The seller is aware of his pricing miscalculation. I would not count this as a sale at this moment.
If anyone interferes with this transaction, I will hold both the Buyer and Seller legally responsible.

Car sales on eBay aren't legally binding. Either party can walk away from the sale with no legal recorse for the other party.
Think again. I bought a super rare Porsche on fleabay 10 years ago. The seller got tipped off that the car was sold too cheap and told me to take a hike AFTER I paid for it. He then asked me for almost double of the auction price via email. This is where I got his local sheriff involved + my lawyer sent him our intent to sue for "specific performance" via Fed Ex if he did not honor the auction. Two weeks of back and fourth, I was told to go get my car & did. I would tread very carefully if I were you when playing legal counsel on the innerwebs.
I'll say. these cars in good shape are way past $140K, at least at this time. But the eBay sale is a contract both ways. The seller refusing to sell after the buy can be sued. This is probably the best deal of the year. See Iknew you could find 25th at $140K still !!
this makes no sense. I think this policy should not be misinterpreted into a "no responsibility" game.The seller had a buy t now and asked for a deposit. If deposit was sent as outlined, I am sure an attorney will blast thru this. This would fall under "sellers remorse" to me. but a suit would not certainly be easy across state lines. If you would be right,then selling homes or car on ebay would be played by 12 years old having fun and would totally destroy that business model. Heck,anyone could post his car to see how much it'll bring get some money and refund it at one's leisure!
The seller might be taking a risk. The car could become dead in the water if it appears on ebay a 2nd time..... at much higher price. However, we all know there is an ass for every seat.
Once you pay you have a binding contract. Just clicking the bin button on the screen means nothing in terms of an enforceable contract. If I were you I'd read what is written not whatever nonsense is running around inside your head when your are forming your responses.
When you click to buy you do have an enforceable contract. The problem is paying a lawyer to do the enforcing causes the unscrupulous person on the other side to count on you not having the money or willingness to sue for damages or specific performance. But "click through" contracts are clearly as enforceable as traditional pen and ink contracts.
Sorry but eBay themselves disagrees with what you are saying. You don't have to believe me. Just read the non binding bid policy posted above. ALL bids made on eBay motors are NON BINDING. You don't have to be a lawyer to undersand this. Google eBay seller refuses to honor winning bid and 18 billion responses will pop up. The only reasons triple x had an enforceable contract was he paid the seller and the seller accepted the money then later tried to extort more money from him.
I think the non-binding policy for real estate and autos is more because of the complexities of those transactions across State lines where the purchase may be affected by regulations that may not be able to be resolved easily. Hence the no harm, no foul if one party has to back out. Clearly, this situation may not be subject to those complexities, but the non-binding definition by ebay still throws a dark cloud over the whole thing.
I interpret the non-binding bid policy as not binding on the BID side. It never states that the seller is not bound. Here is a list of things that eBay says are NOT allowed (this is just below the Policy Overview): - Bidding without the intent of completing the purchase - Retracting a bid on an item that doesn't fall into a non-binding bid category - Backing out of the transaction due to buyer or seller remorse - Backing out of the transaction because buyers didn't place a high enough bid and the seller didn't add a reserve price - Stating in the listing that bidding could result in a binding obligation to complete the purchase It sounds to me like the buyer should get the car if he pays for it.
Look at the second point you make. Auto sales on eBay are non binding. At goes both ways. Buyer and seller are not bound by the auction results. All real estate and auto are non binding.
That wasn't the policy back in 2003 when I did my transaction. =) It's almost pointless to play around on eBay when doing cars or real estate. The buyer can simply flake out every single time. Total waste of time.
Absolutely correct. As an advertising vehicle it may work, but proceeding to a sale is a crap shoot at best.
So I wrote the seller of the car, I inquired about the car and the sold price repeating the 139.9 and he replied yes, the price was correct at 239.9... notice I have a 2 in there not a 1 for 139.9... Not sure whats up, but something is totally a miss with this entire deal, count on it. On a personal note this is my first post, I acquired a 1984 Euro 5000S just this past month and look forward to getting information from what seems to be a wealth of knowledge from all of you.

Now that the Countach value curve has gone inelastic, what would you guys think of the other cars in that era and directly after, value wise? Which cars will benefit, value wise from Countach's Rise in Price? The Jalpa, the 80's baby Countach? The Diablo, the C's successor, just about as dramatic and the last car made before Audi took over?
jalpa now but not SO higly priced the diablo will be more expensive but needs time today is countach time for lamborghini values
