The paint looks good now some clear,film over the area. Window seals tight. Cycle the window down and it only opens part way!!!
    The guy says he can't apologize enough I said you are right you can't.
    The insurance company screwed up not totaling this car. It looks brand new but the repairs and the diminished value award i got is close to the value of the car.

    Yikes....sorry for the bad experience. Doesn't sound like the cars fault...he's just a victim, poor lil guy.

    Sucks man...glad to hear it is resolved now. Hopefully you can put it behind you and still enjoy the car. Here's hoping!

    They shouldn't put film over fresh paint!!! Sorry about your troubles. Looking at the Coparts thread it seems as if these cars get totaled for very little reason. I've seen some with what I would call fairly minor right rear quarter damage that were totaled.

    Did the window not seal on the front edge or the rear?

    If they didn't replace the window regulator.. that's probably where the issue lies. I'll wager its bent slightly and that's what's giving the issues... that OR the guiderails.
    They should have known that.

    Window doesn't seal in th back. The entire door and window was replaced don't know about the internals

    I hope that your state has a depreciated value law that accounts for the lower value that a crashed and repaired vehicle will bring. According to my Allstate agent here in NC I would be allowed to collect that depreciated value from the other party in addition to the cost of repairs etc. In most cases involving extensive damage such as your car suffered that would probably cause the other parties insurance carrier to total the vehicle.

    The cost of the repair plus the depreciated value was SIGNIFICANT would have been a way to total it.

    Then I'm really surprised that they didn't. I guess you didn't have any say in the matter. Shame really. So the settlement did include depreciated value from the other party's insurance. At least you won't be out of pocket when you come to sell.

    I did lawyer up. The Ins co screwed up. It was over 60K to fix the car and I got a BIG check for loss of value. The two together are nearly the RETAIL value of the car. pushed for a total from day one. I think they got sucked in with the repair not figuring the loss of value would be an issue. Once the car was fixxed they were stuck. They made a low ball offer which was rejected we push and they finally got someone that knows exotics to look at it and offered a big check for about 45% of the value of the car

    In the end it sounds like you got a good deal. I'm sure you can sell the car (probably advisable) for a discounted price and have enough to buy a very nice 430.

    Hmmm.. Not sure I can claim that but definitely try to be honest.. Hence I've two cars for sell and 18 months later.. Still got them..

    Any potential owner should do a CarFax search and I'm sure that the repair will show up so he will go into the deal knowing that. If he doesn't then caveat emptor.
