    Let the character assassination continue. Fox News has "bombshell" evidence that Tony Stewart has a past history of on track "anger", including "comments" made after being involved in a "racing incident". Wow, just wow.

    How many racers show emotion and anger? I understand that not all racers have hit another driver running on track, but as someone else posted - if this were 2 local racers, it would be a blip.

    Again, he may have had intent, he may not have...we don't know. This is turning into George Zimmerman all over again. Next thing, we'll have his grade school teachers being interviewed that he had anger issues in 5th grade.

    Stop the madness.

    remember tony threatening to "bust his azz" when referring to joey logano last year? which turned out to be a joke as tony was never anywhere near joey after the first fists were thrown...joey turned out to be too fast on the track for tony to catch.

    clearly tony has some history of emotion and nascar fans in some ways have long since apoointed him the nascar tough guy...or the next intimidator. it is what it is...

    The Frances are to blame, but not responsible, for this behavior. They and NASCAR have fostered a WWF-type of drama by not disciplining boorish behavior by their participants. What would Bernie do? The yahoos would have been purged.

    I agree completely...and I would think the Ward estate would have grounds for a lawsuit against everyone that allowed this behavior to continue....and if nothing is done now, even more liability

    ... from this point onward, it's a PR war.

    Thing to do now, for the people at Stewart Haas Racing is, get those videos banned, lower the volume, leverage the Ontario County Police, place a mole there if possible, begin the process of a preliminary settlement, and begin assembling personnel necessary for a top-down a media campaign for which to poison potential jury pools and emphasize the social civic contributions of Tony Stewart.

    If possible, get him a girlfriend, and get him engaged to be married, triple ASAP (e.g., not a swimsuit model; a girl-next door archetype; comely, but not too attractive; as though he's fallen in love with who she is, not what she is).

    Thing to do if you're the Ward family is, take page 1 out of the NAACP playbook, start floating 7 year old photographs around the on-line media, how Kevin Ward was just a wittle baby boy eating his Skittles.

    I'm afraid our boy Tony Stewart has caught the attention of the policy community. He is about to become motor sport's rude equivalent, to George Zimmerman. Bet you coffee and doughnuts Tony Stewart now has a fusion center analyst assigned to him, compiling his dossier, probing his periphery, watching every single thing he does.

    Little birdy just tweeted, Ontario County Sheriff is not (NOT) in possession of Tony Stewart's Go-Pro on board. Apparently, he had ample time to delete it - asj.

    If ward's first reaction after a crash is to walk onto the track it was only a matter of time before he was hit. It sounds heartless, but bad decisions have consequences.

    To the best of my knowledge, NASCAR has nothing to do with any of this.

    Also, Tony Stewart Racing is a separate entity from Stewart Haas.

    So, Ward is so distraught he throws himself off a building. On the way down, TS, who's flying a plane, hits and kills him in mid-air.

    Is TS liable for the death of Ward?

    But...Tony will at some point very, very soon have to kiss the ring.

    Don't think for a second that the ripple effect is not a concern of the France family. A driver can do what he/she pleases outside of nascar so long as his/her actions have no negative net effect to the powers that be. Life under the nascar microscope.

    Again, it is what it is and it is they life they choose.

    By th way if asj has some inside track to info, based on his last post we drop concern of the criminal consequences and focus on a civil action or more likely a settlement.

    What has not been discussed is what if the ward family gets guidance from a hot shot litiigator...he yells them not to quickly settle and to threaten to go to trial. Clearly the stakes could be higher for the family but also the litigator.

    Now, I would also like to know who asj is and why after two years of membership on fchat, has he finally broken his silence?

    His message may be over the top for some but is is by no means all wrong either. Like it or not.

    No..but the organizations that fostered his behavior and did little to stop it may very well be liable....
    He did make his own decision to be stupid enough walk out on the track...as others have done before...

    ... legal fact of the matter, whether Kevin Ward placed himself in harm's way, will inevitably fizz. In motor sport, flagging is sovereign. Stewart didn't run down Ward on a green flag. Stewart ran Ward down, after having been ordered to stand down, by race officials (e.g., the yellow flag).

    Rather, intent may not be inferred from Stewart's actions alone that lap, but only when viewed in tandem with the lap before, when Stewart (1) deliberately drove Ward into the wall. Then, (2) ex post facto the caution flag, was Stewart observed in the video (a) traveling a far greater speed than the drivers having previously passed Ward's position, (b) rate of acceleration increasing, AND (most significantly; c) Stewart is observed to be significantly higher on the outside line, than any of the drivers having passed Ward's position after the caution flag, implying Stewart was out of compliance with race control and the flagman; as such, that Stewart elected to forgo last clear chance to avoid Ward, intent may be inferred.

    This video evidence is so compelling, it can be argued Ontario County Sheriff Phillip Provero is incompetent. This video evidence alone was sufficient to cuff Tony Stewart, arrest him, and charge him, and read him his Miranda, on-the-spot.

    How the court rules, whether the lap before is allowed into evidence, or dismissed as wholly irrelevant, is what makes or breaks Stewart's defense.

    Supreme authority of all motor sport vested, to the flag man, that Stewart did not stand down on the caution flag, that Stewart killed Ward, on a caution flag, it is not looking good for Tony Stewart - asj.

    County seat in Ontario County is Canandaigua. That is where Tony Stewart's trial would otherwise be held. If charges were conferred upon Stewart, Canandaigua most certainly doesn't have infrastructure sufficient, for an OJ trial.

    There aren't enough 5 star hotels, for the newsies of the yellow press (horrors!).

    The good people of the sleepy, backwater community of Canandaigua are not going to want the world press stinking up the place, stopping up their toilets, tossing candy wrappers and cigarette butts, in their gutters. They're going to want this whole Tony Stewart thing packed up, and shipped, anywhere but there

    Though a Tony Stewart kangaroo court would be just the thing, for local enterprise, owing to logistics, it's impracticable -- asj.

    Even in this discussions alone there seem to more people who believe the video shows nothing that incriminates Stewart. So much for 'compelling' eh? But believe what you want. Just be careful when you accuse someone on a public internetforum of the crime of murder or at least manslaughter when your 'evidence' is questionable to say the least. It is called 'defamation' I believe and it can bite you in the a$$.

    I meant to respond to his earlier.

    Watch this vid - observe when a driver divebombs, that the driver to the outside yeilds - and gets their car pointed down the next straight. The divebomber, has to make a harder turn on exit once they get in front, so they don't have the exit speed. Trying to race a divebomb(in karting speak) off the corner in dirt is silly, when all you have to do is cross back under as they slide up. If a car is on the outside, and in front, the car below would see them, and it would be unwise of the driver below to come up into them. I'd said earlier, and outside trailing position in specific, rather than simply outside.
