    In one breath he has said he ordered it was let down and he will refund me. In the next business is bad and he has no funds. Yet he was supposed to pick up my part last week for which he must have had funds. Sadly I will probably have to go down the legal route. I live in Dubai and here what he has done is fraud and is a criminal charge. They can extradite from Italy, even for this small amount 2580 euros. Dont like to do it but if thats the only way to get my money back then so be it. Its all well and good saying you will refund but then he has to produce the funds. Ive offered him every chance but he continues to be aggressive and rude. Time will tell. He has a week.

    Just as a side note, litigation in Italy is often slow, expensive and occassionally quite surprising in the end. A proceeding, wherein the plantiff claims money, statistically has a duration of about 1000 days (first instance). Depending on which court (location) is responsible, this duration may be rather 500 days or rather 2000 days. And defendants can effectively stretch all this considerably ....

    P.S.: The Italian fellow, who supplied me with very rare (used) parts, had and presumably still has the habit to first send the parts and then ask for the agreed payment after I had received them. His proposal, not mine. Quite the opposite of this example here ....

    I have just been scammed by Orlando Vetrano for 7,800 euros.... for carbon sports seats for a F512M. He wanted 15,000 euro for new seats but I was not sure about him so went for the cheaper ones. I have now instructed an Italian lawyer to issue proceedings against him, which will cost me a lot but at least other genuine Ferrari fans will not be ripped off if he is shut down.

    Vetrano would string me along with excuses like, he has funeral to go to and the seats are somewhere else in Italy, but now I really know the seats are never going to arrive.

    Some of you will say serves you right for being naive, but such is the demand for genuine Ferrari parts I'll do anything to get them and that means taking risks I would not usually take. Does anyone have any other tips of how to deal with Italian fraudsters?

    At the time of purchase I was not a member of Ferrari Chat. Not everyone is, so please spread the word at the club, with your friends, with mechanics, to stay away from Orlando Vetrano at La Scuderia Rossa.

    Vetrano is ripping people off because he has spotted a need in the market for Ferrari parts because Ferrari's own spares and parts department is rather useless indeed. Whenever I contact Marenello UK, all I get is, "None in stock, not made anymore". Ferrari need to license a manufacturer to make these rare parts thereby reducing the need for scam artists. Ferrari really need to address this issue otherwise more La Scuderia Rossa's will rise up up.

    Now I need some seats for a 512TR or F512M. If anyone knows of any please message me.

    Delete thread. Oh, he didn't refund after all. Undelete thread. Oh, he'll refund now if you delete it again. Rinse and repeat. That's a waste of our time.

    If you hadn't posted here you wouldn't have gotten an offer to refund to begin with, so you're no worse off for having posted. If he is going to refund, he should be willing to do it for your full public retraction. If he isn't, then he's just playing you and we won't waste our time on such games.

    If LaScuderiaRossa refunds your money you can post a full retraction of your charges. That's the best deal you and he are going to get on this site.

    I should have checked here before, I ordered brightwork for my 365 2+2, I paid 3800 Euros in good faith on April 14. I notice his website is still up, so he could be traced? I will be more careful next time.
    What can we do now? I have informed my bank, but do not know if that helps. Is the Italian legal system efficient in this respect? If Orlando has done this before, they should know him?

    I tried to contact you, but your telephone lines are disconnected and you do not respond to my emails.
    I will now hand this to lawyers and will start prosecution.
    You can avoid this by refunding the 3800 euros that I paid on April 17 no later than May 9.
    If these funds are not in my account by then, I will start proceedings.

    While I sympathize with your situation, one thought occurs to me based in the letter / email that you sent. In many jurisdictions, threatening criminal action in order to collect a debt is in itself a criminal act.

    Saying "you are a thief and I am pressing charges" is perfectly OK.

    Saying "you owe me $X and I want it now" is perfectly OK.

    Saying "you owe me $X and if you don't pay I will sue in civil court to recover my money" is perfectly OK, and is often a necessary requirement before actually suing.

    However, saying "you are a thief and I am pressing charges, unless you pay me $X" in certain jurisdictions is considered extortion. I don't know the specifics or whether this applies under either Italian or Dutch law, but I can assure you from first hand experience in the Collections industry that more than one outright thief has used this to turn the tables on an over zealous collector. In the end the thief walks away completely untouched while the collector is charged with a crime.

    Orlando Vetrano has been scamming people long enough that I'm sure he knows the laws inside out. I would be careful what you put in writing to him until you have confirmed exactly how this may or may not apply in your case.


    Edit: you may already have done so, and good on you for doing so. Please excuse my concern as I have seen it happen too often, and I have no sympathy for thieves twisting the law to their own advantage.

    All contracts will have a clause somewhere in them that defines the governing jurisdiction. I'll bet dollars to donuts that your checking account at your local bank is governed by the laws of the State of Delaware no matter which state you live in, and it says so in your agreement.

    Online terms and conditions will also have this. Those pop up windows we are supposed to read before we click "I Agree" will have it in there.

    Orlando may have inserted it a bit clumsily, but it tells me he is slightly more sophisticated than your average internet scam artist that he does have it. It means if you want to come after him, you have to go there. You can't start an action against him in Singapore, for example, and compel him to answer.

    Not sure how exactly it is inserted and therefore how enforceable it is, but it is a smart move on his part to try.
