He is on everything you ever did for one reason you worked for him and he was your employer. I am positive you will have a chance in court to show how such an expert as you claim operates. Your only Ferrari contact was acting for Gardners car businesses. You have no transactions or ownership interest in any Ferrari car that is not tied into Gardner, and the time you worked for him. Nor have you ever sat in a Ferrari in fact. When you went out on your own in the car world, you were known for rusty MGs then you quickly and switched to the Unauthorized Practice of Law charging people like Gardner for fiduciary lawyers fees, and chasing new partners like Big Dog Tom Price and other known collectors of the car community. Ford worked full time for Gardner in 1988, and in 2006 came on with his law license to continue. Gardner used Ford to do contracts and source cars for Gardner, and hammer down deals. Gardner also did business with Ferrari Los Gatos, ( several 300SLs) who he did the deal with providing the Daytona/TR exchange. Ford had Zero contacts in the car business. Only using Gardners funds and business contacts, Ford worked for Gardner as he was instructed. 'Simple as That'. The Daytona, owned by Bill Simmons was exchanged by Los Gatos in the deal. Ford had no role as a principle, he was Gardners agent, and 'yes man' At that time in 1988, and as now, Ford was hungry and desperate. The deal was done this way because Simmons wife could not agree for CG to buy the Daytona for personal reasons involving Simmons 52 Hinckley Racing Yacht. She was pissed off at that, Gardner sold it. Same deal with the Kleve Ferrari, Gardner sent Ford in to contract on his behalf. Hence, Ford writes in John Doe Car Collector into the 375 plus deal. That John Doe was Gardner, recovering from a fairly serious bone transplant while Ford is empting his hard-drives while repairing cabinet trim in Gardners house. An interesting case from the "gray market" bad old days of the '80s. According to the opinion of the U.S. 5th Circuit Court of Appeals in the link, in 1989 Gardner was charged with 10 instances of importing non-federalized German cars, through the fraudulent use of an EPA loophole which excused compliance from EPA regulations if the "importer" intended the car for personal use. Turbo Porsches and AMGs come to mind. Gardner's scheme was to pay $50 to straw men, to falsely pose as the importers with respect to these cars. Gardner pleaded guilty to two counts, with a reservation of the right to appeal. Gardner's argument on appeal was that the person who signs the U.S. Customs paperwork as the importer of the car need not be the owner of the car. The court disagreed, and affirmed Gardner's two criminal convictions. According to the Court, because the EPA loophole is available only to an individual importing the car for personal use, and because Gardner's straw men did not meet this requirement, "Gardner's scheme was designed to conceal a material fact from the United States." I'm not going to say this was OK. But we must also admit that the gray market of the 80s had a lot of gray areas. The emissions performance of many of the cars that did receive EPA sign-offs was marginal. Many certified cars were promptly divested of the add-ons as soon as they cleared customs. Few on the road today continue to retain this gear. In fact it's a violation of EPA regulations to "tamper" with *any* emissions equipment on *any* emissions-controlled car. Advancing your timing a couple degrees beyond factory spec, or rejetting your carburetors, are likely to make you a tamperer. Removing catalytic convertors would do it for sure. Of course no one on this board would do these things. But Porsche and Mercedes-Benz owners just might.

You mean "posts" into "this thread".. Why were they so worried about getting the "last parts" do you think? They had most of the car via prior theft, Kleve had gone to the FBI, and he certainly had the ability to reproduce the rest. Really, all his efforts to reclaim the original engine from America, it would have been faster to just have Classiche cast the block and build it? It's obvious to me that Swaters at some point, became fixated with completing this car. Why??? Not much left of Max Vito but wild flailing and vitriol.....he's done. He hasn't brought any hard facts in here since he started really, just taunts and insults.
Surely some hurt feelings displayed. Normally, that's by the losers in a conflict, but Max Vitos posts sound more like boasts from the winning side (the Auction Team), but have they truly won?? Ocean Joe has always SEEMED to share the inside view, from the Kleve side, historical videos and transcripts, and that has been interesting to see. Hard to say, as if Bonhams is called on what seems to have transpired, it would certainly do damage to reputation. Real world damage. Whoever comes out on the bottom of this fiasco is gonna stay there a long time. IMO.

Bonhams sold the car, in spite of failure to do so per the original agreement, 50/50 split deal. It had timed out, and each side is blaming the other (has to do with retrieval of the OEM hood and a few other bits, gas tank) They built a wire frame display stand for these items (Bonhams) so, hard to tell where fault lies, in any event, the agreement was voided by the calendar..... Joe warned them, Ohio court placed a hold on the sale, they did it anyway. Chris Gardner found some lawyers to file claim in Ohio, to the 50%, that was to go to Kleves daughters. Some one bought the car for big bucks, (albeit reduced value from the stench of death of original parties, ongoing title dispute) but Bonhams can't give him clear title, see note above. Chance if Joe loses, the Kleve's heirs are cut out entirely, by Gardners claims... Tune in tomorrow for As The Ferrari Wheel turns!
